A committee attempted to subpoena documents from his office and he refused to comply with that subpoena. So last month the Pennsylvania House voted to hold Krasner in contempt. The vote <a href=\"https:\/\/hotair.com\/john-s-2\/2022\/09\/15\/pennsylvania-house-holds-da-krasner-in-contempt-as-judge-orders-him-to-write-apology-letters-to-victims-family-n496812\" target=\"_blank\" rel=\"noopener\">was overwhelming<\/a>, 162-38, meaning even some Philadelphia Democrats agreed that Krasner was out of line to dodge the subpoenas.\u00a0Today, the PA House announced articles of impeachment <a href=\"https:\/\/www.phillyvoice.com\/pennsylvania-house-republicans-impeachment-philly-district-attorney-larry-krasner\/\" target=\"_blank\" rel=\"noopener\">against Krasner<\/a>:<\/p>\n<blockquote>\n<p>Pennsylvania House Republicans announced articles of impeachment against Philadelphia District Attorney Larry Krasner Wednesday, decrying his \u201cprogressive criminal justice philosophy that prioritizes criminals over victims,\u201d which has led to increased homicide and carjackings in the city, they say.<\/p>\n<p>The Republicans assembled at the press conference this morning painted a picture of a crime-ridden city where citizens live in \u201cfear of even going to Wawa.\u201d They linked climbing crime stats to Krasner\u2019s leadership, citing recent findings from a select committee investigation.<\/p>\n<p>\u201cThese are the consequences of District Attorney Larry Krasner\u2019s failure in office,\u201d Rep. Martina White, the primary sponsor of the articles of impeachment, said in the conference. \u201cNo public official is above the law.\u201d\u2026<\/p>\n<p>Reporters at the conference questioned whether Krasner\u2019s alleged inaction met the standard for impeachment, since the House Republicans had leveled no accusations of criminal behavior. They countered that \u201cmisbehavior in office\u201d offered sufficient standing.<\/p>\n<\/blockquote>\n<p>The issue of the grounds for the impeachment is one that Krasner raised in a statement <a href=\"https:\/\/phillyda.org\/news\/da-krasner-statement-to-pa-gop-lawmakers-determined-to-impeach-him\/\" target=\"_blank\" rel=\"noopener\">last week<\/a>:<\/p>\n<blockquote>\n<p>You have never specified what your basis of impeachment is. There has been no suggestion of criminal conduct or corruption of any kind. You have never indicated to me or to anyone why I should be impeached, but there is little doubt that the Select Committee intends to recommend my impeachment. Indeed, this Committee was formed for the express purpose of recommending my impeachment. Rep. Ecker, one of the members of this committee, even publicly called for my impeachment before the Committee was formed\u2026<\/p>\n<p>There are many ways to pursue public safety. In the past, the Philadelphia District Attorney\u2019s Office (DAO) has relied almost exclusively on the blunt instrument of jail and prison, without recognizing that this approach is often ineffective and, in the long term, may make our communities more dangerous. In my office, we recognize we have numerous tools in our arsenal, and we use each one to build up our community. We are proud of our work. So are Philadelphians. It is why they overwhelmingly re-elected me less than a year ago\u2026<\/p>\n<p>I am utterly disappointed in the Select Committee\u2019s approach during its investigation.<\/p>\n<p>It subpoenaed files from my office, including prosecution case files and secret grand jury records that I legally cannot provide, and then rushed to hold me in contempt while I challenged, in a court, the lawfulness of the subpoena. It is pushing this process forward, at a blistering pace, before the courts can even address it. It refused to allow me to testify before it in a transparent way, insisting that it could only be done behind closed doors, and then, before negotiations of my appearance had ended, said that it that it no longer had time for my testimony.<\/p>\n<\/blockquote>\n<p>The next step in the process is for the House to hold a vote to advance the impeachment to the PA Senate. So far there\u2019s no commitment to doing that before the midterms.<\/p>\n<p>Despite his claims that he is doing a great job in Philadelphia, Krasner\u2019s office has recently been in trouble over efforts to help convicted murderers. In one case, Krasner was ordered by a judge to personally write letters of apology to <a href=\"https:\/\/www.inquirer.com\/news\/larry-krasner-mitchell-goldberg-sanctions-robert-wharton-20220913.html&#038;cid=Philly.com+Twitter\" target=\"_blank\" rel=\"noopener\">a victim\u2019s family<\/a>:<\/p>\n<blockquote>\n<p class=\"inq-p\">A federal judge has found that the Philadelphia District Attorney\u2019s Office provided incomplete and misleading information as it sought to overturn the death sentence of a man who\u00a0<a href=\"https:\/\/www.inquirer.com\/news\/philadelphia-district-attorney-larry-krasner-death-penalty-robert-wharton-murders-bradley-ferne-hart-20190907.html\" target=\"_blank\" rel=\"noopener\" data-link-type=\"article-body\">killed<\/a><a href=\"https:\/\/www.inquirer.com\/news\/philadelphia-district-attorney-larry-krasner-death-penalty-robert-wharton-murders-bradley-ferne-hart-20190907.html\" target=\"_blank\" rel=\"noopener\" data-link-type=\"article-body\">\u00a0an East Mount Airy couple<\/a>\u00a0inside their home in 1984, then shut off the heat and left their infant daughter inside to die.<\/p>\n<p class=\"inq-p\">In a\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.paed.24617\/gov.uscourts.paed.24617.314.0.pdf\" target=\"_blank\" rel=\"noopener\" data-link-type=\"article-body\">blunt opinion<\/a>\u00a0issued Monday, U.S. District Judge Mitchell Goldberg said top prosecutor Larry Krasner\u2019s administration had failed to conduct a careful review of Robert Wharton\u2019s case before asking Goldberg to vacate the death penalty and order Wharton to serve a life sentence instead. Goldberg said the review by prosecutors was \u201cpatently deficient\u201d for failing to mention that Wharton had previously been convicted of violently trying to escape from a City Hall courtroom.