Gavin <a href=\"https:\/\/www.dailywire.com\/topic\/gavin-newsom\" target=\"_blank\" rel=\"noopener\">Newsom<\/a> signed a measure into law last month that doesn\u2019t allow businesses to sell products for women at a higher price than they are sold to men.<\/p>\n<p class=\"p1\">The law, AB <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB1287\" target=\"_blank\" rel=\"noopener\">1287<\/a>, states that a business or other entity \u201cshall not charge a different price for any two goods that are substantially similar if those goods are priced differently based on the gender of the individuals for whom the goods are marketed and intended.\u201d<\/p>\n<p class=\"p1\">In the bill, \u201c[s]ubstantially similar\u201d means two products where there are \u201c[n]o substantial differences in the materials used in production,\u201d \u201c[t]he intended use is similar,\u201d \u201c[t]he functional design and features are similar,\u201d and \u201c[t]he brand is the same or both brands are owned by the same individual or entity.\u201d<\/p>\n<p class=\"p1\">However, the law notably allows price disparities for specific reasons. It points out that costs of items can be different if the price is based on how much time it takes to make the items, how difficult it is to make them, the \u201ccost incurred in manufacturing,\u201d \u201c[t]he labor used,\u201d [t]he materials used,\u201d as well as \u201c[a]ny other gender-neutral reason for charging a different price for those goods.\u201d<\/p>\n<p class=\"p1\">A company could face a fine of $10,000 for an initial violation, and $1,000 for each following violation, not totaling to more than $100,000.<\/p>\n<p class=\"p1\">The legislation is <a href=\"https:\/\/ktla.com\/news\/politics\/new-california-law-bans-companies-from-gender-based-pricing-on-products\/\" target=\"_blank\" rel=\"noopener\">directed<\/a> towards what critics refer to as the \u201cpink tax,\u201d which claims that women\u2019s items are marked up from men\u2019s items, even when the product is the same as something marketed to men.<\/p>\n<p class=\"p1\">\u201cThe \u2018Pink Tax\u2019 is a gender based penalty that harms women who are already paid less,\u201d Assemblywoman Rebecca Bauer-Kahan, who introduced the legislation, reportedly <a href=\"https:\/\/www.washingtonexaminer.com\/news\/california-bans-gender-based-pricing\" target=\"_blank\" rel=\"noopener\">said<\/a> in a statement.\u00a0\u201cThis type of arbitrary gendered pricing has no place in California. It\u2019s long past time to eliminate this type of inequality. I\u2019m grateful Governor Newsom has signed this bill to ensure price equality in California.\u201d<\/p>\n<p class=\"p1\">\u201cSimply being a woman shouldn\u2019t cost money \u2013 but it does,\u201d Holly Martinez, Executive Director of the California Commission on the Status of Women and Girls, which assisted in writing the bill, said.<\/p>\n<p class=\"p1\">\u201cThese measures bring new transparency to tackle pay gaps, end discriminatory pricing of products based on gender and expand supports for survivors of abuse and assault,\u201d Governor Newsom said. \u201cCalifornia has the strongest equal pay laws in the nation, but we\u2019re not letting up on our work to ensure all women in our state are paid their due and treated equally in all spheres of life.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Democratic California Gov.
