The tech giant deceptively obtained users\u2019 location data and used it to make billions in profit. It\u2019s one of the largest consumer fraud lawsuits in Arizona history.<\/p>\n<p>\u201cWhen I was elected attorney general, I promised Arizonans I would fight for them and hold everyone, including corporations like Google, accountable,\u201d Arizona Attorney General Mark Brnovich said in a press release. \u201cI am proud of this historic settlement that proves no entity, not even big tech companies, is above the law.\u201d<\/p>\n<p>Most of the $85 million will go into the state general fund and need legislative appropriation to be spent. However, $5 million is going to attorney general education programs, according to Brnovich\u2019s office.<\/p>\n<p>General Brnovich started investigating Google after a <a class=\"editor-rtfLink\" href=\"https:\/\/azag.us5.list-manage.com\/track\/click?u=cc1fad182b6d6f8b1e352e206&amp;id=7bf1602012&amp;e=d9e61735a1\" target=\"_blank\" rel=\"noopener\">2018 Associated Press article<\/a> revealed the company misled and deceived its consumers about the collection and use of their personal location data. Google did so by tracking smartphones even when consumers disabled the \u201cLocation History\u201d setting.<\/p>\n<p>General Brnovich sued Google in <a class=\"editor-rtfLink\" href=\"https:\/\/azag.us5.list-manage.com\/track\/click?u=cc1fad182b6d6f8b1e352e206&amp;id=9bf3ab9a16&amp;e=d9e61735a1\" target=\"_blank\" rel=\"noopener\">May 2020<\/a>. He became the first attorney general in America to sue Google in state court for deception through so-called \u201cdark patterns\u201d built into the tech giant\u2019s software, including apps and Android phones. Dark patterns are \u201ccoercive design tactics used to manipulate users\u2019 behavior,\u201d according to the Attorney General\u2019s office.<\/p>\n<p>In the lawsuit, General Brnovich alleged that Google engaged in \u201cdeceptive and unfair practices\u201d to its users by tracking their location data even after being told to stop.<\/p>\n<p>\u201cWhen users turned off their Location History in settings, Google continued to surreptitiously collect their location through other settings such as Web &#038; App Activity and the company used that information to sell ads,\u201d the Attorney General\u2019s office said in its press release. \u201cThe software is pre-programmed into Android phones purchased by consumers.\u201d<\/p>\n<p>In 2019, more than 80% of Google\u2019s revenues ($135 billion out of $161 billion) came from advertising.
