It will undoubtedly renew arguments to pack the highest Court in the land. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Fortunately, we shouldn\u2019t have to deal with mass rioting and violence until next summer when the decisions on the two cases in question are anticipated.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The topic on the docket today involves the role of affirmative action within higher education, specifically enrollment. Initially one case, now the Supreme Court is hearing arguments in two separate yet related cases.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The University of North Carolina and Harvard are facing scrutiny over their enrollment policies. The plaintiff, Students for Fair Admissions, argues that their practices discriminate against white and Asian American students. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Let\u2019s take a closer look at these cases and what they might mean for the future of American students.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Going to be amazing to watch the freak out when Clarence Thomas votes down affirmative action at SCOTUS.<\/p>\n<p>\u2014 Katie Pavlich (@KatiePavlich) <a href=\"https:\/\/twitter.com\/KatiePavlich\/status\/1587118062494523392?ref_src=twsrc%5Etfw\">October 31, 2022<\/a><\/p>\n<\/blockquote>\n<h3><span data-preserver-spaces=\"true\">The Differences<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\">It\u2019s essential to understand the fundamental differences between these two institutions of higher learning and why the case was split into two. First, the University of North Carolina is a public university.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Public institutions are bound by the Constitution\u2019s Equal Protection Clause and Title VI of the Civil Rights Act of 1964. Title VI prohibits institutions that receive federal money from participating in race discrimination.<\/span><\/p>\n<p><strong>RELATED: <a href=\"https:\/\/thepoliticalinsider.com\/msnbcs-joy-reid-dials-up-racial-attacks-on-herschel-walker-republicans\/\" target=\"_blank\" rel=\"noopener\">MSNBC\u2019s Joy Reid Dials Up Racial Attacks on Herschel Walker, Republicans<\/a><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">The arguments against the universities are slightly nuanced as well. For UNC, the argument is that the university discriminates against white and Asian applicants, preferring black, Hispanic, and Native American applicants instead.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Harvard is being accused of discriminating specifically against Asian applicants by using subjective criteria such as likability, courage, and kindness as factors when weighing enrollments for minority applicants. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">These two cases were split from the original single case due to the newest Justice, Ketanji Brown Jackson. She <a href=\"https:\/\/www.axios.com\/2022\/10\/30\/affirmative-action-supreme-court-harvard-unc\" target=\"_blank\" rel=\"noopener\">recused herself<\/a> from the Harvard case due to her involvement on one of the university\u2019s boards.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Harvard and UNC students gather in front of the Supreme Court protest as SCOTUS poised to rule affirmative illegal. <\/p>\n<p>They have a stage set up too.<a href=\"https:\/\/twitter.com\/gwhatchet?ref_src=twsrc%5Etfw\">@gwhatchet<\/a> <a href=\"https:\/\/t.co\/2h8fmceN7y\">pic.twitter.com\/2h8fmceN7y<\/a><\/p>\n<p>\u2014 Barry Yao (@IamBarryYao) <a href=\"https:\/\/twitter.com\/IamBarryYao\/status\/1587058559107334144?ref_src=twsrc%5Etfw\">October 31, 2022<\/a><\/p>\n<\/blockquote>\n<h3><span data-preserver-spaces=\"true\">Predictions<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\">It\u2019s widely believed that the Court will opt to, at a minimum, scale back what institutions of higher learning can do regarding the racial factors of applicants. At a maximum, they could outright remove the ability for these places of learning to utilize race as a factor. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Imagine living in a time when race isn\u2019t a factor in the judgment of your abilities!<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Why is the left assuming that the world as they know it will end next summer with yet another Supreme Court decision? Given that these two cases were both upheld at lower courts, many believe we will see another historic decision by the highest Court.