{"id":1695365,"date":"2022-10-15T06:04:02","date_gmt":"2022-10-15T10:04:02","guid":{"rendered":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1695365"},"modified":"2022-10-16T11:24:32","modified_gmt":"2022-10-16T15:24:32","slug":"waukesha-christmas-parade-massacre-suspect-attempts-to-use-sovereign-citizen-defense","status":"publish","type":"post","link":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/waukesha-christmas-parade-massacre-suspect-attempts-to-use-sovereign-citizen-defense\/","title":{"rendered":"Waukesha Christmas Parade Massacre Suspect Attempts to Use &#8220;Sovereign Citizen&#8221; Defense"},"content":{"rendered":"<aside class=\"mashsb-container mashsb-main mashsb-stretched\"><div class=\"mashsb-box\"><div class=\"mashsb-count mash-medium\" style=\"float:left\"><div class=\"counts mashsbcount\">22<\/div><span class=\"mashsb-sharetext\">SHARES<\/span><\/div><div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.conservativenewsdaily.net%2Fbreaking-news%2Fwaukesha-christmas-parade-massacre-suspect-attempts-to-use-sovereign-citizen-defense%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=&amp;url=https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1695365&amp;via=ConservNewsDly\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Twitter<\/span><\/a><a class=\"mashicon-subscribe mash-medium mash-nomargin mashsb-noshadow\" href=\"#\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Subscribe<\/span><\/a><div class=\"onoffswitch2 mash-medium mashsb-noshadow\" style=\"display:none\"><\/div><\/div>\n            <\/div>\n                <div style=\"clear:both\"><\/div><\/aside>\n            <!-- Share buttons by mashshare.net - Version: 4.0.47--><p>As the trial of Waukesha parade massacre suspect Darrel Brooks continues, the defendant is attempting to use the idea of being a sovereign citizen as a defense.<\/p>\n<p>According to <a href=\"https:\/\/www.tmj4.com\/news\/darrell-brooks-trial\/judge-rules-brooks-is-unable-to-use-sovereign-citizen-defense-at-trial\">TMJ4<\/a>, &#8220;A sovereign citizen is someone who believes they are not under the jurisdiction of any sort of government and therefore thinks the laws don\u2019t apply to them.&#8221;<\/p>\n<p>On October 6, Judge Jennifer Dorow ruled that <a href=\"https:\/\/thepostmillennial.com\/breaking-waukesha-massacre-suspect-darrell-brooks-pleads-not-guilty-to-all-charges\/\">Brooks<\/a> count not use the defense, saying that it doesn\u2019t have merit.<\/p>\n<p><a href=\"https:\/\/thepostmillennial.com\/breaking-waukesha-christmas-parade-massacre-suspect-denied-change-of-venue-request\">Brooks<\/a>, who has had many outbursts during the trial so far, has suggested that as a sovereign citizen, he\u2019s immune to the court\u2019s rules and state\u2019s laws.<\/p>\n<p>Civil rights attorney William Sulton told TMJ4, &#8220;From a legal standpoint, it means nothing because it&#8217;s not a defense at all.&#8221;<\/p>\n<p>&#8220;It&#8217;s a theory that&#8217;s been rejected for decades and the court properly rejected it here,\u201d he said.<\/p>\n<p>Sultan said that the defense argument has gained steam over the last decade, but never works out for those who use it.<\/p>\n<p>Dr. Christine Sarteschi, a professor at Chatham University and a long-time studier of sovereign citizens, told TMJ4, &#8220;People always ask me, &#8216;Why would anyone try this when they never work?&#8217; but the thing is I don&#8217;t think the people who are trying them know it doesn&#8217;t work, or they believe, &#8216;hey, if I just use my strategy, this little difference here, it will work this time.'&#8221;<\/p>\n<p>&#8220;They don&#8217;t believe in the court system, they don&#8217;t believe in the government. They don&#8217;t think they have jurisdiction, and so they challenge them, like he&#8217;s doing. [Brooks] seems worse in some ways than a lot of sovereign citizens,&#8221;\u00a0Sarteschi said in regards to sovereign citizens, speaking with <a href=\"https:\/\/www.vice.com\/en\/article\/xgy4nw\/darrell-brooks-trial-waukesha-christmas-parade-attack\">VICE News<\/a>.<\/p>\n<p>She said that Judge Dorow appears to be trying to avoid a mistrial.<\/p>\n<p>&#8220;They&#8217;re trying to eliminate that possibility because I&#8217;ve seen plenty of sovereign cases where somebody is allowed to represent themselves and then when they lose, which is typically the case, they go back and they try to appeal it on the basis that they should not have been allowed to represent themselves,&#8221; she said.\u00a0<\/p>\n<p>On day one of the trial last week, the judge was forced to take multiple recesses due to Brooks\u2019 outbursts, at one point kicking Brooks out of the courtroom altogether to watch the proceedings from a nearby room, according to <a href=\"https:\/\/www.fox9.com\/news\/darrell-brooks-trial-begins-monday\">Fox 9<\/a>.<\/p>\n<p>Brooks told Dorow multiple times that he &#8220;doesn\u2019t recognize&#8221; the name &#8220;Darell Brooks,&#8221; an objection that has carried into Friday&#8217;s proceedings.<\/p>\n<p>Brooks, who is <a href=\"https:\/\/thepostmillennial.com\/driver-in-waukesha-christmas-parade-massacre-allowed-to-cross-examine-victims-belittling-and-re-traumatizing-them\">representing himself<\/a>, has been reminded by Dorow that she can revoke his right to represent himself &#8220;at any time,&#8221; accusing him on numerous occasions of refusing to answer &#8220;the simplest of questions.&#8221;<\/p>\n<p>According to Fox 9, Dorow has called Brooks\u2019 declaration of being a sovereign citizen an &#8220;obstructionist tactic.&#8221;<\/p>\n<p>Brooks has also given the state a handwritten note demanding, amongst other things, that state prosecutors give &#8220;verified proof&#8221; of his United States citizenship.<\/p>\n<p>Number 12 on the lengthy list states: &#8220;Plaintiff, please provide verified proof that the alleged defendant<\/p>\n","protected":false},"excerpt":{"rendered":"<p>As the trial of Waukesha parade massacre suspect Darrel Brooks continues, the defendant is attempting to use the idea of being a sovereign citizen as a defense.
