The guidance also allows election officials to \u201cspoil\u201d the old ballot on behalf of the voter, creating an environment ripe for voter fraud and confusion. <\/p>\n<p>Such a directive violated Wisconsin statute, which <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/6\/iv\/86\/5\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a>\u00a0that a voter possesses the exclusive authority to spoil his absentee ballot\u00a0<em>before\u00a0<\/em>it is submitted, not after.\u00a0<\/p>\n<p>RITE argued that the guidance was against the law and could create opportunities for fraud and confusion. Waukesha County Circuit Judge Brad Schimel agreed with RITE and ordered WEC to rescind its guidance on Wednesday. The Democratic National Committee had joined WEC in fighting the lawsuit. <\/p>\n<p>\u201cToday\u2019s ruling is another major victory for Wisconsin voters,\u201d RITE President and CEO Derek Lyons said in a <a href=\"https:\/\/acrobat.adobe.com\/link\/track?uri=urn:aaid:scds:US:3633758a-34fe-3947-bd42-98575f74aa7c\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a>. \u201cWEC\u2019s unlawful guidance destroys voter confidence and taints the integrity of Wisconsin\u2019s elections. Once a vote is cast, it is cast. Period.\u201d<\/p>\n<p>This isn\u2019t the first blow to WEC. Last month, a Wisconsin judge <a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-wisconsin-lawsuits-voting-absentee-22ce95ea6172fa6e9a085dd5ca5fdacf\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> WEC guidance allowing election clerks to fill in missing information on witness certification envelopes containing absentee ballots \u2014 a process otherwise known as ballot curing. During the 2020 election, Wisconsin processed nearly 2 million absentee ballots statewide.<\/p>\n<p>Ever since the chaos that marked the administration of the 2020 election, WEC has come under fire. In September, a Wisconsin judge\u00a0<a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-wisconsin-lawsuits-voting-absentee-22ce95ea6172fa6e9a085dd5ca5fdacf\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a>\u00a0WEC guidance allowing election clerks to fill in missing information on witness certification envelopes containing absentee ballots \u2014 a process otherwise known as ballot curing. That same month, the Wisconsin Institute for Law &#038; Liberty (WILL)\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/09\/19\/lawsuit-wisconsin-elections-commission-illegally-used-unauthorized-voter-registration-forms\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued the board for illegally using a voter registration form not authorized by state law<\/a>.<\/p>\n<p>In July, the Wisconsin Supreme Court ruled WEC\u2019s\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/07\/08\/wisconsin-supreme-court-drops-hammer-on-2020-election-shenanigans-ballot-drop-boxes-are-illegal-under-wisconsin-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">use of ballot drop boxes was illegal<\/a>. And last year, a state investigation\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/10\/29\/wisconsin-elections-commission-shattered-laws-by-telling-nursing-home-staffers-to-illegally-cast-ballots-for-residents\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a>\u00a0that WEC allegedly violated the law by telling nursing home staff to cast ballots for residents. During the 2020 election itself, WEC wrongfully kept third-party candidates off the ballot, like the Green Party\u2019s Howie Hawkins and Kanye West.\u00a0<\/p>\n<p>WEC\u2019s ostensible partisanship made Wisconsin radio host Dan O\u2019Donnell describe the commission as \u201cdownright <a href=\"https:\/\/www.maciverinstitute.com\/2021\/10\/the-lawless-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">derelict<\/a> in its duty\u00a0to fairly and impartially oversee an election.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Victoria Marshall is a staff writer at The Federalist.
