To comply with California law, ICE would have to cease its ongoing immigration detention operations in California and adopt an entirely new approach in the state,\u201d Nguyen wrote. \u201cThis foundational limit on state power cannot be squared with the dramatic changes that AB 32 would require ICE to make.\u201d<\/p>\n<p class=\"p1\">The state was <a href=\"https:\/\/www.latimes.com\/california\/story\/2022-09-26\/court-says-california-ban-on-private-ice-detention-facilities-is-unconstitutional\">sued<\/a> by the federal government and a federal contractor, which asked that the law\u2019s execution be blocked by injunction. A district court refused.<\/p>\n<p class=\"p1\">Last year, three judges on the 9th Circuit Court of Appeals <a href=\"https:\/\/apnews.com\/article\/immigration-donald-trump-gavin-newsom-san-diego-california-ba5b3ef5a1398fe7ab2ca6bf31627878\" target=\"_blank\" rel=\"noopener\">decided<\/a> that the measure was in conflict with the powers of the federal government.<\/p>\n<p class=\"p1\">\u201cAB 32 cannot stand because it conflicts with this federal power and discretion given to the Secretary (of Homeland Security) in an area that remains in the exclusive realm of the federal government, and it bars the Secretary from doing what federal immigration law explicitly permits him or her to do,\u201d Judge Kenneth Lee wrote.<\/p>\n<p>California Attorney General Rob Bonta then asked that a larger panel review the ruling, <a href=\"https:\/\/www.politico.com\/news\/2022\/09\/27\/court-blocks-california-prison-ban-00058967\">according<\/a> to Politico. This week, the higher court got <a href=\"https:\/\/www.latimes.com\/california\/story\/2022-09-26\/court-says-california-ban-on-private-ice-detention-facilities-is-unconstitutional\">rid<\/a> of the lower court\u2019s ruling refusing an injunction and returned it to be reviewed.<\/p>\n<p class=\"p1\">The 2019 law, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB32\" target=\"_blank\" rel=\"noopener\">Assembly Bill 32<\/a>, would not have allowed the Department of Corrections and Rehabilitation to incarcerate anyone in a \u201cprivate, for-profit prison facility\u201d after January 1, 2028. Governor Gavin <a href=\"https:\/\/www.dailywire.com\/topic\/gavin-newsom\" target=\"_blank\" rel=\"noopener\">Newsom<\/a> (D-CA) signed the law in 2019, and it was originally sponsored by Bonta when he was in the California Assembly.\u00a0<\/p>\n<p class=\"p1\">Bonta\u2019s office said it is looking over the ruling but is \u201cdeeply disappointed\u201d by it.
