Wade<\/em> with the <em>Dobbs<\/em> decision, James Mac Naughton, an attorney representing the temple, told\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.axios.com\/local\/boston\/2022\/10\/03\/satanic-temple-abortion-ban-lawsuits\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Axios<\/a><span data-preserver-spaces=\"true\">\u00a0that the historic reversal that returned abortion access to the states has \u201cwoken a sleeping giant among women politically and have stirred up a hornets\u2019 nest of legal issues.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cGorsuch, you want a national debate on abortion? Congratulations, you have one,\u201d Mac Naughton added.<\/p>\n<p><span data-preserver-spaces=\"true\">Fox News <a href=\"https:\/\/www.foxnews.com\/us\/satanic-temple-challenges-abortion-bans-idaho-indiana\" target=\"_blank\" rel=\"noopener\">reports<\/a> that satanic abortion rituals were introduced to argue for a religious exception under the 1993 federal law, the Religious Freedom Restoration Act, which prohibits states from infringing on anyone\u2019s religion without demonstrating a compelling interest.<\/p>\n<p><span data-preserver-spaces=\"true\">According to <a href=\"https:\/\/thehill.com\/homenews\/ap\/ap-u-s-news\/ap-the-satanic-temple-takes-aim-at-idaho-indiana-abortion-bans\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>, the ritual is a process where a person is reminded that their body is inviolate. After the abortion, the woman then recites a personal affirmation.<\/p>\n<p><span data-preserver-spaces=\"true\">According to the complaint, the Salem, Massachusetts-based group claims more than 1.5 million Satanic Temple members worldwide \u2014 including approximately 11,300 in Indiana and 3,500 in Idaho \u2014 which writes that it advocates on behalf of female members \u201cwho are involuntarily pregnant,\u201d <a href=\"https:\/\/www.wcvb.com\/article\/salem-massachusetts-based-the-satanic-temple-sues-indiana-idaho-over-abortion-bans\/41495030\" target=\"_blank\" rel=\"noopener\">WCVB<\/a> reports.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cAll of the Involuntarily Pregnant Women who are TST members believe the fetal tissue they carry in their uterus \u2014 from conception until viability \u2014 is part of their body and not imbued with any humanity or existence separate and apart from that of the Involuntarily Pregnant Woman herself,\u201d the temple wrote in both lawsuits.<\/p>\n<p><span data-preserver-spaces=\"true\">Using the 13th Amendment\u2019s prohibition of involuntary servitude, the equal protection clause of the 14th Amendment, and the takings clause in the 5th Amendment, which prohibits \u201cprivate property be taken for public use, without just compensation,\u201d the temple has sought an injunction against the states\u2019 abortion bans.<\/p>\n<p><span data-preserver-spaces=\"true\">Indiana passed a law banning abortion in most instances with exceptions in the case of fatal fetal anomalies, serious health risks to the mother, or cases of rape and incest following the U.S. Supreme Court overturning of <em>Roe v. Wade<\/em> with the <em>Dobbs<\/em> Decision.<\/p>\n<p><span data-preserver-spaces=\"true\">A spokesperson for the office of Indiana Attorney General Todd Rokita, who is listed as a defendant, said in a statement last week, according to the <a href=\"https:\/\/www.indystar.com\/story\/news\/local\/indianapolis\/2022\/09\/27\/satanic-temple-lawsuit-indiana-abortion-law-violates-religious-rights\/69521905007\/\" target=\"_blank\" rel=\"noopener\">Indy Star<\/a>, that the Supreme Court decided earlier this year that the U.S. Constitution does not protect abortion.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThis new lawsuit merely offers weaker arguments for the same discredited right,\u201d the spokesperson said.<\/p>\n<p><span data-preserver-spaces=\"true\">Indiana Governor Eric Holcomb is also listed as a defendant.<\/p>\n<p><span data-preserver-spaces=\"true\">Idaho recently passed a similar law banning abortion, which states that anyone who performs an abortion of a clinically diagnosable pregnancy is guilty of a felony unless the abortion is necessary to save the life of the pregnant woman or in the case of rape or incest.<\/p>\n<p><span data-preserver-spaces=\"true\">According to multiple media outlets, the Idaho Attorney General\u2019s office did not comment on the lawsuit.<\/p>\n<p><span data-preserver-spaces=\"true\">Scott Graf, a spokesman for the attorney general\u2019s office, told\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.ktvb.com\/article\/news\/local\/208\/satanic-temple-lawsuit-says-idaho-abortion-laws-violate-constitutional-rights\/277-5312ae3e-c70d-4bfc-8343-45462d745166\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">KTVB<\/a><span data-preserver-spaces=\"true\">\u00a0it has a policy against commenting on pending litigation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Satanic Temple filed lawsuits in federal court against Idaho and Indiana last month over near-total abortion bans in both states, citing a list of accusations surrounding religious rights blocking a woman\u2019s right to engage in the \u201cSatanic Abortion Ritual.\u201d In the wake of the U.S. Supreme Court overturning Roe v.
