Google LLC would be heard asking whether tech companies make \u201ctarget recommendations.\u201d<\/p>\n<p>Axios\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.axios.com\/2022\/10\/03\/supreme-court-case-tech-section-230?utm_campaign=editorial&amp;utm_source=twitter&amp;utm_medium=social\" target=\"_blank\" rel=\"noopener\">reports<\/a>\u00a0the case alleges YouTube aided and abetted in the death of Nohemi Gonzalez, a 23-year-old American woman who was killed in the 2015 ISIS attacks in Paris along with 130 others and injured more than a hundred.<\/p>\n<p>The family of Gonzalez sued Google, the parent company of YouTube, arguing that the platform\u2019s algorithms allowed and recommended terrorist-related content from ISIS to target users with \u201chundreds of radicalizing videos inciting violence and recruiting potential supporters.\u201d<\/p>\n<p>Google argued the claims were barred under Section 230 and has since moved to dismiss the lawsuit, Axios reports.<\/p>\n<p>The Hill\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/thehill.com\/regulation\/court-battles\/3671946-supreme-court-to-hear-challenge-to-big-techs-section-230-liability-protections\/\" target=\"_blank\" rel=\"noopener\">reports<\/a>\u00a0a judge dismissed the case prompting the family to appeal to the nation\u2019s highest court.<\/p>\n<p>Gonzales\u2019 case taps into another controversial topic within the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/230\" target=\"_blank\" rel=\"noopener\">Communications Decency Act<\/a>, which has a provision tucked inside the law \u2014 otherwise known as Section 230 \u2014 that says, \u201cno provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.\u201d<\/p>\n<p>The law has seen criticism from Democrats and Republicans, who argue it grants too much power to social media companies and says it favors one party over the other concerning censoring or bolstering content.<\/p>\n<p>Former Libertarian U.S. Congressman Justin Amash\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/twitter.com\/justinamash\/status\/1577004248910290944?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\" target=\"_blank\" rel=\"noopener\">tweeted<\/a>, \u201cregime Republican and Democrats want to destroy Section 230 because it protects freedom of speech.\u201d<\/p>\n<p>\u201cDismantling Section 230 will lead to more censorship of speech that challenges their authority\u2014giving those in power more influence and control over public discourse,\u201d Amash said.<\/p>\n<p>Tennesse Republican Sen Marsha Blackburn said in a\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/twitter.com\/MarshaBlackburn\/status\/1577037525679411201\" target=\"_blank\" rel=\"noopener\">tweet<\/a>\u00a0she looks forward to hearing what the court has to say on the issue.<\/p>\n<p>\u201cFor too long, Big Tech has used Section 230 as a shield to avoid accountability for its decisions, including the hosting of [Child Sexual Abuse Material], violent content, and the removal of conservative content,\u201d Blackburn said.<\/p>\n<p>NetChoice, a trade group for tech corporations, advocated for the industry to<a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-takes-internet-company-immunity-youtube-dispute-rcna48517\"> NBC News<\/a>, saying that tech groups need the flexibility to keep or remove content.<\/p>\n<p>\u201cWithout moderation, the internet will become a content cesspool, filled with vile content of all sorts, and making it easier for things like terrorist recruitment,\u201d said NetChoice counsel Chris Marchese.<\/p>\n<p>The Washington Examiner\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/supreme-court-big-tech-protections-section-230-\" target=\"_blank\" rel=\"noopener\">reports<\/a>\u00a0that others said changing the provision could produce larger impacts on smaller organizations.<\/p>\n<p>\u201cSection 230 is the foundation that today\u2019s internet is built on, supporting both speech online and the ability of internet platforms to take down harmful content,\u201d Adam Kovacevich, CEO of Chamber of Progress, said according to The Washington Examiner. \u201cEroding that wouldn\u2019t just impact large platforms \u2014 it would hammer smaller websites, from community newspapers to niche blogs.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Supreme Court agreed Monday to take up a case that challenges legal protection for big tech companies over user-generated content that could potentially usher in a new era of moderating freedom of expression on the Internet.
