Wade<\/em><\/a> last summer.<\/p>\n<p><span data-preserver-spaces=\"true\">In 2019, the Catholics for Life group and two pregnant women challenged a newly enacted Rhode Island law that codified abortion rights. However, according to\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.reuters.com\/legal\/us-supreme-court-rebuffs-fetal-personhood-appeal-2022-10-11\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Reuters<\/a><span data-preserver-spaces=\"true\">, the Rhode Island Supreme court ruled the plaintiffs lacked proper legal standing for the case.<\/p>\n<p>But after justices overturned the <em>Roe<\/em> decision in June, the plaintiffs asked the Supreme Court to consider the case.<\/p>\n<p>\u201cThis Court should grant the writ to finally determine whether prenatal life, at any gestational age, enjoys constitutional protection \u2013 considering the full and comprehensive history and tradition of our Constitution and law supporting personhood for unborn human beings,\u201d the petitioners\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-201\/236882\/20220901130349933_Petition%20Brief.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">wrote<\/a><span data-preserver-spaces=\"true\">.<\/p>\n<p>The court declined without comment.<\/p>\n<p>The plaintiff\u2019s lawyers have not responded to requests for comment.<\/p>\n<p>Rhode Island Democratic Governor Daniel McKee expressed satisfaction with the justices\u2019 decision to\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.reuters.com\/legal\/us-supreme-court-rebuffs-fetal-personhood-appeal-2022-10-11\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Reuters<\/a><span data-preserver-spaces=\"true\">.<\/p>\n<p>\u201cGovernor McKee believes that we should be expanding access to reproductive healthcare for women,\u201d spokesperson Matt Sheaff said in a statement, adding that the governor \u201cis committed to using his veto pen to block any legislation that would take our state backwards.\u201d<\/p>\n<p>Justice Samuel Alito wrote in the court\u2019s June ruling to overturn abortion rights that the court took no position on \u201cif and when prenatal life is entitled to any of the rights enjoyed after birth.\u201d<\/p>\n<p>The plaintiff\u2019s lawyers argued the case \u201cpresents the opportunity for this court to meet that inevitable question head on,\u201d referring to if the U.S. Constitution\u2019s 14th Amendment grants a fetus due process and equal protection rights. In the 1973 <em>Roe v. Wade<\/em> decision, the nation\u2019s highest court found that \u201cthe word \u2018person,\u2019 used in the Amendment does not include the unborn.\u201d<\/p>\n<p>Prenatal life, or fetal personhood, has sparked heavy debate recently between pro-abortion advocates and those protecting the sanctity of life. While abortion rights supporters claim personhood laws could impact in vitro fertilization or subject women to murder charges, pro-life advocates argue that fertilized eggs, embryos, and fetuses should have the same rights as newborns.<\/p>\n<p>Since the court\u2019s ruling, more than a dozen states have enacted near-total abortion bans.<\/p>\n<p>Georgia state law following the Dobbs decision allows pregnant women to claim their unborn embryo as a dependent on their tax returns, according to <a class=\"editor-rtfLink\" href=\"https:\/\/thehill.com\/homenews\/3584208-georgians-can-claim-an-embryo-as-a-dependent-on-tax-returns\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">The Hill<\/a><span data-preserver-spaces=\"true\">.<\/p>\n<p>Axios\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.axios.com\/local\/columbus\/2022\/07\/14\/ohio-bill-ban-abortions-conception\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">reports<\/a><span data-preserver-spaces=\"true\">\u00a0Ohio state lawmakers are also considering creating a law that would recognize personhood from the moment of conception.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Supreme court turned away a\u00a0case\u00a0Tuesday that would determine if unborn children are entitled to have constitutional rights following the historic overturning of Roe v.
