Bush appointee, ruled that <a href=\"https:\/\/www.theepochtimes.com\/t-igor-danchenko\">Igor Danchenko<\/a>, the source, did not make a false statement when he told FBI agents on June 15, 2017, that he did not talk with Charles Dolan about material that was included in the dossier.<\/p>\n<p>\u201cOkay, so you\u2019ve\u00a0had \u2026 was there any \u2026 but you had never talked to Chuck Dolan about anything that showed up in the dossier right?\u201d an FBI agent asked Danchenko at the time.<\/p>\n<p>\u201cNo,\u201d Danchenko said.<\/p>\n<p>\u201cYou don\u2019t think so?\u201d the agent asked.<\/p>\n<p>\u201cNo. We talked about, you know, related issues perhaps but no, no, no, nothing specific.\u201d<\/p>\n<p>The key word was \u201ctalked,\u201d Trenga said, siding with defense lawyers who had argued that a common meaning of talk is to deliver information by speech.<\/p>\n<p>The FBI agents made \u201cno effort\u201d to probe the matter further,\u201d Trenga said. \u201cMr. Danchenko answered literally. Mr. Danchenko\u2019s answer was literally true in that the government never established he \u2026 talked with Dolan\u201d about the information that was ultimately published in the dossier, which was funded by Democrats including Trump\u2019s rival for president in 2016, former Secretary of State Hillary Clinton.<\/p>\n<p>The government \u201cfails to carry the burden of evidence,\u201d the judge added.<\/p>\n<p>Dolan said during the trial that he maintains he never talked with Danchenko about anything in the dossier.<\/p>\n<p>Dolan sent Danchenko a message on Aug. 20, 2016, claiming he\u2019d received information about drama in the Trump campaign involving officials Corey Lewandowski and Paul Manafort. That information appeared in similar form in the dossier.<\/p>\n<p>\u201cMr. Dolan, would you agree that the information you provided to Mr. Danchenko is substantially similar to what\u2019s in report 3 of the dossier?\u201d a prosecutor asked Dolan during Danchenko\u2019s trial.<\/p>\n<p>\u201cYes,\u201d Dolan said.<\/p>\n<p>Dolan also <a href=\"https:\/\/www.theepochtimes.com\/clinton-associate-testifies-he-lied-about-claim-that-made-its-way-into-dossier_4794675.html\">acknowledged<\/a> during the trial that he lied about having a GOP source who provided him with information and <a href=\"https:\/\/www.theepochtimes.com\/another-dossier-source-viewed-clinton-favorably-and-other-key-moments-from-day-3-of-danchenkos-trial_4796720.html\">detailed<\/a> his deep ties with Russia.<\/p>\n<p>Jurors will still decide on the remaining four counts.<\/p>\n<p>Those all relate to Sergei Millian, a pro-Trump businessman.<\/p>\n<p>Danchenko lied when he said that he thought he spoke with Millian in 2016 when he actually \u201cwell knew\u201d that the person on the phone was not Millian, according to charging documents.<\/p>\n<p>Danchenko was charged in late 2021 with five counts of lying to the FBI in interviews in 2021. The Russian national, who has bragged that he was responsible for most of the material in the dossier, faces up to 20 years in prison if convicted after the partial acquittal.<\/p>\n<p>The jury was given instructions on Friday. They were set to start deliberating on Monday after closing arguments.<\/p>\n<p>Prosecutors wrapped up their case with several current and former FBI personnel. Defense lawyers called no witnesses.
