However, as a result, a complaint with the Federal Elections Commission has now been filed.<\/p>\n<p>In a campaign ad for Republican Senate Challenger Tiffany Smiley called \u201c<a href=\"https:\/\/www.youtube.com\/watch?v=B6kGg6py6xc\">Cup of Coffee<\/a>\u201d, Smiley is standing in front of one of\u00a0<a href=\"https:\/\/thepostmillennial.com\/starbucks-closing-16-stores-in-democrat-cities-over-safety-concerns\/\">5 Seattle Starbucks locations shuttered by the coffee giant<\/a> in response to crime and safety concerns. The remnants of the closed store\u2019s Starbucks sign are barely visible at the top of the structure and viewed backward.<\/p>\n<p>As Smiley links Murray and Democrat policies to rising crime, two Seattle Times headlines appear onscreen, one of which reads: \u201cStarbucks to Close 5 Seattle Stores Over Safety Concerns.\u201d<\/p>\n<blockquote class=\"twitter-tweet\"><\/blockquote>\n<p>After the ad aired, The Seattle Times erroneously addressed a September 21 <a href=\"https:\/\/drive.google.com\/file\/d\/19zJ9KOTIMh8gbJ7JtNytFEuYXDVY-0gE\/view\">&#8220;Cease and Desist&#8221; letter<\/a> to the \u201cJane Smiley\u201d campaign, obviously not using a &#8220;fact checker,&#8221; and demanded the removal of logos and story headlines used in the \u201cCup of Coffee\u201d ad, claiming violations of copyright law for unauthorized use of its logo and content.<\/p>\n<p>In response, the Smiley for Washington campaign filed a <a href=\"https:\/\/drive.google.com\/file\/d\/1KhcNlKpTXH4l4Td-EHmoETAlxfwJrcP8\/view\">complaint with the Federal Elections Commission<\/a> against the outlet for illegally using its corporate resources to support the re-election campaign of incumbent Democrat Senator Patty Murray. The Smiley for Washington campaign pointed out that the outlet had previously allowed Patty Murray, whom they have endorsed, to use their logo and content without a license during her 2016 re-election campaign.<\/p>\n<blockquote class=\"twitter-tweet\"><\/blockquote>\n<p>The Smiley campaign claimed that the outlet provided the Murray campaign with <a href=\"https:\/\/drive.google.com\/file\/d\/1tAjfWrOgPqxcoztYOrm7qgkq-bvv_y6A\/view\">a prohibited in-kind contribution<\/a>. According to the complaint, the Smiley for Washington campaign would have to spend an estimated $5,000 to remove and update the ad\u2014\u201ccosts that Patty Murray does not have to accrue.\u201d<\/p>\n<p>The complaint cited FEC regulations stating, \u201cif a corporation makes its resources available for free, it must do so for\u00a0all\u00a0candidates.\u201d<\/p>\n<p>According to a press release from the Smiley campaign, \u201cSince corporate resources were used for arbitrary enforcement of its copyright claims, The Seattle Times clearly violated federal election law by providing a prohibited corporate in-kind contribution to Patty Murray\u2019s campaign.\u201d<\/p>\n<p>The statement noted \u201cfair use is intended to protect and promote freedom of expression, which \u2026 allows The Seattle Times to publish extreme leftist commentary and pretend that it is news\u201d and while their \u201cpolitical affiliation may not align with Tiffany Smiley\u2019s,\u201d the legal claims made have \u201cno merit.&#8221;<\/p>\n<p>Starbucks also sent a certified <a href=\"https:\/\/drive.google.com\/file\/d\/1fo0xOXvfZnqEPSUD0ZHFZDz8oO-T2ZbG\/view\">letter<\/a>\u00a0to the campaign claiming that Smiley appropriated its intellectual property and complaining the ad might \u201ccreate an unfounded association in the minds of consumers between Starbucks and your campaign.\u201d<\/p>\n<p>The coffee giant demanded the campaign pull the ad or change it to remove the barely visible and backward sign and the Seattle Times headline referencing Starbucks.<\/p>\n<p>The campaign refuted Starbucks&#8217; infringement claims in a <a href=\"https:\/\/drive.google.com\/file\/d\/13QHba3_PeNGySZ1OlxZd3hFv5kc8cqxg\/view\">legal letter<\/a> sent Thursday, noting political speech protections and that no reasonable person would ever think a factual ad about shuttered<br \/>Starbucks stores amounted to a coffee-chain endorsement. The letter also suggested the coffee giant spend its vast resources focusing on its own problems, such as recent problems with unions.<\/p>\n<blockquote class=\"twitter-tweet\"><\/blockquote>\n<p>Murray, the media, and corporate supporters are likely getting more desperate as a recent\u00a0Trafalgar Group poll\u00a0showed Smiley just two points behind Murray.
