Therefore, the court finds that (the Red River Women\u2019s Clinic) has a substantial probability of succeeding on the merits through showing that there is a \u2018real and substantial question\u2019 before the court,\u201d the decision added.<\/p>\n<p>Red River Women\u2019s Clinic of Fargo, the state\u2019s only abortion provider, filed a lawsuit in July after the Supreme Court\u2019s decision to overturn\u00a0<em>Roe v. Wade\u00a0<\/em>and return laws regarding abortion to the states.<\/p>\n<p>North Dakota was one of several states with a trigger law set to be enacted following the court\u2019s decision. In 2007, the state legislature passed a bill that would ban abortion except in cases of rape, incest, or when the mother\u2019s life is in jeopardy.<\/p>\n<p>Red River Women\u2019s Clinic <a href=\"https:\/\/www.kare11.com\/article\/news\/health\/red-river-womens-clinic-fargo-moorhead-abortion\/89-e44d04b3-582d-4acb-b8b9-06533bdda640\" target=\"_blank\" rel=\"noopener\">raised<\/a> approximately $1 million following the Supreme Court decision and moved its operations to neighboring Minnesota\u2019s Moorhead community. It initially faced a deadline to close in Fargo by August 26 after 24 years of operation.<\/p>\n<p>Romanick issued a temporary stay to the trigger law in August. The state\u2019s Supreme Court then ordered the judge to reconsider the case, leading to yet a second temporary ban as the litigation moves forward in court.<\/p>\n<p>Tammi Kromenaker, director of the Red River Women\u2019s Clinic, expressed her agreement with the decision in a statement to the Associated Press.<\/p>\n<p>\u201cWe want physicians who are treating patients to feel like they can use their best medical judgment and training and not be looking at the law books as to how they can take care of patients,\u201d she <a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/judge-injunction-remains-north-dakota-abortion-ban-92446444\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>North Dakota is not alone in facing litigation over its trigger law. In Idaho, an August ruling blocked part of the state\u2019s abortion ban, siding with the Biden administration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Justice Department sued Idaho, claiming its <a href=\"https:\/\/www.dailywire.com\/news\/idaho-supreme-court-allows-two-pro-life-laws-to-take-effect\" target=\"_blank\" rel=\"noopener\">abortion ban<\/a> would stop emergency room doctors from performing abortions needed to stabilize the health of women in medical emergencies.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A federal district court in the state agreed that doctors in Idaho could not be legally punished for acting to protect the health of endangered mothers in a preliminary injunction in August.<\/p>\n<p>A total of 13 states had trigger laws set to go into effect following the Supreme Court\u2019s decision to return abortion laws to states. Several additional states have passed new laws following the decision to limit abortion.