<\/span><\/p>\n<p><strong>RELATED: <a href=\"https:\/\/thepoliticalinsider.com\/study-shows-parents-were-right-crt-being-taught-in-many-public-schools\/\" target=\"_blank\" rel=\"noopener\">Study Shows Parents Were Right, CRT Being Taught in Many Public Schools<\/a><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">You see, there wouldn\u2019t be much of a need for the Supreme Court to hear these cases since the lower courts ruled in favor of the defendants. One can make the leap that at least some of the Justices are leaning the other way if they are hearing out this appeal.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, Justice Elena Kagan does not appear to be one of these justices, <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/10\/31\/supreme-court-affirmative-action-college-admissions\/8200027001\/\" target=\"_blank\" rel=\"noopener\">stating<\/a>:<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cI thought that part of what it meant to be an American and to believe in American pluralism is that, actually, our institutions are reflective of who we are as a people.\u201d<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">Funny, I thought what it meant to be an American was more profound than mere skin color.\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This is certainly not the heart of the issue, but the <a href=\"https:\/\/twitter.com\/HarvardUniv?ref_src=twsrc%5Etfw\">@HarvardUniv<\/a> data that is mentioned in passing at <a href=\"https:\/\/twitter.com\/hashtag\/SCOTUS?src=hash&#038;ref_src=twsrc%5Etfw\">#SCOTUS<\/a> is quite awful. <br \/>For example, huge numbers of legacy admission, &#038; 80%+ students from rich families. This needs to change (but probably won&#8217;t) regardless of this case.<\/p>\n<p>\u2014 Guy Rub (@Guy_A_Rub) <a href=\"https:\/\/twitter.com\/Guy_A_Rub\/status\/1587144190437335042?ref_src=twsrc%5Etfw\">October 31, 2022<\/a><\/p>\n<\/blockquote>\n<h3><span data-preserver-spaces=\"true\">The Wrong Kind Of Diversity<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\">Of course, the universities\u2019 main argument for keeping their affirmative action practices is the D word\u2026Diversity. Justice Clarence Thomas drops a real truth bomb on this argument, <a href=\"https:\/\/www.nationalreview.com\/news\/justice-thomas-on-affirmative-action-case-diversity-seems-to-mean-everything-for-everyone\/\" target=\"_blank\" rel=\"noopener\">stating<\/a>:<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cI\u2019ve heard the word diversity quite a few times and I don\u2019t have a clue what it means. It seems to mean everything for everyone\u2026\u201d<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">In response, UNC representative Ryan Park <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/10\/31\/supreme-court-affirmative-action-college-admissions\/8200027001\/\" target=\"_blank\" rel=\"noopener\">explained<\/a> that diversity \u201creduces groupthink\u201d and, as he put it, \u201cleads to a more efficient outcome in seeking truth.\u201d Anyone who thinks there isn\u2019t massive liberal groupthink on college campuses in this country should come to check out a bridge that I have for sale at a great price.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">As sociology professor Brad Wilcox from the University of Virginia <a href=\"https:\/\/www.nytimes.com\/2022\/03\/07\/opinion\/campus-speech-cancel-culture.html\" target=\"_blank\" rel=\"noopener\">said<\/a>:<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201c\u2026the dominant messages students hear from faculty, administrators and staff are progressive ones.\u201d<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">We may need more diversity in professors to reduce groupthink. But the type of required diversity is the diversity of thought.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Everyone agrees that affirmative action in the NBA would ruin basketball, and affirmative action in the NFL would ruin football. Turns out that affirmative action in engineering &#038; medicine has a similar effect: this should surprise no one.<\/p>\n<p>\u2014 Vivek Ramaswamy (@VivekGRamaswamy) <a href=\"https:\/\/twitter.com\/VivekGRamaswamy\/status\/1587056536215486464?ref_src=twsrc%5Etfw\">October 31, 2022<\/a><\/p>\n<\/blockquote>\n<h3><span data-preserver-spaces=\"true\">Not Even Worth It<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\">I have two little ones; my daughter has shown an aptitude and interest at a very young age for mathematics and science, and my son, while still just a toddler, is also showing similar gifts. So, of course, I am thrilled. Still, I\u2019m not overly excited at the prospect of them going to college\u2026certainly not staying on campus.