The tweet read, \u2018Operation Fly Formula delivers 70,000 pounds of infant formula for American mothers and their infants. Thank you @POTUS.\u2019 The tweet also read, \u2018Get your Democrats Deliver merch today!\u2019 and included a link to Strike PAC\u2019s online store and an image of the group\u2019s \u2018Democrats Deliver\u2019 t-shirt,\u201d she wrote.<\/p>\n<p>Strike PAC is a partisan political group that supports the Democratic Party.<\/p>\n<p>Galindo-Marrone noted that Klain removed the post following notification of the OSC\u2019s complaint.<\/p>\n<p>\u201cAlthough OSC has concluded that Mr. Klain violated the Hatch Act, we understand that he promptly removed the retweet upon being notified of this complaint,\u201d the letter read.<\/p>\n<p>\u201cAccordingly, we have decided not to pursue disciplinary action and will close this matter. Mr. Klain has been warned that if in the future he engages in activity prohibited by the Hatch Act while employed in a covered position, OSC would consider such activity to be a willful and knowing violation of the law that could result in disciplinary action,\u201d the letter concluded.<\/p>\n<p>\u201cUsing your White House Twitter account to advocate for a PAC is ILLEGAL,\u201d Hamilton said in his <a href=\"https:\/\/aflegal.org\/breaking-office-of-special-counsel-finds-that-biden-white-house-chief-of-staff-ron-klain-violated-the-hatch-act-based-on-afl-request-for-investigation\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> reacting to the OSC letter.<\/p>\n<p>Klain\u2019s retweet occurred in May. America First Legal sent its <a href=\"https:\/\/wordpress.aflegal.org\/wp-content\/uploads\/2022\/06\/Klain-OGE-Letter-Final.pdf\" target=\"_blank\" rel=\"noopener\">request<\/a> for an ethics investigation of Klain on June 2.<\/p>\n<p>\u201cAs OGE\u2019s director, you have the authority to review potential ethics violations and notify the employee\u2019s agency, in this case the White House, of any violations. Based on the evidence, an investigation is clearly called for here,\u201d Reed Rubinstein, senior counselor for America First Legal, wrote at the time.<\/p>\n<p>Klain is not the only Biden administration official to receive a warning regarding a Hatch Act violation.
