Gregory Steube (R-Fla.) and other U.S. lawmakers are asserting that the <a href=\"https:\/\/www.theepochtimes.com\/t-food-and-drug-administration\">Food and Drug Administration<\/a>\u2019s (FDA) refusal to provide records to The Epoch Times is illegal.<\/p>\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/5\/552\">Freedom of Information Act<\/a> (FOIA) states that, with exceptions, agencies that receive satisfactory records requests \u201cshall make the records promptly available\u201d to the requester. But the FDA <a href=\"https:\/\/www.theepochtimes.com\/exclusive-fda-refuses-to-provide-key-covid-19-vaccine-safety-analyses_4722586.html\">recently refused<\/a> to provide results of COVID-19 vaccine safety monitoring analysis to The Epoch Times, claiming that it could not separate the results from inter-agency and intra-agency communications, which are allowed to be withheld.<\/p>\n<p>Steube and colleagues told FDA Commissioner Dr. Robert Califf, a Biden appointee, that they were concerned after reading the story about the refusal to provide the records, telling Califf that his agency \u201cis obligated to disclose\u201d the materials under FOIA.<\/p>\n<p>The requested analysis was performed on reports to the Vaccine Adverse Event Reporting System (VAERS). Anybody can submit reports to VAERS, but most reports are submitted by health care workers, who are required to report adverse events following COVID-19 vaccination.<\/p>\n<p>\u201cIt is unacceptable that the FDA would withhold such important material from the public eye. Americans depend on the information provided in VAERS to be able to make conscious decisions about their health and well-being,\u201d the lawmakers told Califf in <a href=\"https:\/\/www.documentcloud.org\/documents\/23116450-members-of-congress-write-to-califf\">a letter<\/a> dated Sept. 23. \u201cIt is critical that the FDA be transparent and release important sets of data to the public.\u201d<\/p>\n<p>They described the FDA as being \u201cnoncompliant\u201d in releasing COVID-19 vaccine safety data, referring to how the FDA denied a request to quickly produce\u00a0all the\u00a0data and information for Pfizer\u2019s vaccine. The agency later <a href=\"https:\/\/www.theepochtimes.com\/fda-says-it-now-needs-75-years-to-fully-release-pfizer-covid-19-vaccine-data_4145410.html\">said\u00a0it would take 75 years<\/a> to produce the information, but a judge <a href=\"https:\/\/www.theepochtimes.com\/judge-gives-fda-just-over-8-months-to-produce-pfizers-safety-data_4198409.html\">ordered the agency<\/a> to take no longer than eight months.<\/p>\n<p>The FDA did not respond to a request for comment on the letter.
