The agency\u2019s\u00a0<a href=\"https:\/\/www.mbda.gov\/who-we-are\/overview\" target=\"_blank\" rel=\"noreferrer noopener\">vision<\/a>\u00a0is \u201ceconomic prosperity for all American business enterprises.\u201d The MBDA will build regional centers, run grant programs, offer training programs, and assist businesses in obtaining financing, among other things.\u00a0<\/p>\n<p>Make no mistake: This federal agency is not an equal opportunity provider. Congress limited the MBDA, part of the Department of Commerce, to assisting only \u201cdisadvantaged businesses,\u201d which federal law presumes to be only businesses owned by African Americans, Hispanics, American Indians, Asians, or Pacific Islanders. All white-owned businesses are presumed to be \u201cnot disadvantaged.\u201d MBDA\u2019s\u00a0<a href=\"https:\/\/www.mbda.gov\/news\/press-releases\/2021\/11\/minority-business-development-agency-permanently-authorized-bipartisan\" target=\"_blank\" rel=\"noreferrer noopener\">website<\/a>\u00a0is crystal clear that the agency is \u201csolely dedicated to the growth and global competitiveness of minority business enterprises.\u201d<\/p>\n<p>Why is this a problem? The Constitution broadly forbids race discrimination by the government. Although courts have sometimes allowed government officials to treat individuals differently based on race, these exceptions have been limited to permit no more discrimination than is necessary to alleviate some discrete episode of discrimination in a particular place and in which the government has somehow been involved. For example, in\u00a0<em>U.S. v. Paradise,<\/em>\u00a0the Supreme Court allowed a temporary racial quota to remedy Alabama\u2019s \u201clong term, open, and pervasive\u201d intentional discrimination against black state troopers. The court\u00a0<a href=\"https:\/\/edge.sagepub.com\/conlaw\/resources\/rights-liberties-and-justice\/13-discrimination\/cases\/united-states-v-paradise\" target=\"_blank\" rel=\"noreferrer noopener\">allowed<\/a>\u00a0the program, in part, because it was \u201cflexible, waivable, and temporary in application,\u201d it had worked in the past, and it did not \u201cburden innocent third parties.\u201d\u00a0<\/p>\n<p>The facts in\u00a0<em>Paradise<\/em>\u00a0were egregious. Whether the court got the rule exactly right, the MBDA is not limited in this way. It prefers all blacks and certain other racial minorities. It burdens all whites. It rests on allegations of generalized \u201cracism\u201d and is not firmly tied to demonstrated and particularized discrimination. It seeks to eliminate group disparities that are presumed to stem entirely from a general atmosphere of discrimination.\u00a0<\/p>\n<h2>Equal Opportunity not \u2018Equity\u2019<\/h2>\n<p>While the Supreme Court is currently\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/race-harvard-and-the-supreme-court-students-for-fair-admissions-colleges-quotas-11643063228\" target=\"_blank\" rel=\"noreferrer noopener\">considering<\/a> whether public universities can make limited use of race as a factor to promote \u201cdiversity\u201d in admissions, it has long made\u00a0<a href=\"https:\/\/www.oyez.org\/cases\/2006\/05-908\" target=\"_blank\" rel=\"noreferrer noopener\">clear<\/a>\u00a0that the government may not draw racial classifications merely to eliminate racial disparities or even to address general \u201csocietal\u201d or even \u201csystemic\u201d discrimination. As in\u00a0<em>Paradise,\u00a0<\/em>carefully limited racial preferences might be justified to redress a government\u2019s demonstrated refusal to hire black officers, but quotas cannot be adopted to ensure that the force \u201clooks like\u201d the community. The American left may seek to replace equal opportunity for individuals of all races with an \u201cequity\u201d mandating group equality, but our Constitution won\u2019t permit it.\u00a0<\/p>\n<p>As former Justice Sandra Day O\u2019Connor wrote in a 1989 case striking down racial quotas, allowing race discrimination to rebalance society \u201ceffectively assures that race will always be relevant in American life.\u201d\u00a0<\/p>\n<p>There is no logical stopping point to racial tinkering aimed at precisely equal outcomes for all racial groups. The resulting regime of racial entitlement would be inconsistent with the moral force behind the civil rights movement \u2014 that all Americans ought to be judged by the content of their character and not the color of their skin. As Supreme Court Justice Antonin Scalia put it, from a constitutional perspective, there can be \u201cno such thing as a creditor or debtor race\u201d because that concept \u201cis alien to the Constitution\u2019s focus on the individual.\u201d And as Chief Justice John Roberts famously wrote, \u201c[t]he way to stop discrimination on the basis of race is to stop discriminating on the basis of race.\u201d<\/p>\n<p>This route may not be simple or quick. But it\u2019s the only one.<\/p>\n<h2>Other Racist Government Programs<\/h2>\n<p>Unfortunately, the MBDA is not an outlier. The Biden administration has frequently set up explicit race discrimination in prior programs. In 2021, the administration launched a farmer loan forgiveness program to help \u201cdisadvantaged\u201d farmers, a Restaurant Revitalization Fund that prioritized \u201cdisadvantaged\u201d restaurant owners, and a Homeowner Assistance Fund with flexible standards only for \u201cdisadvantaged\u201d homeowners. The administration even created a <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/11\/23\/fact-sheet-the-bipartisan-infrastructure-law-will-revitalize-main-street\/\" target=\"_blank\" rel=\"noreferrer noopener\">$37 billion<\/a> infrastructure fund for \u201cdisadvantaged\u201d federal contractors. In each instance, \u201cdisadvantaged\u201d was just a euphemism for \u201cnon-white.\u201d Litigators stepped in. The Equality Under the Law Project, run by the Wisconsin Institute for Law and Liberty, challenged each program, obtaining two favorable court orders, one substantial programmatic change, and one legislative repeal by Congress. Others enjoyed similar success.\u00a0<\/p>\n<p>It is unlikely that Congress will fix the MBDA. Not a single senator <a href=\"https:\/\/www.mbda.gov\/node\/730\" target=\"_blank\" rel=\"noreferrer noopener\">objected<\/a> to the appointment of the head of that racially discriminatory agency.
