Among the <a href=\"https:\/\/www.paypalobjects.com\/marketing\/ua\/pdf\/US\/en\/acceptableuse-full-110322.pdf\" target=\"_blank\" rel=\"noopener\">changes<\/a> are prohibitions on \u201cthe sending, posting, or publication of any messages, content, or materials\u201d that \u201cpromote misinformation\u201d or \u201cpresent a risk to user safety or wellbeing.\u201d Users are also barred from \u201cthe promotion of hate, violence, racial or other forms of intolerance that is discriminatory.\u201d<\/p>\n<p>The company\u2019s <a href=\"https:\/\/www.paypal.com\/us\/legalhub\/acceptableuse-full\" target=\"_blank\" rel=\"noopener\">current<\/a> acceptable use policy does not mention such activities. The Daily Wire reached out to PayPal for definitions of the added terms, although no response was received in time for publication.<\/p>\n<p>Deliberations will be made at the \u201csole discretion\u201d of PayPal and may subject the user to \u201cdamages\u201d \u2014 including the removal of $2,500 \u201cdebited directly from your PayPal account.\u201d The company\u2019s <a href=\"https:\/\/www.paypal.com\/us\/webapps\/mpp\/ua\/useragreement-full?locale.x=en_US#restricted-activities\" target=\"_blank\" rel=\"noopener\">user agreement<\/a> contains a provision in which account holders acknowledge that the figure is \u201cpresently a reasonable minimum estimate of PayPal\u2019s actual damages\u201d due to the administrative cost of tracking violations and damage to the company\u2019s reputation.<\/p>\n<p>\u201cUnder existing law, PayPal has the ability as a private company to implement this type of viewpoint-discriminatory policy,\u201d Aaron Terr, a senior program officer at the Foundation for Individual Rights and Expression, explained to The Daily Wire. \u201cWhatever motivation PayPal has for establishing these vague new categories of prohibited expression, they will almost certainly have a severe chilling effect on users\u2019 speech. As is often the case with ill-defined and viewpoint-discriminatory speech codes, those with unpopular or minority viewpoints will likely bear the brunt of these restrictions.\u201d<\/p>\n<p>The move comes days after PayPal canceled three accounts linked to Toby Young, a commentator who runs a nonprofit called Free Speech Union. The organization has <a href=\"https:\/\/freespeechunion.org\/blog\/\" target=\"_blank\" rel=\"noopener\">defended clients<\/a> such as actor and comedian Russell Brand, who recently <a href=\"https:\/\/www.dailywire.com\/news\/russell-brand-leaves-youtube-for-rumble-after-censorship-complaint\" target=\"_blank\" rel=\"noopener\">moved his show<\/a> from YouTube to Rumble in reaction to censorship from the former platform.<\/p>\n<p>Roughly one-third of Free Speech Union members rely upon PayPal to process their membership dues \u2014 although the company gave no explanation to Young for the suspension beyond mentioning a breach of the acceptable use policy. PayPal later restored the accounts after receiving criticism from lawmakers and apologized to Young for \u201cany inconvenience caused,\u201d according to a <a href=\"https:\/\/www.telegraph.co.uk\/politics\/2022\/09\/27\/paypal-reinstates-free-speech-union-accounts-accused-politically\/\" target=\"_blank\" rel=\"noopener\">report<\/a> from The Telegraph.<\/p>\n<p>Platforms such as <a href=\"https:\/\/www.dailywire.com\/news\/the-end-of-conservative-books-amazon-quietly-bans-books-they-deem-offensive-hate-speech\" target=\"_blank\" rel=\"noopener\">Amazon<\/a>, <a href=\"https:\/\/www.dailywire.com\/news\/allie-beth-stuckey-suspended-from-twitter-after-challenging-fox-news-segment-that-went-viral\" target=\"_blank\" rel=\"noopener\">Twitter<\/a>, and <a href=\"https:\/\/www.dailywire.com\/news\/meta-doubles-down-after-zuckerberg-reveals-how-facebook-censored-hunter-biden-laptop-story\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> have formerly censored conservatives and others who subscribe to heterodox positions on controversial social issues, including transgenderism and homosexuality. <a href=\"https:\/\/www.dailywire.com\/news\/what-gofundmes-trucker-convoy-targeting-says-about-tech\" target=\"_blank\" rel=\"noopener\">GoFundMe<\/a> seized millions in funds raised for trucker protests in Canada earlier this year, while <a href=\"https:\/\/www.dailywire.com\/news\/democrat-senator-happy-about-getting-google-to-suppress-crisis-pregnancy-centers\" target=\"_blank\" rel=\"noopener\">Google<\/a> recently began suppressing search results for crisis pregnancy centers.<\/p>\n<p>\u201cThese kinds of policies are unwise, threaten free speech, and invite legal risk,\u201d Jeremy Tedesco, vice president of corporate engagement at Alliance Defending Freedom, told The Daily Wire. \u201cWhen companies apply policies to restrict the religious speech of their customers, they could run afoul of prohibitions on religious discrimination that exist in many state and federal laws.\u201d<\/p>\n<p>PayPal has also <a href=\"https:\/\/www.dailywire.com\/news\/gay-rights-organization-gets-deplatformed-by-paypal-while-pro-pedophile-group-remains\" target=\"_blank\" rel=\"noopener\">sanctioned<\/a> Gays Against Groomers, a group that opposes the sexualization of children, as well as evolutionary biologist Colin Wright and journalist Ian Miles Cheong. The company featured a rainbow-colored banner on its social media platforms during the month of June affirming that the platform is \u201copen for all\u201d \u2014 and PayPal U.K. still <a href=\"https:\/\/twitter.com\/PayPalUK\" target=\"_blank\" rel=\"noopener\">sports<\/a> the banner.<\/p>\n<p>\u201cWhatever PayPal\u2019s intentions may be, censorship and chilling free speech is precisely the effect of these kinds of vaguely worded policies,\u201d Tedesco added. \u201cWe\u2019ve seen social media companies use similar policies to stifle free speech on their platforms.
