Administration officials estimate over 40 million Americans are eligible.<\/p>\n<p>The problem, according to the new suit, is that the justification for the move doesn\u2019t hold.<\/p>\n<p>The Department of Education asserted that the\u00a0Higher Education Relief Opportunities for Students Act of 2003 (HEROES Act) as giving the authority to cancel so much debt for so many people due to the COVID-19 pandemic. The law enables the education secretary to\u00a0\u201cwaive or modify any statutory or regulatory provision applicable to the student financial assistance programs \u2026\u00a0in connection with a war or other military operation or national emergency.\u201d The administration cited the COVID-19 pandemic as the national emergency.<\/p>\n<p>But even the Department of Justice\u2019s legal opinion (<a href=\"https:\/\/www.justice.gov\/sites\/default\/files\/opinions\/attachments\/2022\/08\/24\/2022-08-23-heroes-act.pdf\">pdf<\/a>) ostensibly in support of the move concluded that any cancellation\u00a0must be \u201cstructured to put loan recipients back into the financial position they would be in were it not for the national emergency\u201d and\u00a0limited only to the harm that has a relation to the borrower\u2019s federal loans, \u201cno matter how much [total] financial harm a borrower may have suffered because of a national emergency,\u201d the suit notes.<\/p>\n<p>\u201cThe Biden Administration\u2019s Mass Debt Cancellation does not even attempt to meet these requirements.
