Even as the court reins in the administrative state, the FTC is advancing new rules and novel theories that stretch the limits of its mandate. Under its progressive chair, Lina Khan, the FTC wants to cancel the gig economy, cripple the ad-supported internet, and address racial justice, rather than simply protect consumers.<\/p>\n<p>In <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/axon-enterprise-inc-v-federal-trade-commission\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Axon Enterprise v. FTC<\/em><\/a><em>, <\/em>the court could take a big step toward cabining the FTC within its statutory and constitutional authority. <em>Axon<\/em> itself involves a narrow procedural question of whether someone can raise certain constitutional challenges to the FTC directly in federal court, without having to wade through years of administrative processes.<\/p>\n<p>As explained in a new <a href=\"https:\/\/www.yalejreg.com\/nc\/ftc-recent-moves\/\" target=\"_blank\" rel=\"noreferrer noopener\">paper<\/a>, however, the case\u2019s import is much broader. If companies can bring the FTC into court anytime the agency exceeds its authority, the courts can prevent the FTC from imposing illegal rules at the outset \u2014 a critical tool given the scope of the FTC\u2019s agenda. Even more importantly, the court could lay the groundwork to revisit the constitutionality of the FTC and much of the administrative state.<\/p>\n<p> <strong>Constitutionality Remains Open to Debate<\/strong> <\/p>\n<p>In 1914, Congress created the FTC as a multimember body with features of all three branches of government. The FTC could prosecute, adjudicate, and even legislate rules of conduct. Although President Woodrow Wilson, a progressive, supported the new agency, even he wanted to avoid empowering a \u201c<a href=\"https:\/\/www.ftc.gov\/sites\/default\/files\/attachments\/federal-trade-commission-history\/origins.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">smug lot of experts<\/a>.\u201d As Wilson explained, \u201cGod forbid that in a democratic country we should resign the task and give the government over to experts.\u201d<\/p>\n<p>In 1935, the Supreme Court upheld the agency\u2019s structure because it believed, the agency had a limited mandate. In <a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Humphrey\u2019s Executor v. United States<\/em><\/a>, the court found that the FTC\u2019s mission was \u201cneither political nor executive\u201d but mainly\u00a0<em>quasi<\/em>-judicial and\u00a0<em>quasi<\/em>-legislative. In the court\u2019s view, the commission was \u201cnonpartisan,\u201d led by a \u201cbody of experts\u201d who had experience in both public service and the \u201cpractical affairs of industry.\u201d<\/p>\n<p>Today, courts have become much more skeptical of independent agencies. Several years ago, then-Judge Kavanaugh <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/B7623651686D60D585258226005405AC\/$file\/15-1177.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> that these agencies held \u201cmassive power\u201d divorced from presidential oversight. As a result, he believed, \u201cindependent agencies pose a significant threat to individual liberty and to the constitutional system of separation of powers and checks and balances.\u201d<\/p>\n<p> <strong><em>Axon<\/em> Could Confine the FTC<\/strong> <\/p>\n<p>As SCOTUS considers the case, it may note that the agency is <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1591702\/p210100_wilsonphillips_joint_statement_-_rules_of_practice.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">planning<\/a> \u201cto replace the free market system with its own enlightened views of how companies should operate.\u201d Khan has argued for the government to play a larger role in \u201cshaping markets and economic\u00a0outcomes\u201d while decrying the free market as a \u201c<a href=\"https:\/\/www.youtube.com\/watch?v=uiyySw0_pMU\" target=\"_blank\" rel=\"noreferrer noopener\">product of metaphysical forces<\/a>.\u201d<\/p>\n<p>Among its initiatives, the FTC is considering a <a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/federal-register-notices\/commercial-surveillance-data-security-rulemaking\" target=\"_blank\" rel=\"noreferrer noopener\">rule<\/a> to restrict \u201ccommercial surveillance and data security,\u201d including \u201ccommon business practices\u201d that have never been deemed illegal.
