Bruen<\/a>]<\/em> \u2013 dictates that New York\u2019s new place of worship restriction is equally unconstitutional,\u201d Sinatra said, The Daily Caller <a href=\"https:\/\/dailycaller.com\/2022\/11\/06\/new-york-gun-law-john-sinatra-jr\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>\u201cThe Constitution and the Bill of Rights are the Status quo \u2013 not 2022 legislation on the books for nine weeks,\u201d the judge continued, taking aim at the Democrat-controlled New York legislature. \u201cLegislative enactments may not eviscerate the Bill of Rights. Every day they do is one too many.\u201d<\/p>\n<p>\u201cThe nation\u2019s history does not countenance such an incursion into the right to keep and bear arms across all places of worship across the state,\u201d Sinatra wrote. \u201cThe right to self defense is no less important and no less recognized at these places.\u201d<\/p>\n<p>The federal judge in October issued a temporary hold on the law, similarly <a href=\"https:\/\/www.lockportjournal.com\/news\/local_news\/judge-issues-injunction-against-ny-gun-control-law\/article_4d336f74-5c91-11ed-91b6-cbd3b792802f.html\" target=\"_blank\" rel=\"noopener\">writing<\/a>, \u201cIn <em>Bruen<\/em>, the Court made the Second Amendment test crystal clear: regulations in this area is permissible only if the government demonstrates that the regulation is consistent with the Nation\u2019s historical tradition of sufficiently analogous regulations. \u2026\u00a0New York fails that test. The State\u2019s exclusion is, instead, inconsistent with the Nation\u2019s historical traditions.\u201d<\/p>\n<p>In its\u00a0<em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\">New York State Rifle &#038; Pistol Association Inc. v. Bruen<\/a> <\/em>decision, the U.S. Supreme Court in June ruled that longtime restrictions New York placed on carrying concealed firearms run in violation of Americans\u2019 Second and 14th Amendment rights, <a href=\"https:\/\/www.dailywire.com\/news\/breaking-scotus-strikes-down-new-york-concealed-carry-restrictions-restrictions\" target=\"_blank\" rel=\"noopener\">The Daily Wire<\/a> reported.<\/p>\n<p>The case centered on a 1911 New York state law that\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/supreme-court-weighs-challenge-to-new-york-states-concealed-weapons-permit-law-11635931800?mod=article_inline\">conditioned<\/a>\u00a0the right to a concealed carry permit on \u201cgood moral character\u201d and \u201cproper cause.\u201d The Supreme Court majority opinion, written by Justice Clarence Thomas, took issue with the latter condition, which unlawfully forced New Yorkers to demonstrate \u201ca special need for self-defense.\u201d<\/p>\n<p>\u201cWe know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need,\u201d Thomas wrote. \u201cThat is not how the First Amendment works when it comes to unpopular speech or the free exercise of religion. It is not how the Sixth Amendment works when it comes to a defendant\u2019s right to confront the witnesses against him.
