Californians will vote on an amendment, Proposition 1, which would add the \u201cfundamental right to reproductive freedom,\u201d to the state constitution in a jurisdiction where abortion is already legal and widely popular. But that hasn\u2019t stopped prominent Democrats from spending time and money on building support for the amendment. <\/p>\n<p>Even though Proposition 1 adds no new protections to abortion, and abortion is and will remain legal in the state of California without passing the amendment, many of the country\u2019s most prominent Democrats such as Gov. Gavin Newsom and former Secretary of State Hillary Clinton have rallied and raised millions for the \u201cYes on Prop 1\u201d campaign. In addition to Proposition 1, Newsom is expected to sign more than a dozen abortion-related bills this year. <\/p>\n<p>Democratic political strategist Robin Swanson\u00a0told <a href=\"https:\/\/www.capradio.org\/articles\/2022\/10\/17\/californias-pro-abortion-ballot-measure-is-poised-to-pass-so-why-are-democrats-spending-so-much-time-and-money-on-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">CapRadio<\/a>, a Sacramento NPR affiliate, that the state\u2019s leaders are banking on the issue not only as a way to boost voter turnout for tight races but to send a message to the rest of the country that California is an abortion \u201csafe haven.\u201d<\/p>\n<p>\u201cI think they\u2019re trying to create a sense of urgency around it,\u201d she said. \u201cA lot of Californians feel sort of immune to these right-wing, conservative ideas affecting our lives. But seeing 50 years of precedent overturned should be a shock to our systems.\u201d<\/p>\n<p>Newsom, Clinton, and their ilk in the pro-abortion Democrat Party have warned about the disappearing \u201cright to abortion and birth control\u201d that would allegedly ensue if the motion <em>fails<\/em> to pass, but little has been clarified for voters on what it would look like for Prop. 1 to take effect \u2014 particularly for health care workers, court systems, and the unborn. <\/p>\n<p> Expanding Late-Term Abortion <\/p>\n<p>Proponents of the bill, such as California Attorney General Rob Bonta,\u00a0say Proposition 1 does not lead to late-term abortions but simply enshrines the constitutional \u201cright to abortion.\u201d On the contrary, the language is vague and lacks specifics. In fact, one doctor who contributed to authoring the amendment is on the record explaining the vague language was \u201con purpose.\u201d<\/p>\n<p>Dr. Pratima Gupta, a San Diego OB-GYN who consulted on Proposition 1, told <a href=\"https:\/\/www.kqed.org\/news\/11927597\/the-v-word-proposition-1-revives-historic-abortion-debate-over-viability-in-california\" target=\"_blank\" rel=\"noreferrer noopener\">KQED<\/a> they intentionally left out the word \u201cviability\u201d \u2014 the key descriptor in determining the limit, if any, at which point during gestation an abortion can legally be performed. <\/p>\n<p>\u201cEvery pregnancy is individual and it\u2019s a continuum,\u201d Gupta said. \u201cIf I see a patient who has broken their bag of water at 23 weeks of pregnancy, that doesn\u2019t mean that it\u2019s viable or not viable.\u201d<\/p>\n<p>Under laws already on the books such as the California Reproductive Privacy Act of 2003, abortion is <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=HSC&#038;sectionNum=123466\" target=\"_blank\" rel=\"noreferrer noopener\">limited<\/a> to \u201cbefore the viability of the fetus.\u201d The text of Proposition 1 would <a href=\"https:\/\/vig.cdn.sos.ca.gov\/2022\/general\/pdf\/topl1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">embed<\/a> a \u201cfundamental right to choose to have an abortion\u201d without any limits or qualifications about the viability of the baby.
