Wade<\/a> <\/i>this summer, made his highly rare rebuke to Kagan in a <a class=\"Link\" href=\"https:\/\/www.wsj.com\/articles\/kagan-v-roberts-justices-spar-over-supreme-courts-legitimacy-11664394642\" target=\"_blank\" rel=\"noopener\">statement<\/a> to the <i>Wall Street Journal, <\/i>albeit without directly naming her. <\/p>\n<p>&#8220;It goes without saying that everyone is free to express disagreement\u00a0with our decisions and to criticize our reasoning as they see fit. But saying or implying that the court is becoming an illegitimate institution or questioning our integrity\u00a0crosses an important line,&#8221; Alito told the outlet.<\/p>\n<p><b><u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/breyer-hated-dobbs-decision-tried-to-persuade-people\" target=\"_blank\" rel=\"noopener\">BREYER SAYS HE HATED DOBBS DECISION, DID &#8216;EVERYTHING I COULD TO PERSUADE PEOPLE&#8217;<\/a><\/u><\/b><\/p>\n<p>Several high court justices have spoken about the court&#8217;s public perception this year since the landmark ruling in <i><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/dobbs-v-jackson-womens-health-organization\" target=\"_blank\" rel=\"noopener\">Dobbs v. Jackson Women&#8217;s Health Organization<\/a><\/i>, which saw the conservative majority of justices vote to allow states to form laws severely restricting access to abortion procedures. The decision prompted protests, threats, and <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/scotus-favorability-hits-new-low-following-summer-abortion-ruling\">polls<\/a> showing more than half of the nation holding an unfavorable view of the Supreme Court.<\/p>\n<p>During a recent public speaking event in New York earlier this month, Kagan <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/jkagan-court-shouldnt-be-doing-things-that-are-popular\" target=\"_blank\" rel=\"noopener\">said<\/a> she believes &#8220;judges create legitimacy problems for themselves, undermine their legitimacy, when they don\u2019t act so much like courts and when they don\u2019t do things that are recognizably law.&#8221;<\/p>\n<p>And during an event in Montana, she argued: &#8220;If, over time, the court loses all connection with the public\u00a0and with public sentiment, that is a dangerous thing for democracy.&#8221;<\/p>\n<p>Chief Justice <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/john-roberts\">John Roberts<\/a> sought to formulate his own response to Kagan&#8217;s position during a speaking event in Colorado, <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/john-roberts-roe-reversal-supreme-court-leaker-investigation\" target=\"_blank\" rel=\"noopener\">saying<\/a> that simple disagreement with an opinion &#8220;is not a basis for questioning the legitimacy of the court.&#8221;<\/p>\n<p>It&#8217;s unclear when was the last time that the justices quarreled back and forth with each other via statements to the press.<\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/b><\/p>\n<p>Alito&#8217;s remarks come on the same week the Supreme Court announced the <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/scotus-oral-arguments-continue-online-streaming-building-closed\" target=\"_blank\" rel=\"noopener\">continuation<\/a> of livestreamed oral arguments for the fall 2022-23 term. Although the building will remain partially closed to the public, people can now request to attend oral argument hearings before the nine-member bench.<\/p>\n<p>Justices will begin oral arguments for the new term next week, beginning with the case <i><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/sackett-v-epa\">Sackett v.
