But the judge did not agree.<\/p>\n<p>\u201cThere is no bright-line rule that the combination of two unprotectable elements is insufficiently numerous to constitute an original work,\u201d Judge Louis Stanton said when making that determination. \u201cA work may be copyrightable even though it is entirely a compilation of unprotectable elements.\u201d<\/p>\n<p>Therefore, Sheeran and his legal team will need to argue their case before a jury. Structured Asset Sales (SAS) owns a partial stake in Gaye\u2019s song and is <a href=\"https:\/\/www.bbc.com\/news\/entertainment-arts-63087419\">seeking<\/a> $100 million in damages for the alleged copyright infringement.<\/p>\n<p>This isn\u2019t the first time the British singer-songwriter faced legal battles over his music. The publication noted that Sheeran recently won a similar lawsuit in the U.K. after artist Sami Chokri claimed the singer stole the 2017 hit \u201cShape of You\u201d from his previous work.\u00a0<\/p>\n<p>Sheeran later told fans \u201clawsuits are not a pleasant experience\u201d and that he was hoping to steer clear of \u201cbaseless claims\u201d going forward.<\/p>\n<p>\u201cThinking Out Loud\u201d received Grammy wins for Song of the Year and Best Pop Solo Performance at the 2016 Grammy Awards and was also nominated for Record of the Year, though Sheeran ultimately lost to Mark Ronson and Bruno Mars for \u201cUptown Funk.\u201d<\/p>\n<p>No date has been set for the trial.\u00a0<\/p>\n<p>Sheeran previously <a href=\"https:\/\/www.nme.com\/news\/music\/ed-sheeran-17-1206163\">told<\/a> The Mirror that he wrote \u201cThinking Out Loud\u201d in collaboration with his friend and fellow singer, Amy Wadge. The musician explained how his album \u201cx\u201d was almost done and the single was a last-minute addition.<\/p>\n<p>\u201c[Wadge] was going through financial troubles about a year ago,\u201d Sheeran told the publication. \u201cShe drove to my house \u2013 my album was nearly done \u2013 and she asked if I could put a song from when I was 17 on the deluxe album, so she could get a little bit of money and pay the mortgage and bills and stuff.\u201d<\/p>\n<p>\u201cWhile she was there, we wrote \u2018Thinking Out Loud\u2019,\u201d he continued. \u201cNow she never has to worry about money again.\u201d<\/p>\n<p>A Spin reviewer <a href=\"https:\/\/www.spin.com\/2015\/03\/marvin-gaye-robin-thicke-blurred-lines-lawsuit-ed-sheeran-thinking-out-loud\/\">noted<\/a> in 2015 how much the song resembled \u201cLet\u2019s Get It On.\u201d\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Singer Ed Sheeran will stand trial for alleged copyright violation of the classic Marvin Gaye single, \u201cLet\u2019s Get It On,\u201d a federal judge has ruled.
