They think that because both of them are male and are biologically incapable of naturally procreating, they meet the medical definition of infertile and are thus entitled to insurance that will cover the costs of using a woman to have a baby. <\/p>\n<p>Both men went to law school, have well-paying jobs, and live together in a <a href=\"https:\/\/patch.com\/new-york\/williamsburg\/williamsburg-now-million-dollar-neighborhood-study-says\" target=\"_blank\" rel=\"noreferrer noopener\">wealthy part of Brooklyn<\/a>, but neither of them wanted to foot the $200,000 it will cost to buy a woman\u2019s egg, fertilize that egg into an embryo, and rent a woman\u2019s womb to carry the baby to term. That\u2019s when they inquired about using Briskin\u2019s insurance to cover the expensive procedures. <\/p>\n<p>Under NYC\u2019s insurance policy, infertility is defined as \u201can inability to have a child through heterosexual sex or intrauterine insemination.\u201d Considering the fact that procreation in gay relationships is physiologically impossible 100 percent of the time, male couples such as Briskin and Maggipinto who desire parenthood are disqualified from receiving taxpayer-funded fertility assistance. <\/p>\n<p>The couple claims this is discrimination and says they feel especially left out because lesbians and single women still qualify for some of the assisted reproductive technology procedures. <\/p>\n<p>\u201cThe policy is the product of a time when there was a misconception, a stereotype, a prejudice against couples that were made up of two men \u2014 that they were not capable of raising children because there was no female figure in that relationship,\u201d Briskin said. <\/p>\n<p>Except that\u2019s not \u201ca misconception,\u201d \u201ca stereotype,\u201d or \u201ca prejudice\u201d to say that children need mothers <em>and<\/em> fathers. <\/p>\n<p>Bragging about having a \u201cmotherless family,\u201d as Maggipinto does in the article, directly contradicts what\u00a0<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/000312240707200203\" target=\"_blank\" rel=\"noreferrer noopener\">plenty of studies<\/a> suggest about parenthood: Children who are born and raised by their married biological mother and father are more likely to lead healthier, safer, and better-educated lives well above the poverty line.<\/p>\n<p>On the contrary, adults who engage the commercial fertility industry to create children using donated gametes and a gestational carrier\u00a0automatically manufacture<a href=\"https:\/\/fluxconsole.com\/files\/item\/441\/56197\/My-Daddys-Name-is-Donor-Full-Study.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> a biological distance<\/a>\u00a0between themselves and the baby they commission. <\/p>\n<p>Additionally, these adults enable an industry that loans vulnerable and sometimes cash-strapped women out to people who have enough money to manufacture a child according to their preferences. The women are compensated for their time and efforts, but their bodies and minds often undergo significant, permanent, and <a href=\"https:\/\/thembeforeus.com\/dear-legislative-allies-this-is-how-surrogacy-harms-children\/\" target=\"_blank\" rel=\"noreferrer noopener\">anxiety-inducing changes<\/a> that cannot be remedied with cash. Similarly, the babies that are ripped away from the women who nurtured them for nine months can suffer from increased stress and even\u00a0<a href=\"https:\/\/www.sciencedaily.com\/releases\/2018\/05\/180503142724.htm\" target=\"_blank\" rel=\"noreferrer noopener\">brain structure alterations<\/a>\u00a0due to the abrupt separation.<\/p>\n<p>The Guardian notes that if Briskin and Maggipinto win the lawsuit, \u201cemployers and health insurers across the US will be under pressure to change their policies to give gay men the same access to fertility benefits as anyone else.\u201d<\/p>\n<p>It\u2019s complaints like this one from Briskin and Maggipinto that fuel an industry that is comfortable erasing a woman\u2019s role in the marvelous act of procreation and putting children at an automatic disadvantage in life.<\/p>\n<p>Already, gay couples claiming discrimination are winning legal battles to commission the creation of children using other peoples\u2019 biological matter. Earlier this year, the United Kingdom\u2019s National Health Service began offering <a href=\"https:\/\/www.gov.uk\/government\/publications\/womens-health-strategy-for-england\/womens-health-strategy-for-england\" target=\"_blank\" rel=\"noreferrer noopener\">no-questions-asked, taxpayer-funded assisted reproductive technology<\/a> to lesbians and single wannabe mothers after a lesbian couple <a href=\"https:\/\/www.leighday.co.uk\/latest-updates\/news\/2021-news\/same-sex-couple-issues-judicial-review-against-discriminatory-ivf-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> the NHS for discrimination. <\/p>\n<p>Prior to the overhaul, women who wanted to create a baby using a sperm donor were required to try intrauterine insemination on their own dime six times before the government would consider them in need of taxpayer-funded assistance. Now, lesbian couples will no longer have to prove their fertility status before they can commission the creation of a fatherless child. <\/p>\n<p>Why is this problematic? Well, in addition to contributing to all of the moral and ethical concerns linked to <a href=\"https:\/\/thefederalist.com\/2022\/08\/05\/when-sperm-and-eggs-are-monetized-human-existence-becomes-transactional\/\" target=\"_blank\" rel=\"noreferrer noopener\">sperm and egg supply<\/a>, <a href=\"https:\/\/thefederalist.com\/2022\/07\/25\/as-reproductive-technology-advances-remember-just-because-we-can-doesnt-mean-we-should\/\" target=\"_blank\" rel=\"noreferrer noopener\">serial embryo creation via IVF<\/a>, and <a href=\"https:\/\/thefederalist.com\/2022\/03\/26\/big-fertility-harms-babies-and-women-so-why-are-we-celebrating-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">surrogacy<\/a>, the popularization and enabling of <a href=\"https:\/\/www.winfertility.com\/blog\/the-labels-of-infertility\/#:~:text=Changing%20the%20Definition&amp;text=Their%20view%20is%20that%20people,of%20a%20same%2Dsex%20partnership.\" target=\"_blank\" rel=\"noreferrer noopener\">\u201csocial infertility\u201d<\/a> is only contributing to the expansion of Big Fertility.
