moment President Joe Biden announced his unilateral \u201ccancellation\u201d of $10,000 per borrower in student loan debt, critics have blasted his plan as\u00a0<a href=\"https:\/\/www.based-politics.com\/2022\/08\/23\/3-glaring-problems-with-bidens-10k-student-debt-cancelation-plan\/\" class=\"stylish-link\"><span class=\"s1\">unfair<\/span><\/a>,\u00a0<a href=\"https:\/\/www.based-politics.com\/2022\/08\/25\/oops-bidens-student-debt-bailout-is-even-more-expensive-than-we-thought-analysis-reveals\/\" class=\"stylish-link\"><span class=\"s1\">costly<\/span><\/a>, and\u00a0<a href=\"https:\/\/reason.com\/volokh\/2022\/09\/03\/bidens-student-loan-cancellation-is-a-trumpian-abuse-of-emergency-powers\/\" class=\"stylish-link\"><span class=\"s1\">unconstitutional<\/span><\/a>. In response, the White House has grasped at straws to try to justify it somehow having the authority to usurp Congress\u2019s constitutional powers and spend money without legislation. But the president just tipped his hand \u2014 and revealed that he actually does know his plan is unlawful.<\/p>\n<p class=\"p1\">Here\u2019s the backstory.<\/p>\n<p class=\"p1\">Whenever a major partisan proposal is unveiled these days, lawsuits quickly pop up to try to block it in court. But, when Biden announced his student loan bailout, a legal headache emerged. At first glance, it was\u00a0<a href=\"https:\/\/reason.com\/volokh\/2022\/09\/05\/does-anyone-have-standing-to-bring-a-lawsuit-against-bidens-student-loan-debt-cancellation-policy\/\" class=\"stylish-link\"><span class=\"s1\">hard to see who would be able to challenge the plan in court<\/span><\/a>\u00a0because of a legal doctrine known as \u201cstanding.\u201d<\/p>\n<p class=\"p1\">\u201cUnder current Supreme Court precedent, plaintiffs have to meet three requirements to get standing to file a lawsuit in federal court: They must 1) have suffered an \u2018injury in fact,\u2019 2) the injury in question must be caused by the allegedly illegal conduct they are challenging, and 3) a court decision should be able to redress the injury,\u201d law professor Ilya Somin\u00a0<a href=\"https:\/\/reason.com\/volokh\/2022\/09\/05\/does-anyone-have-standing-to-bring-a-lawsuit-against-bidens-student-loan-debt-cancellation-policy\/\" class=\"stylish-link\"><span class=\"s1\">explained<\/span><\/a>.<\/p>\n<p class=\"p1\">Basically, in order to sue, you have to have been directly harmed by the program. And, on paper, it\u2019s hard to see who is harmed by the bailout because, unfortunately, just generally being a taxpayer whose money is being illegally wasted is not considered sufficient justification to bring a lawsuit.<\/p>\n<p class=\"p1\">So, for a while, it seemed that even though Biden\u2019s plan was glaringly constitutionally suspect, nobody would be able to challenge it in court, meaning it wouldn\u2019t be struck down even if it was unconstitutional. Thankfully, various right-of-center plaintiffs have come up with creative ways to challenge the plan in court. One such lawsuit that has emerged is a suit by six states claiming that their finances would be harmed by Biden\u2019s bailout because they\u2019re heavily invested in private companies that service loans and will take a big hit from the president\u2019s cancellation initiative.<\/p>\n<p class=\"p1\">The White House panicked. It responded by immediately changing the details of its plan to exclude these types of \u201cprivately backed\u201d loans,\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/last-minute-changes-bidens-student-loan-handout-make-harder-challenge-court-experts\" class=\"stylish-link\"><span class=\"s1\">removing the eligibility<\/span><\/a>\u00a0of more than 700,000 potential beneficiaries. This was clearly intended to prevent the lawsuit from moving forward.<\/p>\n<p class=\"p1\">\u201cBy getting rid of the privately-backed loans, they probably cut off the right to sue from certain investors, financial institutions, and state governments who could argue they would be negatively impacted by the proposal,\u201d Heritage Foundation legal policy analyst Jack Fitzhenry\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/last-minute-changes-bidens-student-loan-handout-make-harder-challenge-court-experts\" class=\"stylish-link\"><span class=\"s1\">told<\/span><\/a>\u00a0Fox News. \u201cThis makes it a lot harder for states and companies managing the privately-held debt to sue over lost revenue.\u201d<\/p>\n<p class=\"p1\">There\u2019s really only one reason Biden and his administration would so drastically change their plan: They know it won\u2019t hold up in court if a challenge is allowed to move forward. That\u2019s right. Biden is knowingly pushing an unconstitutional policy and simply hoping he can evade scrutiny by the courts.<\/p>\n<p class=\"p1\">So, this is no longer just about bad policy or wasted taxpayer money.
