However, in an unsigned <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/092222zr_gfbh.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">order<\/a>, a divided Supreme Court vacated that judge\u2019s ruling, permitting the execution to go through. All four female justices \u2014 Sonia Sotomayor, Elena Kagan, Amy Coney Barrett, and Ketanji Brown Jackson \u2013 dissented.<\/p>\n<p>In 2018, Alabama passed a <a href=\"https:\/\/arc-sos.state.al.us\/ucp\/B18081AA.AVH.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">law<\/a> that gave death row prisoners the choice to be killed by a new method: nitrogen hypoxia, in which a person is fatally deprived of oxygen.<\/p>\n<p>Miller, who was convicted of <a href=\"https:\/\/www.washingtonpost.com\/wp-srv\/national\/longterm\/workshooting\/stories\/alabama080699.htm\" rel=\"noopener noreferrer\" target=\"_blank\">murdering<\/a> three men in 1999, claimed that he had a fear of needles and preferred to be executed via nitrogen hypoxia. The state argued that Miller never made the request for nitrogen hypoxia and sought to move forward with lethal injection.<\/p>\n<p>After the Supreme Court\u2019s order, prison officials began trying to insert an IV line into Miller\u2019s veins. However, the state was not able to complete the process before midnight, when Miller\u2019s death warrant expired, according to <a href=\"https:\/\/www.nytimes.com\/2022\/09\/23\/us\/alan-miller-alabama-execution.html\" rel=\"noopener noreferrer\" target=\"_blank\">the New York Times<\/a>. \u201cDue to time constraints resulting from the lateness of the court proceedings, the execution was called off once it was determined the condemned inmate\u2019s veins could not be accessed in accordance with our protocol before the expiration of the death warrant,\u201d <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-alabama-executions-d028c2d62f0e0fa919797030b06c30b0\" rel=\"noopener noreferrer\" target=\"_blank\">said<\/a> Alabama Corrections Commissioner John Hamm.<\/p>\n<p>Miller ended up being returned to his prison cell.<\/p>\n<p>In recent years, Alabama has had several incidents related to botched executions. In 2018, the state called off the execution of Doyle Hamm after being \u201cunable to establish an intravenous line,\u201d reports the <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-alabama-executions-d028c2d62f0e0fa919797030b06c30b0\" rel=\"noopener noreferrer\" target=\"_blank\">Associated Press<\/a>.<\/p>\n<p>\u201cThe Alabama Department of Corrections verges somewhere between malpractice and butchery,\u201d <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-alabama-executions-d028c2d62f0e0fa919797030b06c30b0\" rel=\"noopener noreferrer\" target=\"_blank\">said<\/a> Bernard Harcourt, a lawyer who represented Doyle Hamm, according to the AP. \u201cWhat it demonstrates is we really shouldn\u2019t be given this incompetent bureaucrats the power over life and death.\u201d<\/p>\n<p>The New York Times reports that it was not immediately clear when the state would try to execute Miller again.
