An application to receive the student debt relief is expected in early October.<\/p>\n<p>Arizona\u2019s legal challenge, filed in a federal court in Arizona against Biden, Education Secretary Miguel Cardona, and the Department of Education, challenges Biden\u2019s authority to cancel the student debt. The state of Arizona is asking the court to declare Biden\u2019s federal student debt relief unconstitutional and otherwise not in accordance with the law, and stop it from going ahead.<\/p>\n<p>\u201cThe Biden administration does not have the authority to cancel student debt,\u201d Arizona Attorney General Mark Brnovich\u2019s office <a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mark-brnovich-sues-over-biden-administrations-student-loan\">announced<\/a> on Thursday. \u201cDespite being told by members of congress he cannot pursue such an action, Biden is relying on the Higher Education Relief Opportunities for Students Act (HEROES Act) and the COVID-19 pandemic.\u201d<\/p>\n<p>According to the lawsuit (<a href=\"https:\/\/www.azag.gov\/sites\/default\/files\/docs\/press-releases\/2022\/complaints\/Student%20Loan%20Debt%20Cancellation%20Complaint%20FINAL_0.pdf\">pdf<\/a>), the student debt relief is \u201cputatively based on using the COVID-19 pandemic to invoke the [HEROES Act].\u201d<\/p>\n<p>Brnovich\u2019s office noted that the HEROES Act was a response to the attacks of Sept. 11, 2001, to \u201crelieve active-duty personnel from financial hardship while defending our nation.\u201d The act also provided for people who reside in disaster<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The state of Arizona on Thursday filed a federal suit against the Biden administration challenging President Joe Biden\u2019s move to cancel billions in student loan debt.
