County District Attorney George Gascon\u00a0<a href=\"https:\/\/nypost.com\/2022\/08\/16\/woke-la-da-george-gascon-survives-recall-bid\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a>\u00a0because nearly 200,000 petition signatures were invalidated, the campaign to recall Gascon\u00a0<a href=\"https:\/\/www.recalldageorgegascon.com\/for-immediate-release-initial-review-reveals-substantial-number-of-improperly-invalidated-signatures-recall-committee-to-file-for-injunctive-relief-against-registrar-of-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>\u00a0it is filing for injunctive relief after an initial review showed 39 percent of the signatures invalidated by the L.A. County registrar were likely wrongfully rejected.\u00a0<\/p>\n<p>\u201cThe initial review of invalidated signatures demonstrates the Registrar\u2019s counting process was seriously flawed, resulting in substantial errors, the wrongful invalidation of many valid signatures, and the disenfranchisement of thousands of Los Angeles County Voters,\u201d the campaign wrote in a press release.<\/p>\n<p>After the California county\u2019s registrar-recorder, Dean Logan, rejected the campaign\u2019s recall petition over an insufficient number of valid signatures (Logan determined the petition had only 520,050 valid signatures, a figure just short of the 566,857 they needed), volunteer attorneys began conducting a review of the invalidated signatures. They identified legitimate challenges for 39 percent of the invalidated signatures reviewed so far.<\/p>\n<p>Examples of improper invalidation by the registrar include:\u00a0<\/p>\n<ul>\n<li>Signatures \u201cinvalidated as \u2018non-matching\u2019 despite showing substantial similarities to the signatures on file.\u201d<\/li>\n<li>Signatures invalidated as \u201cnot registered\u201d despite the signature belonging to a registered voter.<\/li>\n<li>Signatures \u201cincorrectly invalidated as \u2018duplicates\u2019 without the Registrar counting at least one of the alleged duplicates as required by law.\u201d\u00a0<\/li>\n<li>Signatures invalidated over confusion regarding changes to voters\u2019 addresses.<\/li>\n<\/ul>\n<p>The recall campaign also claims that the L.A. County registrar placed arbitrary limits on the campaign\u2019s review process, limiting review hours, the number of reviewers, and \u201caccess to information necessary to determine\u201d the validity of a signature. It will take more than a year for the volunteers to review all the invalidated signatures under those limitations, the recall effort claims. The campaign is filing for injunctive relief to seek expanded access.<\/p>\n<p>In addition to claiming improper signature invalidation, the campaign also argues that L.A. County\u2019s voter rolls were \u201cartificially inflated\u201d by 208,000 to 515,000 ineligible names at the time the number of signatures required for the recall was determined (10 percent of all Los Angeles County registered voters).<\/p>\n<p>Had L.A. County been actively maintaining its voter rolls, there\u2019s a good chance the recall petition would have gone through, even with the rejected signatures.<\/p>\n<p>\u201cThe original requirement of 566,857 signatures to qualify (based on bloated voter rolls showing 5,668,569 active voters at the time) should have been set anywhere from 515,357 to 546,357,\u201d according to the press release. \u201cThis issue alone could substantially affect the outcome of the recall given that the Registrar has already identified what it deems to be 520,050 valid signatures.\u201d<\/p>\n<p>This isn\u2019t the first time L.A. County has been criticized for failing to clean its voter rolls. Back in 2019, California and Los Angeles County\u00a0<a href=\"https:\/\/www.nbclosangeles.com\/news\/la-county-and-state-to-purge-15-million-inactive-voters-from-rolls\/6866\/\" target=\"_blank\" rel=\"noreferrer noopener\">agreed to purge<\/a>\u00a0as many as 1.5 million ineligible voters from its rolls after Judicial Watch filed a lawsuit arguing the Golden State and its biggest county were not complying with federal law requiring the removal of inactive registrants.