United States case, the nine justices declined to hear a writ of certiorari (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-1364\/221267\/20220418134323040_Petition%20for%20Writ%20of%20Certiorari.pdf\">pdf<\/a>) that questioned the legality of the filter team protocols. The rules allow agents and prosecutors who aren\u2019t assigned to a case to examine seized materials that are claimed to be privileged before a judge issues a ruling.<\/p>\n<p>Like the vast majority of cases the Supreme Court declines to hear, the justices on Monday did not provide an explanation why it rejected the Korf petition.<\/p>\n<p>The case pertained to a <a href=\"https:\/\/nypost.com\/2021\/03\/06\/businessmen-accused-of-ukraine-money-laundering-gave-millions-to-ny-charities\/\">DOJ money laundering probe<\/a> that claimed that the use of a filter team was a violation of the Constitution\u2019s 6th Amendment right to counsel.<\/p>\n<p>\u201cOnly after the filter team has reviewed the documents would a court rule on whether privilege applies. That procedure needlessly and harmfully exposes assertedly privileged communications to the government\u2019s eyes,\u201d lawyers for Mordechai Korf, who the DOJ <a href=\"https:\/\/www.justice.gov\/opa\/pr\/united-states-files-civil-forfeiture-complaint-proceeds-alleged-fraud-and-theft-privatbank\">targeted<\/a> with a civil forfeiture complaint in January, said in their filing.<\/p>\n<p>\u201cIt undermines essential protections for the adversary system,\u201d the lawyers continued. \u201cAnd it jeopardizes the confidentiality needed for the applicable privileges to serve their vital purposes.\u201d<\/p>\n<p> Trump Case <\/p>\n<p>If the Supreme Court ruled on the case, it may have\u00a0provided clarity for the DOJ and Trump\u2019s legal team following the raid.<\/p>\n<p>In September, a district judge sided with Trump\u2019s team in appointing a special master to review documents that were taken during the raid on Aug. 8 that the former president said was unprecedented and politically motivated.<\/p>\n<p>Lawyers for the\u00a0DOJ confirmed the agency used a filter team to start its review of the documents that<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Monday declined to hear whether the Department of Justice (DOJ) can use its so-called \u201cfilter teams,\u201d including the one that is being used to review documents seized at former President Donald Trump\u2019s Mar-a-Lago.
