Gavin Newsom on Friday signed a bill that subjects the state\u2019s doctors to discipline, including the suspension of their medical licenses, for sharing \u201cmisinformation\u201d or \u201cdisinformation\u201d about COVID-19 with their patients.<\/em><\/p>\n<p><em><a href=\"https:\/\/childrenshealthdefense.org\/defender\/newsom-signs-california-ab2098-doctors-disciplined-covid-misinformation\/\">This article was originally published by The Defender<\/a> \u2013 Children\u2019s Health Defense\u2019s News &#038; Views Website<\/em><\/p>\n<p>California Gov. Gavin Newsom on Friday signed a bill that subjects the state\u2019s doctors to discipline, including the\u00a0<a href=\"https:\/\/apnews.com\/article\/health-business-california-covid-gavin-newsom-95397f4783a19b6fb35d2c46ac6f872e\">suspension of their medical licenses<\/a>, for sharing \u201cmisinformation\u201d or \u201cdisinformation\u201d about COVID-19 with their patients.<\/p>\n<p><a href=\"https:\/\/legiscan.com\/CA\/text\/AB2098\/id\/2604233\">California Assembly Bill 2098<\/a>\u00a0(AB 2098) defines \u201cmisinformation\u201d as \u201cfalse information that is contradicted by contemporary scientific consensus contrary to the standard of care\u201d and \u201cdisinformation\u201d as \u201cmisinformation that the licensee deliberately disseminated with malicious intent or an intent to mislead.\u201d<\/p>\n<p>Newsom said the law applies only to physicians\u2019 speech with patients during discussions directly related to\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a>\u00a0treatment.<\/p>\n<p>Language in the bill points out that the\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/federation-of-state-medical-boards-covid-misinformation\/\">Federation of State Medical Boards<\/a>\u00a0(FSMB) has warned that physicians who spread misinformation or disinformation \u201crisk losing their medical license, and \u2026 have a duty to provide their patients with accurate, science-based information.\u201d<\/p>\n<p>The FSMB, as previously reported by The Defender,\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/federation-of-state-medical-boards-covid-misinformation\/\">takes money from Big Pharma<\/a>\u00a0and has a history of challenging and attacking non-pharmaceutical medical approaches used by integrative doctors as falling outside the \u201cstandard of care\u201d as they define it.<\/p>\n<p>Commenting on Newsom\u2019s decision to sign the controversial AB 2098, Robert F. Kennedy, Jr.,\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/\">Children\u2019s Health Defense<\/a>\u00a0(CHD) chairman and chief legal counsel, said the law \u201cfundamentally changes the sacred relationship between physician and patient that has existed since Hippocrates.\u201d<\/p>\n<p>Kennedy added:<\/p>\n<p>\u201cUnder the new rubric, the doctor no longer serves the best interest of the patient but acts as an agent of state policy.<\/p>\n<p>\u201cHistory is replete with nightmarish examples of what happens when doctors stop healing and act instead to advance \u2018the greater good.\u2019 Governments have variously cited that phrase to justify euthanasia of the elderly, mental defectives, homosexuals and other \u2018useless eaters\u2019 and to enforce \u2018one-child\u2019 policies.<\/p>\n<p>\u201cWhen governments start practicing medicine, the story never ends well.\u201d<\/p>\n<p>AB 2098 was introduced in mid-February by California Assemblymember Evan Low \u2014 one of seven Democratic lawmakers who in January\u00a0<a href=\"https:\/\/sd06.senate.ca.gov\/news\/2022-01-19-legislators-form-vaccine-work-group-boost-public-health-policies\">formed the Vaccine Work Group<\/a>\u00a0to develop legislation promoting the use of COVID-19 vaccines while \u201cbattling misinformation.\u201d<\/p>\n<p>The bill passed the California Assembly in May, and the California Senate in late August.