WILL points to several instances of the <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/08\/24\/fact-sheet-president-biden-announces-student-loan-relief-for-borrowers-who-need-it-most\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden White House<\/a> implying that the administration created the program \u201cwith the express purpose of advancing \u2018racial equity.&#8217;\u201d<\/p>\n<p>\u201cExplaining that the purpose of the program is to \u2018narrow the racial wealth gap,\u2019 the White House explained that the program is intended to help \u2018black students,\u2019 \u2018black borrowers,\u2019 and \u2018other borrowers of color,&#8217;\u201d the lawsuit reads. \u201cAs such, Defendants have articulated an improper racial motive in creating and implementing the One-Time Student Loan Debt Relief Plan.\u201d<\/p>\n<p>In the suit, WILL also contends that Biden\u2019s loan bailout scheme violates the Administrative Procedures Act \u201cby exceeding statutory authority because the cancellation plan is not authorized under the HEROES Act,\u201d which the administration has cited as legal justification for the policy.<\/p>\n<p>Under the <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:20%20section:1098bb%20edition:prelim)\" target=\"_blank\" rel=\"noreferrer noopener\">HEROES Act<\/a>, the executive is granted the power to waive loans when \u201cnecessary in connection with a war or other military operation or national emergency.\u201d<\/p>\n<p>While intended for U.S. military service members in the wake of the Sept. 11, 2001, terrorist attacks, the Education Department has <a href=\"https:\/\/www2.ed.gov\/policy\/gen\/leg\/foia\/secretarys-legal-authority-for-debt-cancellation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">attempted to rationalize<\/a> that the \u201cCOVID-19 pandemic\u201d fulfills the HEROES Act\u2019s definition of a national emergency, despite Biden himself <a href=\"https:\/\/townhall.com\/tipsheet\/leahbarkoukis\/2022\/09\/19\/biden-the-pandemic-is-over-n2613268\" target=\"_blank\" rel=\"noreferrer noopener\">declaring<\/a> the pandemic to be \u201cover\u201d during a recent \u201c60 Minutes\u201d interview.<\/p>\n<p>In the meantime, WILL has requested a preliminary injunction to bar the cancellation of any federal student loan before a decision is reached, as well as a restraining order until such an injunction is granted.<\/p>\n<p>In addition to WILL, a <a href=\"https:\/\/nypost.com\/2022\/09\/29\/6-republican-states-sue-biden-white-house-over-student-loan-bailout\/\" target=\"_blank\" rel=\"noreferrer noopener\">coalition of six states<\/a> has also filed a lawsuit against the Biden administration over the proposed program, saying the president is overstepping his legal authority and citing his comments on \u201c60 Minutes\u201d as proof that the pandemic is over.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
