Bush appointee.<\/p>\n<p>U.S. District Judge Aileen Cannon agreed to appoint a special master <a href=\"https:\/\/www.theepochtimes.com\/judge-grants-trump-motion-for-special-master-to-review-records-fbi-seized_4711262.html\">on Sept. 5<\/a>. At the same time, the Trump appointee prohibited the government from using records with classified markings that were seized from Mar-a-Lago as part of the criminal investigation into Trump.<\/p>\n<p>But <a href=\"https:\/\/www.documentcloud.org\/documents\/23118637-cannon-order-appointing-special-master\">the actual order<\/a> appointing U.S. District Judge Raymond Dearie as special master didn\u2019t come until Sept. 15. The Department of Justice appealed the first order, but not the second, Trump lawyers noted. And special master orders are not appealable under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/1292\">federal law<\/a>, they said.<\/p>\n<p>\u201cThat appointment order is simply not appealable on an interlocutory basis and was never before the Eleventh Circuit. Nonetheless, the Eleventh Circuit granted a stay of the Special Master Order, effectively compromising the integrity of the well-established policy against piecemeal appellate review and ignoring the District Court\u2019s broad discretion without justification,\u201d Trump\u2019s application to the nation\u2019s top court stated.<\/p>\n<p>\u201cThis unwarranted stay should be vacated as it impairs substantially the ongoing, time-sensitive work of the Special Master. Moreover, any limit on the comprehensive and transparent review of materials seized in the extraordinary raid of a President\u2019s home erodes public confidence in our system of justice,\u201d his lawyers added.<\/p>\n<p>In a footnote in <a href=\"https:\/\/www.theepochtimes.com\/appeals-court-allows-doj-to-regain-access-to-classified-documents-seized-from-mar-a-lago_4746924.html\">its Sept. 21 ruling<\/a>, the U.S. Court of Appeals for the 11th Circuit addressed Trump\u2019s claim, asserting Cannon\u2019s orders were \u201cinextricably intertwined.\u201d<\/p>\n<p>The appeals court panel wrote that \u201cthe district court \u2018enjoin[ed] the Government from reviewing and using the seized materials for investigative purposes pending completion of the special master\u2019s review or further Court order,\u2019 \u2018in natural conjunction with [the appointment of the special master].&#8217;\u201d<\/p>\n<p>\u201cAnd our pendent jurisdiction allows us to address an otherwise nonappealable order when it is inextricably intertwined with an appealable decision, or when review of an otherwise-nonappealable order \u2018is necessary to ensure meaningful review\u2019 of an appealable decision,\u201d it said.<\/p>\n<p>That ruling led to the special master and Trump <a href=\"https:\/\/www.theepochtimes.com\/judge-in-trump-records-case-blocks-special-master-from-viewing-materials-with-classified-markings_4748013.html\">being blocked<\/a> from viewing all records with classified markings that were seized from the former president\u2019s estate. About 100 documents fit that definition, according to an inventory released by the FBI.<\/p>\n<p>A request for a partial stay of Cannon\u2019s order had been denied by Cannon herself, prompting the government to seek relief from the appeals court.<\/p>\n<p>Thomas received the application because he is the justice assigned to the 11th Circuit. He can deny the application or pass it on for consideration to the full court.<\/p>\n<p>The application is not aimed at the other portion of the appeals court ruling, which enabled the government to resume using the records with classified markings in its criminal investigation of Trump.
