Those documents were among some 11,000 records that FBI agents seized on Aug. 8.<\/p>\n<p>While urging the Supreme Court to reject Trump\u2019s petition, DOJ officials wrote (<a href=\"https:\/\/s3.documentcloud.org\/documents\/23129295\/22a283-response.pdf\">pdf<\/a>) the former president \u201ccertainly cannot establish the clear error required to justify the relief he seeks\u2014particularly because he does not acknowledge, much less attempt to rebut, the court of appeals\u2019 conclusion that the district court\u2019s order was a serious and unwarranted intrusion on the Executive Branch\u2019s authority.\u201d<\/p>\n<p>On Aug. 22, Trump filed a petition to restrict the DOJ\u2019s access to the records as it pursues an investigation into whether he retained classified documents after departing the White House in January 2021. A federal judge in Florida sided with Trump\u2019s attorneys and appointed a special master, retired Judge Raymond Deare, to review the documents.<\/p>\n<p>His lawyers previously told the Supreme Court that Dearie should be able to look into the records to see whether the FBI-seized materials \u201cbearing classification markings are in fact classified, and regardless of classification, whether those records are personal records or presidential records.\u201d<\/p>\n<p>Further, they wrote that the DOJ is trying \u201cto criminalize a document management dispute and now vehemently objects to a transparent process that provides much-needed oversight,\u201d his lawyers added.<\/p>\n<p> <a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/10\/11\/GettyImages-1243795466-1200x826.jpg\"><\/a> Justices of the US Supreme Court pose for their official photo at the Supreme Court in Washington on Oct. 7, 2022.
