However, the judge said he would revisit his ruling after Durham\u2019s team had presented its full case during the October trial. Trenga, a George W. Bush appointee who has <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/judge-sets-trial-date-for-steele-source-represented-by-law-firm-linked-to-clinton\">sat on the Foreign Intelligence Surveillance Court<\/a>, added that \u201cI think it\u2019s an extremely close call, particularly with count one\u201d related to longtime Hillary Clinton ally Chuck Dolan. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/gop-wants-answers-fbi-making-danchenko-paid-informant\">GOP WANTS ANSWERS ON FBI MAKING STEELE SOURCE A PAID INFORMANT<\/a><\/b> <\/p>\n<div class=\"Enhancement\">\n<div class=\"Enhancement-item\">\n<figure class=\"Figure mb-1 mb-sm-3 mb-md-1 article-lead-photo data_invisible\" data-align=\"center\" data-image-size=\"fixed\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\">\n<div class=\"Figure-container\"><source media=\"(max-width: 768px)\" type=\"image\/webp\" data-image-size=\"1060x600_md\" \/><source media=\"(max-width: 768px)\" data-image-size=\"1060x600_md\" \/><source media=\"(max-width: 1440px)\" type=\"image\/webp\" data-image-size=\"1060x600_xl\" \/><source media=\"(max-width: 1440px)\" data-image-size=\"1060x600_xl\" \/><source type=\"image\/webp\" data-image-size=\"1060x600\" \/><source data-image-size=\"1060x600\" \/><figcaption class=\"Figure-caption\" itemprop=\"caption\">\n                John Durham and Igor Danchenko.<br \/>\n               <\/figcaption><\/div>\n<\/figure><\/div>\n<\/p><\/div>\n<p>The November 2021 indictment said Danchenko anonymously sourced a fabricated claim about Trump campaign manager Paul Manafort to Dolan, who spent years, including 2016, <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/pr-executive-1-identified-as-longtime-clinton-adviser-who-fed-falsehood-to-steele-source\">doing work in Russia.<\/a><\/u> Danchenko also allegedly <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/key-durham-witness-sergei-millian-unlikely-testify-danchenko\">lied to the FBI about a phone call he claimed he received from Sergei Millian<\/a><\/u>, who Danchenko claimed told him about a conspiracy of cooperation between Trump and the Russians. <\/p>\n<p>The judge said he &#8220;has to conclude at this point&#8221; that he couldn\u2019t say definitively that Danchenko\u2019s statement related to Dolan was literally true, concluding that \u201cthere are sufficient arguments of context\u201d to allow the trial to move forward. <\/p>\n<p>Trenga also said that, regarding the Millian-related charges, he \u201ccan\u2019t conclude that there is an undisputed fact that is not actionable\u201d through criminal charges. <\/p>\n<p>The indictment <a class=\"Link\" href=\"https:\/\/www.justice.gov\/sco\/press-release\/file\/1446386\/download\">argued<\/a> that Danchenko \u201cstated falsely that he had never communicated with\u201d Dolan \u201cabout any allegations contained\u201d in the dossier, while \u201cin truth and in fact, and as Danchenko well knew, Danchenko sourced one or more specific allegations\u201d in the dossier anonymously to Dolan. <\/p>\n<p>Danchenko lawyer Stuart Sears began by telling the judge that \u201cthis isn\u2019t even a close call, in my opinion\u201d because \u201ca literally true statement cannot be charged as a false statement.\u201d Sears repeatedly pointed out that the <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/fbi\">FBI<\/a> had asked Danchenko if he had ever \u201ctalked\u201d with Dolan about the dossier, with the defense arguing \u201ctalked\u201d doesn\u2019t necessarily include written communications. <\/p>\n<p>An FBI agent had asked Danchenko: \u201cBut you had never talked to [Dolan] about anything that showed up in the dossier right?\u201d The defendant had replied, \u201cNo.\u201d The agent followed up, \u201cYou don&#8217;t think so?\u201d Danchenko replied, \u201cNo. We talked about, you know, related issues perhaps but no, no, no, nothing specific.\u201d <\/p>\n<p>\u201cIt was a bad question, but that\u2019s the special counsel\u2019s problem, not Mr. Danchenko\u2019s,\u201d Sears told the judge, adding, \u201cHis answer to that question was 100% accurate.\u201d The defense lawyer contended that \u201ctalked\u201d was the key to the FBI\u2019s question because the indictment \u201conly alleges they exchanged an email.\u201d <\/p>\n<p>Durham later argued that Danchenko\u2019s claims about his Dolan statements being \u201cliterally true\u201d have to \u201crevolve around\u201d wrongly taking the statement in \u201cisolation.\u201d <\/p>\n<p>The special counsel said that \u201cone has to look at these matters in context\u201d and that in context, it was clear the FBI was asking Danchenko about any and all communications he may have had about the dossier with Dolan, arguing that Danchenko was \u201ckeenly\u201d and \u201cfully aware\u201d of \u201cthe fact of what the FBI was looking for\u201d as the bureau <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-danchenko-lies-about-pee-tape-sourcing-evidence-trial\">attempted to ascertain the truthfulness or falsity of the dossier.<\/a> <\/p>\n<p>Durham pointed out that Danchenko brought a copy of the Democratic-funded dossier to an FBI meeting and said he had reviewed it, showing he knew what the FBI was interested in. The special counsel said the jury, not the judge, should decide whether the evidence shows that \u201che did know it was untrue.\u201d <\/p>\n<p>The special counsel pointed out that Danchenko did not proactively provide the FBI with the email exchange with Dolan that is now at the center of the indictment. <\/p>\n<p>Durham also said \u201cthe evidence in this case will show\u201d that in other instances, Danchenko had personally referred in written discussions on social media to having spoken to someone. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/b> <\/p>\n<p>Sears retorted again that \u201cthere is no context in which that statement is false\u201d because it was \u201cliterally true.\u201d <\/p>\n<p>Danchenko was also hit with four false statement charges for when he \u201cstated falsely\u201d in multiple FBI interviews that he received an anonymous phone call from Millian in July 2016.
