While the DOJ ultimately turned over a few of the records to FGA <a href=\"https:\/\/thefederalist.com\/2022\/09\/12\/bombshell-doj-conceals-records-about-bidens-use-of-federal-agencies-to-influence-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">last month<\/a>, the documents were <a href=\"https:\/\/thefga.org\/fga-vs-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">heavily redacted<\/a> and did not include the DOJ\u2019s 15-page \u201cstrategic plan\u201d on how the agency intends to comply with Biden\u2019s executive order.<\/p>\n<p>In their Thursday legal filing arguing for a summary judgment, the DOJ claimed that its Civil Rights Division (CRT) \u201chas submitted a reasonably specific declaration\u201d describing the search that CRT \u201cconducted for records responsive to FGA\u2019s [Freedom of Information Act] request\u201d and that documents withheld or redacted by the DOJ are protected under the \u201cpresidential communications privilege.\u201d<\/p>\n<p>\u201cThe presidential communications privilege applies to the Strategic Plan because it was \u2018solicited and received by the President[\u2019s] . . . immediate White House advisers with broad and significant responsibility for investigating and formulating the advice to be given the President\u2019 regarding voting rights issues,\u201d the DOJ filing reads. \u201cThe Strategic Plan therefore falls squarely within the scope of the presidential communications privilege.\u201d<\/p>\n<p>Most notable in the agency\u2019s arguments, however, is the contention that the release of the information requested by FGA would cause \u201cpublic confusion\u201d and that \u201csuch public confusion would result from disclosure of the Strategic Plan because it contains many proposed actions that the public might construe as \u2018future commitments, past actions, or provisions already in place.&#8217;\u201d<\/p>\n<p>\u201cDOJ therefore properly withheld the Strategic Plan in its entirety,\u201d the agency claimed.<\/p>\n<p>In response to the DOJ\u2019s continued coverup, FGA President and CEO Tarren Bragdon issued a <a href=\"https:\/\/thefga.org\/press\/doj-continues-to-hide-voter-registration-plans-midterms\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> blasting the agency\u2019s behavior, saying that it\u2019s \u201cclear\u201d that Biden\u2019s administration \u201chas weaponized DOJ to hide records and is using the legal process to run out the clock before the midterm elections.\u201d<\/p>\n<p>\u201cDOJ offered flimsy excuses to justify concealing key information regarding their participation in government-funded \u2018get out the vote\u2019 efforts,\u201d Bragdon said. \u201cFGA will not stop fighting to uncover these records and expose the full scope of the Biden administration\u2019s mass voter registration scheme. The law and the American people are on our side.\u201d<\/p>\n<p>As <a href=\"https:\/\/thefederalist.com\/2022\/06\/23\/yes-biden-is-hiding-his-plan-to-rig-the-2022-midterm-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> by Federalist Editor-in-Chief Mollie Hemingway, Biden\u2019s executive order isn\u2019t just unethical and unconstitutional, but \u201ca recipe for chaos, confusion, and fraud at a time when election security concerns are particularly fraught.\u201d<\/p>\n<p>\u201cExecutive Order 14019 ignores that the Constitution does not give the executive branch authority over elections. That power is reserved for the states, with a smaller role for Congress,\u201d Hemingway explained. Considering that \u201cH.R. 1 and other Democrat Party efforts to grab more control over elections have thus far failed,\u201d she added, \u201cCongress hasn\u2019t authorized such an expansion.\u201d<\/p>\n<p>With the 2022 midterms rapidly approaching, the Biden DOJ has since been ramping up its efforts to intervene in elections under the guise of targeting voter \u201cintimidation\u201d in various states across the country. Most recently, the DOJ\u2019s district attorney in New Hampshire, Jane Young, appointed Assistant U.S. Attorney Seth R. Aframe to \u201clead the efforts of her office in connection with the Justice Department\u2019s nationwide Election Day Program\u201d for the November elections.<\/p>\n<p>\u201cThe Department of Justice has an important role in deterring and combatting discrimination and intimidation at the polls, threats of violence directed at election officials and poll workers, and election fraud,\u201d an agency <a href=\"https:\/\/www.justice.gov\/usao-nh\/pr\/us-attorney-young-announces-district-election-officer\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a> read. \u201cThe Department will address these violations wherever they occur.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