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.ama-assn.org\/\">American Medical Association<\/a>\u00a0(AMA), which strongly supports the bill, hopes other states will follow suit in \u201censuring that licensing boards have the authority to take disciplinary action against health professionals for spreading health-related disinformation,\u201d according to a\u00a0<a href=\"https:\/\/www.ama-assn.org\/press-center\/press-releases\/ama-adopts-new-policy-aimed-addressing-public-health-disinformation\">new policy adopted<\/a>\u00a0at its mid-June annual meeting aimed at addressing public health \u201cdisinformation.\u201d<\/p>\n<p>The AMA\u2019s adopted policy expanded on prior efforts and called for the organization to work with \u201chealth professional societies and other relevant organizations to implement a comprehensive strategy to address health-related disinformation disseminated by health professionals.\u201d<\/p>\n<h2>\u2018Tool for Enforcing Propaganda and Censorship Policies\u2019 Approved by State<\/h2>\n<p><a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a>\u00a0reached out to numerous physicians who support informed consent and medical freedom.<\/p>\n<p>Here\u2019s what they told us.<\/p>\n<h3><strong><a href=\"https:\/\/childrenshealthdefense.org\/defender\/michelle-perro-take-stance-covid-vaccines-kids\/\">Dr. Michelle Perro<\/a>, California-based pediatrician, said:<\/strong><\/h3>\n<p>\u201cThe Golden State has declared its intent with the passage and signing of AB 2098 to effectively muzzle physicians in regards to \u2018COVID-speak.\u2019<\/p>\n<p>\u201cPhysicians were reticent prior to the passage of this draconian bill to speak on behalf of their patients. With looming threats of loss of livelihood, it is unlikely that any physician will speak out at this juncture. For those physicians still willing to throw down the gauntlet, a mass exodus from California will likely ensue \u2026<\/p>\n<p>\u201cBut the largest concern is regarding our children. Parents will not be able to depend on medical professionals and need to protect their own children against ill-advised experimental therapies. This bill will not only remove healthy discourse but will further divide our communities.\u201d<\/p>\n<h3><strong>Dr. Sanjay Verma, California-based cardiologist, said:<\/strong><\/h3>\n<p>\u201cEven in the best of times, \u2018standard of care\u2019 emerges after years of reproducible research. Even when multiple trials support the generation of new practice guidelines, often years pass before the new practice guidelines are adopted and implemented in community centers.<\/p>\n<p>\u201cIn a rapidly evolving pandemic resulting from a new virus \u2026 there is all the more reason to insist on the passage of time before codifying prevailing norms into enforceable policies. \u2026<\/p>\n<p>\u201cThroughout the pandemic, contrarian scientific voices have been subjected to censure and censorship. However, often these very perspectives were later proven to be irrefutably true \u2026.<\/p>\n<p>\u201cInformed consent requires the discussion of risks, benefits and alternatives to any medical intervention. CA AB 2098 enables medical board disciplinary action for perspectives that challenges the accuracy and thoroughness of CDC [Centers for Disease Control and Prevention] and FDA [U.S. Food and Drug Administraton] safety monitoring. That itself will cause patient harm.<\/p>\n<p>\u201cScience demands open and transparent debate. Throughout the history of modern medicine there are numerous examples in which the contrarian view led to advances in knowledge and in reassessing product post-market safety.<\/p>\n<p>\u201cCA AB 2098 is the wrong approach to improving trust in public health and maximizing adoption of rational, risk-stratified, evidence-based mitigation efforts during a pandemic that indubitably caused tremendous morbidity and mortality.\u201d<\/p>\n<h3><strong>Dr. Liz Mumper, Virginia-based pediatrician and medical advisor to CHD, said:<\/strong><\/h3>\n<p>\u201cI am despondent that AB 2098 is now law. \u2018Misinformation\u2019 is not defined. Scientific truth evolves over time \u2014 what is labeled as today\u2019s misinformation may be tomorrow\u2019s ingenious breakthrough.