Harvard\/UNC<\/em>. The court\u2019s decision will determine whether our military\u2019s future leadership will consist of the \u201cbest-qualified\u201d individuals instead of simply those \u201cqualified\u201d as defined by an ever-moving standard meant to accommodate political and cultural goals.\u00a0<\/p>\n<p>Affirmative action, in the form of racial preferences, pervades today\u2019s military despite federal law that, if enforced, would prevent it. Section 601 of the Civil Rights Act of 1964 prohibits racial \u201cdiscrimination under any program or activity receiving Federal financial assistance.\u201d\u00a0 Racial preferences in the military also violate our Constitution\u2019s Fifth Amendment Due Process Clause.\u00a0\u00a0<\/p>\n<p>Department of Defense (DOD) surrogates speciously have argued to the Supreme Court that the DOD\u2019s use of racial preferences in service academy admissions is \u201cmission critical\u201d and \u201cindispensable to\u201d national security. That strategy was contrived only because of the legal framework courts must use when examining practices that violate the Constitution. Evidence must clearly prove a \u201ccompelling state interest\u201d sufficiently strong to justify the drastic measure of suspending the constitutional provision that prohibits such practices.<\/p>\n<p>DOD\u2019s surrogates made their preferences-are-essential-to-national-security argument first in 2003 in <em>Grutter v. Bollinger<\/em>. Unrebutted, that far-fetched claim misled the <em>Grutter<\/em> majority into a falsely predicated, 5-4 decision authorizing the limited, narrowly tailored use of racial preferences in college admissions for the sole purpose of gaining the \u201ceducational benefits of diversity.\u201d The DOD thereby gained some of the judicial cover it sought for its racial preferences practices in service academy admissions.\u00a0\u00a0<\/p>\n<p>Veterans for Fairness and Merit (VFM), an organization that has 627 members, 21 Medal of Honor recipients, 45 POWs, 119 general officers (12 four-stars and 25 three-stars), with 934 combat tours, 476 combat leader positions held, and more than 900 combat valor awards to its name, filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-1199\/222848\/20220509154943084_Amicus%20Brief%20of%20Veterans%20for%20Fairness%20and%20Merit%20Supp%20Petitioner.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a> in <em>Harvard\/UNC<\/em> to correct the record based on their first-hand experiences.<\/p>\n<p>Our military most assuredly can defend America without resorting to extra-constitutional practices that require suspension of the Equal Protection Clause and Section 601. To claim otherwise is disingenuous. The racial demographic parity of enlisted officers \u2014 if that\u2019s what \u201ccritical officer diversity\u201d means \u2014 is unnecessary for our military to be combat-effective.\u00a0\u00a0<\/p>\n<p>Our warfighters respond to their leaders regardless of race. Sub-group identities are inconsequential to the selfless servant, \u201ccolorblind\u201d warrior. Mission accomplishment, however, requires the best-qualified leaders.<\/p>\n<p>DOD\u2019s race preference practices far exceed the limited use <em>Grutter <\/em>envisioned. At <a href=\"https:\/\/usmadata.com\/2018\/06\/10\/on-diversity-as-strength\/\" target=\"_blank\" rel=\"noreferrer noopener\">West Point<\/a>, \u00a0 \u00a0 to fulfill \u201cclass composition goals,\u201d marginally qualified applicants are admitted, displacing better-qualified Asian and White applicants. Substantial differences in attrition\/graduation rates and performance measures predictably result. Because of this, our warfighters are denied the \u201cbest-qualified\u201d officers.<\/p>\n<p>DOD\u2019s brazen use of preferences to pursue parity is \u201cracial balancing,\u201d a practice the court has repeatedly held \u201cpatently unconstitutional,\u201d regardless of the \u201cdiversity\u201d label.<\/p>\n<p>Like VFM (which condemns all forms of racism), a substantial majority of Americans oppose the use of racial preferences in college admissions. <a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2022\/04\/26\/u-s-public-continues-to-view-grades-test-scores-as-top-factors-in-college-admissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pew Research found<\/a> that 74 percent of Americans, including 59 percent of blacks, polled in March<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Warfighters deserve the best-qualified leaders available, regardless of race.