<\/p>\n<p>\u201cIf I were interested in Los Angeles, I would be dredging the records of list maintenance through the NVRA [the National Voter Registration Act, a federal law that governs voter registration and removal] to see how responsive they\u2019ve been to the Judicial Watch lawsuit settlement, because they\u2019re under some kind of obligation already,\u201d President of the Public Interest Legal Foundation J. Christian Adams told The Federalist.\u00a0<\/p>\n<p>Adams has spent 10 years litigating voter roll maintenance and other election integrity-related cases. Most recently, PILF has\u00a0<a href=\"https:\/\/publicinterestlegal.org\/press\/pilf-files-sixth-and-final-voter-list-maintenance-complaint-in-minnesota-over-duplicate-registrations\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a>\u00a0six complaints surrounding 515 duplicate voter registrations in six Minnesota counties. The nonprofit law group also filed a lawsuit\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/08\/26\/judge-denies-michigan-secretary-of-states-motion-to-dismiss-lawsuit-removing-26000-dead-registrants-from-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">against <\/a><a href=\"https:\/\/thefederalist.com\/2022\/08\/26\/judge-denies-michigan-secretary-of-states-motion-to-dismiss-lawsuit-removing-26000-dead-registrants-from-voter-rolls\/\">Michigan Secretary of State Jocelyn Benson<\/a>\u00a0for her failure to remove nearly 26,000 dead registrants from Michigan\u2019s voter rolls.\u00a0<\/p>\n<p>Due to an\u00a0<a href=\"https:\/\/www.demos.org\/sites\/default\/files\/2019-08\/11th%20Circuit%20Decision%20ACRU%20v%20Snipes.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">11th\u00a0Circuit Court decision<\/a>\u00a0that refused to accept the inflated voter roll theory, Adams recommended the recall campaign instead find the ineligible registrants \u2014 duplicates, deceased, those that have moved, etc. \u2014 on L.A. County\u2019s voter rolls, just like what PILF does.\u00a0<\/p>\n<p>\u201cThey need to be doing the analysis, and not just the math,\u201d Adams said. \u201cBecause the courts have foreclosed the math part.\u201d\u00a0<\/p>\n<p>While it looks like many Democrat-run cities \u2014 Los Angeles,\u00a0<a href=\"https:\/\/whyy.org\/articles\/the-partisan-conflict-behind-a-quest-to-purge-up-to-800000-voters-from-pa-s-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">Philadelphia<\/a>,\u00a0<a href=\"https:\/\/publicinterestlegal.org\/cases\/pilf-v-detroit\/\" target=\"_blank\" rel=\"noreferrer noopener\">Detroit<\/a>\u00a0\u2014 are plagued by inflated voter rolls (and many critics rightly blame\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/09\/21\/complaint-michigan-secretary-of-state-broke-law-by-outsourcing-voter-roll-cleanup-to-left-wing-group\/\" target=\"_blank\" rel=\"noreferrer noopener\">nefarious<\/a>\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/08\/11\/democratic-operatives-control-voter-rolls-in-31-states-report-shows\/\" target=\"_blank\" rel=\"noreferrer noopener\">political operatives<\/a>), Adams believes it\u2019s because there are more renters than property owners in cities, thus more people move around and fail to change their voter registration.\u00a0<\/p>\n<p>\u201cThe NVRA does not let you remove people who are ineligible at the pace that they\u2019re coming onto the rolls,\u201d Adams said. \u201cThat limits your ability to take people off with the same amount of speed they\u2019re moving.\u201d<\/p>\n<p>Although voter roll maintenance can be a slow and arduous process for municipalities, Adams still emphasized the importance of maintaining accurate records.\u00a0<\/p>\n<p>\u201cThis [Gascon recall petition] is the first time I\u2019ve heard of bad list maintenance potentially impacting a signature drive,\u201d Adams said. \u201cIn all the years I\u2019ve worked in this space I\u2019ve never contemplated how having ineligible voters on your rolls makes it harder for people to get enough signatures in a place like California.
