Under the EEOC guidance, employers may be sued for discrimination over policies related to dress codes, bathrooms, and pronouns. <\/p>\n<p>But in March, the case was amended to include new rules from the Department of Health and Human Services (HHS) covering how minors must be accommodated with wrongly named \u201cgender affirming care.\u201d The HHS <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/hhs-ocr-notice-and-guidance-gender-affirming-care.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">regulations<\/a> came in response to Texas Republican Gov. Greg Abbott\u2019s February <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-directs-dfps-to-investigate-gender-transitioning-procedures-as-child-abuse\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a>, which tasked protective services with investigating so-called sex-change procedures on minors as child abuse, and stipulated that opponents to such severe medical intervention could be subject to civil rights lawsuits.  <\/p>\n<p>The Biden administration argued the new regulations were justified by the Supreme Court\u2019s 2020 decision in <em><a href=\"https:\/\/thefederalist.com\/2020\/06\/18\/supreme-court-treat-men-and-women-as-interchangeable-or-get-sued-into-oblivion\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bostock v. Clayton County<\/a><\/em>, wherein the high court changed the meaning of \u201csex\u201d in civil rights protections to include sexual orientation and gender identity. Justice Neil Gorsuch wrote the majority 6-3 opinion, which declared that Title VII of the Civil Rights Act of 1964 made it illegal to fire an employee for being gay or transgender. Writing in dissent, Justice Samuel Alito warned the majority ruling in <em>Bostock <\/em>would creep into attempted government coercion of every possible avenue of accommodation. <\/p>\n<p>\u201cToday\u2019s decision may have effects that extend well beyond the domain of federal antidiscrimination statutes,\u201d Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/17-1618_hfci.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>, citing another case where a transgender prisoner was denied hormone medication \u201cand ability to dress and groom as a female.\u201d<\/p>\n<p>In striking down the Biden administration guidelines last week, Judge Matthew Kacsmaryk <a href=\"https:\/\/drive.google.com\/file\/d\/1JHWvflKyZYdQqyC1EyCRPExz9-FF6D-S\/view\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that the administration overstepped in its regulations when it drew upon the court\u2019s <em>Bostock<\/em> ruling. The Supreme Court, Kacsmaryk wrote, barred discrimination on the basis of sexuality and gender identity under Title VII \u201cbut not necessarily all correlated conduct,\u201d and cited Justice Alito\u2019s hypothetical \u201cparade of horrible\u201d coming to fruition.<\/p>\n<p>Kacsmaryk did not rule whether \u201ccorrelated conduct\u201d such as pronoun demands and bathroom rules is protected under Title VII but argued that the Supreme Court did <em>not<\/em> decide on the issue and left the door open. <\/p>\n<p>\u201cThe Guidances and Defendants misread <em>Bostock <\/em>by melding \u2018status\u2019 and \u2018conduct\u2019 into one catchall protected class covering all conduct correlating to \u2018sexual orientation\u2019 and \u2018gender identity,&#8217;\u201d the judge wrote. <\/p>\n<p>In other words, the Supreme Court ruled that Title VII barred the firing of employees for being gay or transgender, but the justices did not decide on how far protections extended under Title VII. <\/p>\n<p>Meanwhile, sex change procedures for minors are on the rise. The business of transgender surgery is expected to become a <a href=\"https:\/\/dailycaller.com\/2022\/10\/05\/sex-change-industry-report-transgender-surgery-profit-cost\/\" target=\"_blank\" rel=\"noreferrer noopener\">$5 billion-dollar<\/a> industry in the next 10 years, with major health care networks capitalizing on child sex changes. Gender-confused children who pursue irreversible medical treatments become permanent patients requiring lifelong treatment. <\/p>\n<p>Boston Children\u2019s Hospital has <a href=\"https:\/\/thefederalist.com\/2022\/08\/12\/boston-childrens-hospital-touts-hysterectomies-and-other-mutilation-for-trans-minors\/\" target=\"_blank\" rel=\"noreferrer noopener\">promoted <\/a>\u201cgender-affirming\u201d hysterectomies and sterilizations for minors while Vanderbilt University openly <a href=\"https:\/\/thefederalist.com\/2022\/09\/21\/the-real-victim-of-matt-walshs-trans-expose-isnt-vanderbilt-university-medical-center-its-all-the-kids-they-maimed\/\" target=\"_blank\" rel=\"noreferrer noopener\">describes<\/a> child patients as dollar signs. <\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"ZxD3o06uFgpfURWQs1G8tH\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Vanderbilt was apparently concerned that not all of its staff would be on board.
