It is unclear how much of Twitter\u2019s workforce Musk plans to lay off.<\/p>\n<p>In their lawsuit, plaintiffs, who filed the lawsuit on behalf of themselves and others \u201csimilarly situated,\u201d allege that the move amounts to a violation and \u201canticipated further violation\u201d of the federal Worker Adjustment and Retraining Notification Act, as well as the California WARN Act.<\/p>\n<p>The\u00a0federal Worker Adjustment and Retraining Notification Act is a U.S. <a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title29\/chapter23&#038;edition=prelim\">labor law<\/a>\u00a0requiring that employers with 100 or more employees provide\u00a060 calendar-day advance notice to employees regarding mass layoffs.<\/p>\n<p>The <a href=\"https:\/\/www.shouselaw.com\/ca\/labor\/wrongful-termination\/warn-act\/\">California WARN act<\/a>, short for\u00a0Worker Adjustment and Retraining Notification Act,\u00a0is slightly more strict. (Justin Sullivan\/Getty Images)<\/figure>\n<h2>No \u2018Advanced Written Warning\u2019<\/h2>\n<p>\u201cIt has been widely reported that Twitter plans to lay off about 3,700 employees, approximately 50 percent of its total workforce,\u201d plaintiffs wrote in Thursday\u2019s lawsuit, referencing multiple reports regarding the planned layoffs.<\/p>\n<p>\u201cTwitter began the layoffs with a few employees,\u201d the lawsuit states, alleging that one of the plaintiffs was terminated on Nov. 1 without being provided with \u201cadvanced written warning, as required by the federal WARN Act and California WARN Act.\u201d<\/p>\n<p>The lawsuit also states that three other plaintiffs in the lawsuit were allegedly locked out of their Twitter accounts on Nov. 3, which they \u201cunderstood to signal that they were being laid off.\u201d<\/p>\n<p>\u201cPlaintiffs are very concerned that Twitter will continue these layoffs without providing the requisite notice,\u201d the lawsuit noted while stating that Musk\u2019s eclectic vehicle company Tesla also \u201crecently engaged in mass layoffs without notice.\u201d<\/p>\n<p>That company (Tesla) \u201cattempted to obtain releases from laid-off employees without informing them of their rights under the federal or California WARN Acts. (Hannibal Hanschke\/AP)<\/figure>\n<h2>Layoffs Will \u2018Place Twitter on a Healthy Path\u2019<\/h2>\n<p>\u201cWe filed this lawsuit tonight in an attempt the make sure that employees are aware that they should not sign away their rights and that they have an avenue for pursuing their rights,\u201d Shannon Liss-Riordan, the attorney who filed Thursday\u2019s complaint, <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-11-04\/twitter-sued-for-mass-layoffs-by-musk-without-enough-notice\">told<\/a> Bloomberg in an interview.<\/p>\n<p>\u201cWe will now see if he is going to continue to thumb his nose at the laws of this country that protect employees,\u201d Liss-Riordan added, referencing Musk. \u201cIt appears that he\u2019s repeating the same playbook of what he did at Tesla.\u201d<\/p>\n<p>An <a href=\"https:\/\/www.theepochtimes.com\/elon-musk-to-begin-twitter-layoffs-friday-morning-reports_4841010.html\">internal company message<\/a> shared among Twitter employees this week,\u00a0which was\u00a0published\u00a0in full by Business Insider, informed workers that layoffs will be announced on Friday morning.<\/p>\n<p>\u201cTeam, In an effort to place Twitter on a healthy path, we will go through the difficult process of reducing our global workforce on Friday,\u201d the message\u00a0reportedly states.<\/p>\n<p>\u201cWe recognize that this will impact a number of individuals who have made valuable contributions to Twitter, but this action is, unfortunately, necessary to ensure the company\u2019s success moving forward.\u201d<\/p>\n<p>According to the message, Twitter will temporarily close its offices on Friday, and all badge access will be suspended during the process.<\/p>\n<p>Earlier this week, billionaire Musk <a href=\"https:\/\/www.theepochtimes.com\/elon-musk-says-new-york-times-report-on-avoiding-payouts-to-twitter-employees-is-false_4830863.html\">denied<\/a> a report by\u00a0The New York Times\u00a0that he planned to lay off some Twitter employees\u00a0before Nov. 1,\u00a0when employees were scheduled to receive stock grants as part of their compensation.
