Alina Habba, a lawyer for Trump, said the legal team had asked the mid-level state appellate court to halt the order from\u00a0New York Supreme Court Justice Arthur Engoron.<\/p>\n<p>\u201cThe preliminary injunction imposed by the court is overly broad, overreaching, and unenforceable on its face,\u201d Habba said in a statement, multiple media outlets reported. \u201cWe trust that the Appellate Division will reign in the Attorney General\u2019s unbridled desire to exert control over The Trump Organization.\u201d<\/p>\n<p>Lawyers for The Trump Organization argued in court papers that Engoron\u2019s decision essentially\u00a0handcuffed the company, restricting its ability to freely make deals, sell assets, and change its corporate structure, putting \u201cimmediate and unlawful prejudgment restraint\u201d on what they said was nearly $5 billion in assets.<\/p>\n<p>The appeal comes in a\u00a0civil lawsuit, filed on Sept. 21 by\u00a0New York Attorney General <a href=\"https:\/\/www.theepochtimes.com\/t-letitia-james\">Letitia James<\/a>, a Democrat. The lawsuit\u00a0(<a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/tto_complaint.pdf\" target=\"_blank\" rel=\"noopener\" data-summari-detected=\"true\" data-summari-has-summary=\"false\">pdf<\/a>) seeks at least $250 million in \u201crestitution\u201d for the people of New York and alleges that Trump, The Trump Organization, three of his children, and others were involved in \u201cyears of financial fraud to obtain a host of economic benefits.\u201d<\/p>\n<p>Trump has criticized the lawsuit, calling it a politically motivated attack.<\/p>\n<p>In mid-October, James asked (<a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/452564_2022_people_of_the_state_of_v_people_of_the_state_of_affidavit_or_affirm_3986.pdf\" target=\"_blank\" rel=\"noopener\" data-summari-detected=\"true\" data-summari-has-summary=\"false\">pdf<\/a>) Engoron to block Trump from moving his assets to a new holding company formed amid the pending lawsuit. She expressed concerns that Trump was moving assets out of New York to evade her reach. The Trump Organization had registered a similarly named new company called \u201cTrump Organization II LLC\u201d on the same day that she filed her civil lawsuit. She also asked Engoron to appoint an independent court monitor.<\/p>\n<p>Engoron, in his 11-page Nov. 3 order\u00a0(<a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/ecf_-_decision_on_pi.pdf\" target=\"_blank\" rel=\"noopener\" data-summari-detected=\"true\" data-summari-has-summary=\"false\">pdf<\/a>), granted James\u2019s request and barred The Trump Organization from selling, transferring, or disposing of any noncash assets without having 14 days of written notice to James\u2019s office and to the court. He also stipulated that the company provide at least 30 days before any planned restructuring.<\/p>\n<p>The judge said The Trump Organization must provide to the independent court monitor a full accounting of the company\u2019s finances and structure, as well as\u00a0any new financial disclosure that The Trump Organization makes to banks and insurers.<\/p>\n<p>The court monitor would be appointed at a later date, he noted.<\/p>\n<p>Engoron wrote that Trump and The Trump Organization \u201cdemonstrated propensity to engage in persistent fraud\u201d and that appointing an outside monitor \u201cis the most prudent and narrowly tailored mechanism to ensure there is no further fraud or illegality\u201d pending the resolution of the lawsuit.<\/p>\n<p>Trump pushed back on Nov. 3 against Engoron\u2019s order.<\/p>\n<p>On his Truth Social platform, Trump wrote: \u201cToday\u2019s ridiculous ruling by a politically-motivated, hand-picked judge makes it even more vital for courts in both New York and Florida to do the right thing and stop this inquisition. We have to fight back against radical tyranny and save our Country!\u201d<\/p>\n<p>A day prior\u2014on Nov. 2\u2014Trump\u00a0<a href=\"https:\/\/www.theepochtimes.com\/trump-lawsuit-claims-ny-attorney-general-letitia-james-pursuing-crusade_4838894.html\" target=\"_blank\" rel=\"noopener\" data-summari-detected=\"true\" data-summari-has-summary=\"false\">filed a lawsuit<\/a>\u00a0in Florida State Circuit Court against James, alleging that she has\u00a0contravened both New York and Florida law in\u00a0engaging in a \u201cwar of intimidation and harassment\u201d against him, his family, his business interests, and his associates.