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But you might say living on campus and experiencing diversity is essential to the educational experience. For the price parents have to pay, what is necessary is that they learn their chosen craft and expand their intellectual flexibility and prowess through rigorous disagreement.\u00a0<\/span><\/p>\n<p><strong>RELATED: <a href=\"https:\/\/thepoliticalinsider.com\/biden-ridiculed-over-plan-to-tackle-racist-legroom-fees-on-airplanes\/\" target=\"_blank\" rel=\"noopener\">Biden Ridiculed Over Plan to Tackle \u2018Racist\u2019 Legroom Fees on Airplanes<\/a><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">But that\u2019s not what happens in colleges anymore. <a href=\"https:\/\/reports.collegepulse.com\/college-free-speech-rankings-2021\" target=\"_blank\" rel=\"noopener\">According to<\/a> a 2021 College Pulse survey of over 37,000 college students, 80% admitted that they self-censor their opinions and ideas on campus.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">As Justice Thomas <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/10\/31\/supreme-court-affirmative-action-college-admissions\/8200027001\/\" target=\"_blank\" rel=\"noopener\">rightly explains<\/a>:<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cWhen a parent sends a kid to college\u2026they don\u2019t necessarily send them there to have fun or feel good or anything like that. They send them there to learn physics or chemistry.\u201d<\/span><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This tweet is a reminder that affirmative action is racist.<\/p>\n<p>\u2014 Steven Crowder (@scrowder) <a href=\"https:\/\/twitter.com\/scrowder\/status\/1587068384696573953?ref_src=twsrc%5Etfw\">October 31, 2022<\/a><\/p>\n<\/blockquote>\n<h3><span data-preserver-spaces=\"true\">Racist<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\"><a href=\"https:\/\/nypost.com\/2018\/10\/17\/harvards-gatekeeper-reveals-sat-cutoff-scores-based-on-race\/\" target=\"_blank\" rel=\"noopener\">Harvard sends an invitation<\/a> to apply to black students that score at least 1100 on the SAT. To receive an invitation to apply, if you are white or Asian American, you must score at least a 1310 and 1350, respectively.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Gee, that doesn\u2019t seem fair at all.\u00a0<\/span><\/p>\n<p>Justice Alito posed a hypothetical for the plaintiff. He asked if an applicant who had moved here from an African country to a rural and mostly white part of North Carolina, and describes in an admissions essay how he or she had to confront a different culture \u2013 would that be acceptable criteria for the university to weigh for admission?<\/p>\n<p><span data-preserver-spaces=\"true\">This caused Justice Kagan to <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/10\/31\/supreme-court-affirmative-action-college-admissions\/8200027001\/\" target=\"_blank\" rel=\"noopener\">bite back<\/a>:<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cRace is part of the culture and the culture is part of the race, isn\u2019t it?\u201d<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">I don\u2019t think she\u2019s necessarily wrong. Still, I believe she is oversimplifying and, in reality, shows a bit of racism in such a broad-stroke argument. Being black doesn\u2019t mean you are doomed to grow up in poverty and receive a poor education.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">And just because you are white or Asian-American doesn\u2019t mean you were blessed with parents who paid for tutors and loved you unconditionally with endless wealth and opportunities. Lived experiences aren\u2019t always associated with skin color; skin color is not automatically indicative of lived experiences.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">There\u2019s a new secular religion in America that says your identity is based on race &#038; gender; that if you\u2019re black, you\u2019re inherently disadvantaged and that if you\u2019re white, you\u2019re privileged. It\u2019s tearing us apart. Do we want to continue to live in a country that weighs people\u2019s chances for higher education and other opportunities based on the color of their skin?<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Or do we want to be judged based on our abilities?