<\/p>\n<p>\u201cI worry that excellent physicians who discuss early treatments for COVID or weigh risks versus benefits of the jabs will flee the state.\u201d<\/p>\n<h3><strong><a href=\"https:\/\/childrenshealthdefense.org\/defender\/joe-rogan-robert-malone-interview-covid-vaccine\/\">Dr. Robert Malone<\/a>, Virginia-based physician, biochemist and infectious disease researcher, said:<\/strong><\/h3>\n<p>\u201cThis bill will primarily act as a strong incentive for all independent-thinking physicians and other medical care providers to migrate their practices to other states.<\/p>\n<p>\u201cIt creates yet another social engineering policy that will be weaponized by any person with an axe to grind against any physician or medical provider in the state by filing accusations, which will then have to be investigated and litigated, functionally creating a medical Stasi.<\/p>\n<p>\u201cThis is clearly a tool for enforcing propaganda and censorship policies approved by the state of California.\u201d<\/p>\n<h3><strong><a href=\"https:\/\/childrenshealthdefense.org\/defender\/rfk-jr-podcast-dr-peter-mccullough-vaccines-are-failing\/\">Dr. Peter McCullough<\/a>, Texas-based internist and cardiologist, said:<\/strong><\/h3>\n<p>\u201cAs a medical expert treating patients with COVID-19 and vaccine injury syndromes, I anticipate AB 2098 will cause physicians to retract from treating such patients.<\/p>\n<p>\u201cAB 2098 makes it impossible for healthcare providers to have honest and fully informed conversations about the rapidly evolving pandemic and the health problems it has brought to Californians.<\/p>\n<p>\u201cThis new law hurts the most vulnerable at a time when they need their physicians to be honest and forthright.<\/p>\n<p>\u201cCalifornia is on a slippery slope of medical totalitarianism.\u201d<\/p>\n<h3><strong><a href=\"https:\/\/childrenshealthdefense.org\/authors\/madhava-setty-m-d\/\">Dr. Madhava Setty<\/a>, Massachusetts-based anesthesiologist and senior science editor of The Defender, said:<\/strong><\/h3>\n<p>\u201cI am not surprised by the passage of AB 2098. Our authorities have been hinting at making this kind of move for two years, from the time sufficient evidence of the effectiveness of early treatment was dismissed and suppressed in 2020.<\/p>\n<p>\u201cThe Newsom administration fails to see that the passage of this bill into law will deliver a potentially fatal blow to our public health agencies\u2019 already plummeting credibility.<\/p>\n<p>\u201cWhy would anyone believe statements from the CDC if they cannot be openly challenged? Why should we trust the regulatory decisions of the FDA if they cannot be questioned?<\/p>\n<p>\u201cIt\u2019s obvious that this bill was proposed and codified into law because the number of physicians in California that are spreading \u2018misinformation\u2019 is rapidly growing.<\/p>\n<p>\u201cThis is a desperate attempt to squelch scientific debate, and it will eventually backfire. It\u2019s only a matter of time before California physicians will see this as an unjust attack on their colleagues and the medical profession as a whole.\u201d<\/p>\n<h3><strong><a href=\"https:\/\/childrenshealthdefense.org\/defender\/meryl-nass-tessa-lena-under-attack\/\">Dr. Meryl Nass<\/a>, Maine-based internist and biological warfare epidemiologist and member of the Children\u2019s Health Defense scientific advisory committee, said:<\/strong><\/h3>\n<p>\u201cClearly it is of the utmost importance to the newest world order that all challenges to the public health COVID narrative be destroyed.<\/p>\n<p>\u201cDoctors, who have authority to speak about such things, must be made to speak in one voice. But the practice of medicine is regulated at the state level, not at the federal level. So doctors must be controlled by the states.<\/p>\n<p>\u201cFor patients who want the right to obtain honest information from their physicians and want to have choices regarding their medical treatment, now is the time to speak up. The screws are tightening.
