Congress could pass a bill, the president could veto it, then Congress could vote to override. And the Supreme Court could step in and void the whole thing.<\/p>\n<p>While the executive and legislative branches are often adversarial \u2014 especially when they\u2019re not controlled by the same party \u2014 the Supreme Court has long been held above the others. Its job is simply to answer this question: Does an action by the president or Congress adhere to the Constitution?<\/p>\n<p>Back in 1972, Americans put great faith in the highest court in the land, with 66% saying they had \u201ctrust and confidence\u201d in the branch,\u00a0<a class=\"c-link\" tabindex=\"-1\" href=\"https:\/\/news.gallup.com\/poll\/402737\/trust-federal-government-branches-continues-falter.aspx\" target=\"_blank\" rel=\"noopener noreferrer\" data-stringify-link=\"https:\/\/news.gallup.com\/poll\/402737\/trust-federal-government-branches-continues-falter.aspx\" data-sk=\"tooltip_parent\" data-remove-tab-index=\"true\">according<\/a>\u00a0to Gallup. That rose to 80% by 1999 and held steady for a decade but began to drop in 2009 as President Barack Obama boldly bashed the court \u2014 down to 76% in 2009, and 53% by 2015.<\/p>\n<p>Americans\u2019 confidence in the court rose to 68% while President Donald Trump took office, but as the mainstream media repeatedly slammed his nominees \u2014 at one point alleging Justice Brett Kavanaugh sexually assaulted a girl back in high school \u2014 that trust plunged to 54%.<\/p>\n<p>Now, with President Joe Biden in office, confidence in the Supreme Court stands at less than half of Americans, 47%.<\/p>\n<p>That is due in large part to Biden endlessly ripping the court as political \u2014 and he\u2019s on a desperate tear now in the waning days of the campaigns before Election Day on November 8.<\/p>\n<p>\u201cI view this, this off-year election, as one of the most important elections that I\u2019ve been engaged in, because a lot can change because the institutions have changed,\u201d he said at a fundraiser for Democrats on Tuesday.<\/p>\n<p>\u201cThe Supreme Court is more of an advocacy group these days than it is a \u2014 evenhanded about it,\u201d he said.<\/p>\n<p>The executive\u2019s attack on the judicial branch comes after the court struck down the constitutional right to abortion and expanded gun rights.<\/p>\n<p>Chief Justice John Roberts blasted the politicization of the court at a September conference for judges and lawyers. \u201cSimply because people disagree with an opinion is not a basis for questioning the legitimacy of the court,\u201d he said, <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/roberts-defends-high-court-against-attacks-on-its-legitimacy\">according<\/a> to Bloomberg Law.<\/p>\n<p>\u201cThe [Court\u2019s] decisions have always been publicly criticized,\u201d Roberts said, adding it is a \u201cmistake\u201d to view those criticisms as doubting the Court\u2019s legitimacy as long as the Court does its job \u2014 which is \u201cto say what the law is.\u201d<\/p>\n<p>\u201cIf the court doesn\u2019t retain its legitimate function of interpreting the Constitution, I\u2019m not sure who would take up that mantle,\u201d he said. \u201cYou don\u2019t want the political branches telling you what the law is.
