He is also being fined $6,500. <\/p>\n<p>The chain of events is simple: Bannon refused to comply with the House select committee\u2019s subpoena for documents and testimony because he argued it would violate President Donald Trump\u2019s executive privilege. The Biden administration\u00a0<a href=\"https:\/\/dailycaller.com\/2022\/10\/21\/steve-bannon-sentenced-four-months\/\" target=\"_blank\" rel=\"noreferrer noopener\">contested this<\/a>\u00a0argument, and the House of Representatives voted to hold Bannon in contempt of Congress last year.<\/p>\n<p>The Bannon sentencing is unprecedented. Individuals are rarely prosecuted, let alone convicted and imprisoned, for being held in contempt of Congress. Ten years ago, then-Attorney General\u00a0<a href=\"https:\/\/www.politico.com\/story\/2012\/06\/holder-held-in-contempt-of-congress-077988\" target=\"_blank\" rel=\"noreferrer noopener\">Eric Holder<\/a>\u00a0was held in contempt of Congress for ignoring a subpoena related to the Fast and Furious scandal in which, due to negligence, the United States government\u00a0<a href=\"https:\/\/abcnews.go.com\/ABC_Univision\/News\/fast-furious-scandal-details-emerge-us-government-armed\/story?id=17352694\" target=\"_blank\" rel=\"noreferrer noopener\">supplied<\/a>\u00a0a Mexican cartel with firearms that were used to terrorize and kill Mexican and American citizens. Even though the Fast and Furious scandal was far more deadly than the capital riot, Holder was never prosecuted for snubbing the Republican-led Congress. The last time someone was even charged with contempt of Congress was nearly\u00a0<a href=\"https:\/\/www.snopes.com\/fact-check\/bannon-charged-contempt-congress\/\" target=\"_blank\" rel=\"noreferrer noopener\">40 years ago<\/a>, and the accused was cleared.<\/p>\n<p> The Sham J6 Committee\u00a0 <\/p>\n<p>The Jan. 6 Committee that targeted Bannon was a sham from its inception. For the first time in the history of the House, the speaker\u00a0<a href=\"https:\/\/thefdrlst.wpengine.com\/2021\/07\/21\/nancy-pelosi-kicks-ranking-republicans-jim-jordan-jim-banks-off-partisan-jan-6-commission\/\" target=\"_blank\" rel=\"noreferrer noopener\">barred<\/a>\u00a0the minority party from appointing members, with House Speaker Nancy Pelosi blocking Republican Leader Kevin McCarthy\u2019s picks, Reps. Jim Jordan and Jim Banks. Instead, <a href=\"https:\/\/thefederalist.com\/2021\/11\/10\/j6-committee-misleading-witnesses-about-republican-staff-presence\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pelosi appointed her own favorites <\/a>who serve Democrats\u2019 interests: Reps. Liz Cheney and Adam Kinzinger. Because there was not one Republican-appointed member present on the committee, the GOP conference had no representation.\u00a0<\/p>\n<p>Bannon\u2019s lawyers tried to\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/06\/15\/judge-rejects-bannons-effort-to-dismiss-criminal-case-for-defying-jan-6-select-committee-00039888\" target=\"_blank\" rel=\"noreferrer noopener\">dismiss<\/a>\u00a0the charges against him by asserting that the select committee was not a valid entity because it had no ranking minority member. Democrat House lawyers, however, waved this argument,\u00a0<a href=\"https:\/\/www.speaker.gov\/sites\/speaker.house.gov\/files\/USA%20v.%20Bannon%20Amicus%20Brief%205.10.2022.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">writing<\/a>\u00a0in their amicus brief: \u201cAs a practical matter, the Select Committee is functioning differently than other House Committees. Here, there is no formalistic division between majority Members and minority Members, or majority staff and minority staff.\u201d\u00a0<\/p>\n<p>Legal counsel for McCarthy\u00a0<a href=\"https:\/\/www.politico.com\/f\/?id=00000180-f84d-d1a7-abf1-f9ff78380000\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a>\u00a0the Democrat lawyers\u2019 statement, writing that the committee\u2019s power \u201cis limited to its authorizing resolution,\u201d and adding that \u201chad the House desired the Select Committee\u2019s subpoena authority to \u2018function[] differently than other House Committees\u2019 it should have explicitly so said\u201d in its\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-resolution\/503\/text\" target=\"_blank\" rel=\"noreferrer noopener\">resolution<\/a>\u00a0to create the committee. Even though, as McCarthy\u2019s lawyers point out, the formation of the committee did not follow House protocol, the federal judge\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/federal-judge-consider-steve-bannons-motion-dismiss-contempt-indictmen-rcna33488\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a>\u00a0to dismiss Bannon\u2019s charges.\u00a0 \u00a0<\/p>\n<p>But there\u2019s more to the J6 Committee\u2019s disdain for norms. In 1961, the Supreme Court\u00a0<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/365\/399\/\" target=\"_blank\" rel=\"noreferrer noopener\">affirmed<\/a>\u00a0that questions asked of individuals subpoenaed by Congress must be relevant to whatever subject the committee has been authorized to investigate. Yet according to a Federalist analysis from January of this year, only\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/01\/20\/only-10-percent-of-j6-committee-subpoenas-relate-to-the-capitol-riot\/\" target=\"_blank\" rel=\"noreferrer noopener\">10 percent<\/a>\u00a0of the J6 Committee subpoenas were even related to the Capitol riot.\u00a0<\/p>\n<p>The committee also targeted private citizens who exercised their First Amendment right to peacefully assemble, which, as The Federalist\u2019s Mollie Hemingway <a href=\"https:\/\/thefederalist.com\/2021\/10\/27\/exclusive-biden-fbi-joins-pelosi-in-blocking-gop-from-investigating-january-6\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, calls<\/p>\n","protected":false},"excerpt":{"rendered":"<p>America&#8217;s rule of law is dead, and Democrats killed it.
