In the suit, Mitchell accuses Baldwin of &#8220;recklessly&#8221; firing the weapon meant as a prop in a scene for the film <i>Rust<\/i>. DA Mary Carmack-Altwies <a class=\"Link\" href=\"https:\/\/www.facebook.com\/plugins\/post.php?href=https%3A%2F%2Fwww.facebook.com%2F1stJDA%2Fposts%2Fpfbid02Qfv4SDymo3gs5ZtBvvjHVL874rq7dEsaKvrTgjSWNZ6oaxwYrNwrbn668b8JKQQSl&#038;show_text=true&#038;width=500\" target=\"_blank\" rel=\"noopener\">clarified<\/a> that even after Baldwin settled with Hutchins&#8217;s family, the investigation would remain in progress. <\/p>\n<p>\u201cWe are very happy that we won and that the court today permitted us, over the objection of Alec Baldwin, to proceed in our lawsuit against him on our theories of assault, intentional infliction of emotional distress, and negligence,\u201d Gloria Allred, who is representing Mitchell, <a class=\"Link\" href=\"https:\/\/news.sky.com\/story\/alec-baldwin-can-be-sued-by-rust-crew-member-over-shooting-that-killed-halyna-hutchins-judge-rules-12736215\" target=\"_blank\" rel=\"noopener\">said following the ruling<\/a>.
