In its application to Barrett, WILL argues that there is \u201cno legal justification\u201d for Biden\u2019s proposal and that it is a \u201cpresidential usurpation of the constitutional spending power, which is reserved exclusively for Congress.\u201d<\/p>\n<p>\u201cThe President has transformed a law designed to benefit military personnel and first responders who have been disadvantaged by their response to a discrete national emergency into a warrant to transfer hundreds of billions, or perhaps over a trillion, dollars in debt onto taxpayers,\u201d the document reads. \u201cBut these student-loan borrowers have not been disadvantaged by their service to the country, or for that matter, anything at all.\u201d<\/p>\n<p>\u201cTo the contrary, the President contends this authority exists because, in his sole judgment, and notwithstanding that the need to make loan payments has long been suspended, the COVID-19 pandemic may have made repayment more difficult for some (but not all) recipients of his largesse,\u201d the application continues.<\/p>\n<p>In attempting to justify the legality of the program, the administration has routinely cited the <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:20%20section:1098bb%20edition:prelim)\" target=\"_blank\" rel=\"noreferrer noopener\">HEROES Act<\/a>, a law passed in the wake of the Sept. 11, 2001, terrorist attacks and intended to help U.S. military service members by permitting the executive to waive loans in \u201cconnection with a war or other military operation or national emergency.\u201d <\/p>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2022\/10\/04\/lawsuit-bidens-taxpayer-funded-student-loan-bailout-is-not-how-lawmaking-works-in-america\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, \u201cthe Education Department has\u00a0<a href=\"https:\/\/www2.ed.gov\/policy\/gen\/leg\/foia\/secretarys-legal-authority-for-debt-cancellation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">attempted to rationalize<\/a>\u00a0that the \u2018COVID-19 pandemic\u2019 fulfills the HEROES Act\u2019s definition of a national emergency, despite Biden himself\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/leahbarkoukis\/2022\/09\/19\/biden-the-pandemic-is-over-n2613268\" target=\"_blank\" rel=\"noreferrer noopener\">declaring<\/a>\u00a0the pandemic to be \u2018over\u2019 during a recent \u201960 Minutes\u2019 interview.\u201d Although the administration officially <a href=\"https:\/\/nypost.com\/2022\/10\/15\/us-dept-of-education-launches-beta-test-on-student-loan-application\/\" target=\"_blank\" rel=\"noreferrer noopener\">began beta testing the proposal on Friday<\/a>, the Education Department has yet to provide a release date for the program\u2019s final version.<\/p>\n<p>\u201cWhat Constitutional power does Biden have to take John Q. Public\u2019s money and pay Jane Q. Public\u2019s school loans?\u201d BCTA President Rich Heidel said in a <a href=\"https:\/\/will-law.org\/will-asks-scotus-to-stop-the-biden-student-loan-forgiveness-plan\/\" target=\"_blank\" rel=\"noreferrer noopener\">WILL press release<\/a>. \u201cWhy not her mortgage, why not her car loan? How did the college-educated caste become the lucky ones? When and how does this stop?
