Instead, she declared that government is constitutionally authorized to make people \u201cequal\u201d by taking \u201crace-conscious\u201d actions.<\/p>\n<p>The facts of this matter, which cut to the core of whether government is allowed to discriminate based on race, show that Jackson is wrong. Moreover, history illuminates the harms that occur when governments treat people differently because of their race.<\/p>\n<p><strong>Jackson\u2019s Reasoning<\/strong><\/p>\n<p>In an October 4th hearing for a case called <em><a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2022\/21-1086_f204.pdf\">Merrill v. Milligan<\/a><\/em>, an attorney for the State of Alabama <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2022\/21-1086_f204.pdf#page=5\">argued<\/a> before the Supreme Court that it would be unconstitutional to draw U.S. congressional district boundaries based on race. This is because the <a href=\"https:\/\/www.justfacts.com\/constitution#Amendment14\">14th Amendment<\/a> to the U.S. Constitution forbids states from denying \u201cto any person within its jurisdiction the equal protection of the laws.\u201d<\/p>\n<p>Challenging the attorney, <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2022\/21-1086_f204.pdf#page=58\">Jackson<\/a> insisted that Alabama should be forced to draw its congressional districts in a way that will give black people more voting power. In support of this position, she asserted:<\/p>\n<p>  \u201cI don\u2019t think we can assume that just because race is taken into account that that necessarily creates an equal protection problem\u201d because the framers of the 14th Amendment adopted it \u201cin a race conscious way.\u201d The framers were \u201ctrying to ensure\u201d that former slaves \u201cwere actually brought equal to everyone else in the society.\u201d \u201cThat\u2019s not a race-neutral or race-blind idea in terms of the remedy. And even more than that, I don\u2019t think that the historical record\u201d shows the framers \u201cbelieved that race neutrality or race blindness was required, right?\u201d The framers passed \u201cthe Civil Rights Act of 1866, which specifically stated that citizens would have the same civil rights as enjoyed by white citizens. That\u2019s the point of that Act, to make sure that the other citizens, the black citizens, would have the same as the white citizens.\u201d The Civil Rights Act of 1866 was enacted so that \u201cother citizens have to be made equal to white citizens, and people were concerned that that didn\u2019t have a constitutional basis, so they enacted the Fourteenth Amendment.\u201d  <\/p>\n<p>The fatal flaw in Jackson\u2019s argument is her counterfactual leap from the framers\u2019 reasons for enacting for the 14th Amendment to their \u201cremedy.\u201d The facts, detailed below, show that the framers witnessed governments treating people differently based on race, and their remedy was to ban them from doing that.<\/p>\n<p><strong>Origins of the 14th Amendment<\/strong><\/p>\n<p>Less than a year after the <a href=\"https:\/\/www.justfacts.com\/racialissues#slavery_civil\">Civil War<\/a> ended in 1865, the Louisiana Democratic Party <a href=\"https:\/\/www.justfacts.com\/racialissues#civil_civilwar\">passed a resolution<\/a> stating:<\/p>\n<p>  \u201cwe hold this to be a Government of white people, made and to be perpetuated for the exclusive benefit of\u201d whites. \u201cpeople of African descent cannot be considered\u201d citizens of the United States. \u201cthere can, in no event, nor under any<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By James D.
