Wade<\/em>, which legalized abortion on demand in the United States through broadly defining \u201chealth.\u201d<\/p>\n<p>In <em>Roe v. Wade<\/em>, the court held that states could issue virtually no regulations for first-trimester abortions and some regulations for second-trimester abortions, but only for the purpose of protecting the \u201chealth\u201d of the mother.\u00a0In the third trimester, when the child is viable, the 1973 court ruling allowed states to \u201cproscribe\u201d abortion, or make it illegal, contingent on the existence of exceptions to protect the mother\u2019s life and \u201chealth.\u201d<\/p>\n<p>Issued on the same day as <em>Roe<\/em>, the lesser known <em>Doe v. Bolton<\/em> case defined the \u201chealth\u201d of the mother as \u201call factors\u201d which affect the woman, including \u201cphysical, emotional, psychological, familial, and the woman\u2019s age.\u201d This legalized abortion on demand for all reasons up to birth on the federal level.<\/p>\n<p>When the court overturned the <em>Roe<\/em> decision this summer and returned the right to legislate abortion to the states, Michigan\u2019s 1931 ban on all abortions with only an exception for the life of the mother kicked in. A state court judge placed a permanent injunction on enforcing the law on Sept. 7, but that was not enough for Michigan pro-choicers.<\/p>\n<p>\u201cWith today\u2019s decision, Michigan\u2019s antiquated 1931 law banning abortion without exceptions for rape or incest and criminalizing doctors and nurses who provide reproductive care takes effect,\u201d Michigan Gov. Gretchen Whitmer (D.) said in a <a href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2022\/06\/24\/whitmer-statement-on-ruling-in-dobbs-v-jackson\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. \u201cFor now, a Michigan court has put a temporary hold on the law, but that decision is not final and has already been challenged.\u201d<\/p>\n<p>Abortion advocates started working on a ballot proposal to enshrine the right to abortion in Michigan\u2019s Constitution in anticipation of the <em>Dobbs<\/em> decision. Prop. 3 would flip Michigan from one of the most pro-life states in the country to the most radically pro-choice. It would <a href=\"https:\/\/thefederalist.com\/2022\/10\/28\/if-michiganders-re-elect-whitmer-and-pass-prop-3-kids-arent-safe-from-sexualization-at-school\/\" target=\"_blank\" rel=\"noreferrer noopener\">invalidate all of Michigan\u2019s pro-life legislation<\/a>, eliminating laws requiring parental consent for minors to get abortions, rules that only a licensed physician can perform an abortion, and the state\u2019s ban against partial-birth and late-term abortion.<\/p>\n<p>Prop. 3 would establish \u201ca new individual right to reproductive freedom, including right to make and carry out all decisions about pregnancy.\u201d It allows the state to \u201cregulate abortion after fetal viability,\u201d but prohibits laws preventing abortion if a \u201chealth care professional\u201d deems it to be \u201cmedically needed to protect a patient\u2019s life or physical or mental health.\u201d This broad, vague clause prevents the legislature from passing bills regulating abortion in any way, as anything could be construed as necessary to protect physical or mental health, including anxiety or stress about the pregnancy.<\/p>\n<p>Michigan law <a href=\"http:\/\/www.legislature.mi.gov\/(S(iokee4rnflxfuep5atq2ewj1))\/mileg.aspx?page=getobject&#038;objectName=mcl-333-26263\" target=\"_blank\" rel=\"noreferrer noopener\">includes<\/a> anyone who is \u201clicensed or registered or otherwise authorized\u201d under <a href=\"http:\/\/www.legislature.mi.gov\/(S(xpftfkjtlsvqk4wjnwczh4d0))\/mileg.aspx?page=GetObject&#038;objectname=mcl-368-1978-15\" target=\"_blank\" rel=\"noreferrer noopener\">article<\/a> 15 of the Michigan Public<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Doe v.