<\/p>\n<p class=\"inq-p\">In addition, Goldberg found that Krasner\u2019s office had provided a \u201cfalse\u201d account of its interactions with the victims\u2019 relatives, including their daughter, Lisa Hart-Newman, who survived the attack. Goldberg said prosecutors filed documents suggesting that the family of Ferne and Bradley Hart had consented to a request to vacate Wharton\u2019s death sentence, which the judge said was \u201cnot true.\u201d<\/p>\n<\/blockquote>\n<p>Just last week Krasner was in the news again after a convicted murder named Jahmir Harris, who was <span>set free last year thanks to Krasner\u2019s <\/span>Conviction Integrity Unit, was accused of murdering a <a href=\"https:\/\/www.inquirer.com\/news\/philly-murder-exoneration-charges-jahmir-harris-charles-gossett-charli-khan-louis-porter-20221020.html\" target=\"_blank\" rel=\"noopener\">50-year-old man<\/a>. Once again, the judge in that case said Krasner\u2019s office hadn\u2019t made a careful review of the case (though she freed Harris anyway).<\/p>\n<blockquote>\n<p>The DA\u2019s Office asked Common Pleas Court Judge Rose Marie DeFino-Nastasi to vacate Harris\u2019 conviction and set him free, which she did \u2014 but not without hesitation.<\/p>\n<p>At one point, DeFino-Nastasi ordered prosecutors to show proof of a more thorough investigation proving that Harris was not involved. Later, she harshly criticized Patricia Cummings \u2014 then the director of the Conviction Integrity Unit \u2014 for what the judge cast as an incomplete review of the case.<\/p>\n<\/blockquote>\n<p>Harris is now accused of murdering Charles Gossett and Krasner\u2019s office is sticking to its claim that Harris was \u201clikely innocent\u201d in the previous case.<\/p>\n<blockquote>\n<p>Jane Roh, spokesperson for the District Attorney\u2019s Office, said that prosecutors still believe Harris\u2019 rights in his older case were violated, and that the office\u2019s recent review of that case led prosecutors to believe Harris was \u201clikely innocent\u201d \u2014 a position that has not changed based on the new allegations against him.<\/p>\n<\/blockquote>\n<p>As I wrote last week, \u201cHaving one of your freed prisoners (allegedly) murder someone else in nearly the same way seems like a pretty terrible outcome.\u201d Finally, the Philly Inquirer published an editorial today urging Krasner to take this impeachment effort as a teachable moment.<\/p>\n<blockquote>\n<p>In many positive ways, Krasner\u2019s first five years in office have been transformative. He has brought a newfound focus to conviction integrity, successfully advocated for additional investments in forensic tools for criminal investigators, and held police officers accountable for their misconduct.<\/p>\n<p>Yet, in an eerie echo of Krasner\u2019s own criticisms of his predecessors, his single-minded zeal for reform has sometimes led to alarming outcomes \u2014 the most obvious being situations in which the district attorney\u2019s office has made choices that have left dangerous people on the street who should have been in custody.<\/p>\n<p>Yaaseen Bivins, the adult who purchased ammunition for and<a href=\"https:\/\/www.inquirer.com\/opinion\/roxborough-high-shooting-youth-violence-prevention-20221020.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\"> allegedly organized<\/a> last month\u2019s <a href=\"https:\/\/www.inquirer.com\/news\/philadelphia\/roxborough-high-school-shooting-20220927.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\">shooting at Roxborough High School<\/a>, had already been convicted of injuring a pregnant woman and killing her unborn child while drag racing.<\/p>\n<p><a href=\"https:\/\/www.inquirer.com\/news\/philadelphia\/roxborough-shooting-yaaseen-bivens-bail-philadelphia-district-attorney-larry-krasner-20221019.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\">Krasner\u2019s office chose not to ask the judge in Bivins\u2019 case to revoke bail<\/a>, a decision that mystified legal observers. Krasner\u2019s office also sought to overturn the murder conviction of Jahmir Harris, <a href=\"https:\/\/www.inquirer.com\/news\/philly-murder-exoneration-charges-jahmir-harris-charles-gossett-charli-khan-louis-porter-20221020.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\">against the advice of the presiding judge<\/a>. Harris is now facing another murder charge. After three SWAT officers were shot while serving a warrant, Police Commissioner Danielle Outlaw lamented that her department \u201c<a href=\"https:\/\/www.inquirer.com\/news\/philadelphia-police-officers-shot-west-poplar-condition-suspects-20221012.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\">arrests the same suspects over and over again<\/a>.\u201d\u2026<\/p>\n<p>Krasner\u2019s weaknesses are more glaring in a Philadelphia where murders are at a record and violent crime is a top concern for residents. Despite his assertions,<a href=\"https:\/\/www.inquirer.com\/news\/larry-krasner-no-violent-crime-crisis-philadelphia-gun-violence-20211209.html\" data-link-type=\"article-body\" target=\"_blank\" rel=\"noopener\"> the city is experiencing a crisis of lawlessness, crime, and violence.<\/a><\/p>\n<\/blockquote>\n<p>The editorial concludes that the impeachment isn\u2019t justified but that Krasner\u2019s critics, who are not merely those on the right, have a point about his smug behavior and poor handling of many decisions in office.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This summer, Republicans called for the impeachment of progressive DA Larry Krasner.
