Their sanctions motion asks a judge to torpedo the multi-billion dollar lawsuit.<\/p>\n<p>Court papers reviewed by Law&#038;Crime are thin on details regarding the network\u2019s allegations, except that the <a href=\"https:\/\/www.documentcloud.org\/documents\/23179070-fnn-notice-of-motion-for-sanctions-for-spoliation\">notice of motion<\/a> for sanctions alleges spoliation of the electronic messages of senior executives [<strong>John<\/strong>]<strong> Poulos,<\/strong> [<strong>Waldeep<\/strong>]<strong> Singh, <\/strong>and [<strong>Kay<\/strong>]<strong> Stinson<\/strong>.\u201d<\/p>\n<p>Poulos is Dominion\u2019s CEO, who as recently as Sunday appeared on <em>60 Minutes<\/em> with <strong>Anderson Cooper<\/strong>. Singh is its executive vice president of sales, and Stinson is its vice president for government affairs.<\/p>\n<p>The doctrine of spoliation <a href=\"https:\/\/www.uslaw.org\/wp-content\/uploads\/2022\/01\/The-Weaponization-of-the-Spoliation-of-Evidence-Doctrine.pdf\">generally refers<\/a> to \u201cthe destruction, concealment or the failure to preserve evidence by one party that is relevant to a claim and hampers the other party\u2019s ability to advance its position.\u201d If a party is found to have acted in such a manner, the court can impose sanctions against that party or even dismiss the complaint.<\/p>\n<p>The network\u2019s attorneys also filed a <a href=\"https:\/\/www.documentcloud.org\/documents\/23179071-fnn-proposed-order-to-motion-for-spoliation-sanctions\">Proposed Order<\/a> that would grant their motion for sanctions against Dominion and possibly provide a series of other potential remedies in the network\u2019s favor, including an order tossing the lawsuit altogether.<\/p>\n<p>If the complaint is not dismissed, Fox is seeking to have the jury instructed that it \u201cmust presume the messages contained information unfavorable to Plaintiffs about the defamatory nature of [Fox News Network]\u2019s coverage of the President\u2019s allegations and about the security of Plaintiffs\u2019 machines and information undermining Plaintiffs\u2019 damages calculation.\u201d<\/p>\n<p>The network also requested that Dominion \u201cbe required to prove falsity and both general and special damages by clear and convincing proof regardless of whether Plaintiffs prove defamation per se.\u201d<\/p>\n<p>The crux of Dominion\u2019s $1.6 billion lawsuit against the conservative news network is that Fox knowingly lied to its viewers about the veracity of election fraud and election rigging claims during the 2020 presidential election, in part to stop viewers from flocking to networks further to the right.<\/p>\n<p>\u201cAfter the November 3, 2020 Presidential Election, viewers began fleeing Fox in favor of media outlets endorsing the lie that massive fraud caused President Trump to lose the election,\u201d the <a href=\"https:\/\/lawandcrime.com\/high-profile\/dominion-sues-fox-news-for-1-6-billion-for-turning-flame-of-post-election-lies-into-a-forest-fire\/\">lawsuit states<\/a>. \u201cThey saw Fox as insufficiently supportive of President [<strong>Donald<\/strong>] <strong>Trump<\/strong>, including because Fox was the first network to declare that President Trump lost Arizona. So Fox set out to lure viewers back \u2014 including President Trump himself \u2014 by intentionally and falsely blaming Dominion for President Trump\u2019s loss by rigging the election.\u201d<\/p>\n<p>Poulos, Dominion\u2019s head executive, appeared on <em>60 Minutes<\/em>\u00a0and continued to claim that Fox News was aware that the allegations against the company were false, but that such knowledge did not stop them from airing them anyway.<\/p>\n<p>\u201cWe told them. We told them in real time. Others told them,\u201d <a href=\"https:\/\/www.cbsnews.com\/news\/dominion-voting-systems-ceo-machines-conspiracy-theories-60-minutes-2022-10-23\/\">Poulos said<\/a> during the interview. \u201cGovernment officials told them. Nonpartisan government officials told \u2019em. People inside the Trump administration told them. Um, local election officials on both sides of the aisle told \u2019em. This is not a matter of not knowing the truth. They knew the truth,\u201d<\/p>\n<p>Dominion last week filed its own confidential motion regarding the court\u2019s ruling on the company\u2019s motion to compel testimony from Fox News personality <strong>Jeanine Pirro<\/strong>.<\/p>\n<p>As <a href=\"https:\/\/lawandcrime.com\/2020-election\/dominion-reportedly-eyes-jeanine-pirros-alleged-role-in-spreading-verifiably-false-yet-devastating-lies-in-election-defamation-case\/\">previously reported<\/a> by Law&#038;Crime, Dominion claims that it obtained evidence exposing Pirro\u2019s key role in the case through discovery, the evidence-sharing phase of proceedings that began months ago. The company claims that Fox News finally produced some of it at the eleventh hour before Pirro was scheduled to take the hot seat.<\/p>\n<p>\u201cThirteen hours before her deposition, and several months since first requesting her deposition, Fox News produced several texts from Ms. Pirro,\u201d the partially sealed public version of the filing states, followed by multiple lines of redactions.<\/p>\n<p>Dominion alleges that those messages give context to Pirro\u2019s interview with conspiracy theorist and attorney <strong>Sidney Powell\u00a0<\/strong>on her show on Nov. 14, 2020, in a segment that she promoted on Twitter.
