After warning Brady and other parents present that they needed to vacate the area, police officers proceeded to arrest Brady, much to the dismay of the other parents.<\/p>\n<p>\u201cHe is arresting her for being on a public playground,\u201d one witness said in a video documenting Brady\u2019s arrest.<\/p>\n<p>Following her detainment, the Meridian Police Department charged Brady with trespassing for failing \u201cto adhere to the rules [in these] trying times.\u201d<\/p>\n<p>The incident also sparked the launch of protests supporting Brady, which were held outside the locality\u2019s city hall.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"XJ3cIeumxCNZBWPU1EDrOQ4Rl8MKAdv0zogsw69LS7akiyFGHh\"><\/p>\n[embedded content]\n<p><\/span>\n<\/div>\n<\/figure>\n<p>\u201cYou don\u2019t expect when you take your kids to a playground and you\u2019re just simply trying to redress an officer for a grievance of a playground closure to end up in an arrest. I never went there that day and anticipated that,\u201d Brady said in an interview with The Federalist.<\/p>\n<p>While the arrest of the Idaho mother of two was outrageous to begin with, what\u2019s even more abhorrent is that Brady is still currently being prosecuted by the office of the state\u2019s Republican attorney general, Lawrence Wasden. <\/p>\n<p>After spending about $25,000 on four sets of lawyers, Brady was finally given her day in court last Tuesday when oral arguments were heard following two years of her trial repeatedly getting delayed due to Covid restrictions. During the Sept. 20 hearing, Brady\u2019s attorney, Seth Diviney, made the motion to have the trespassing charges against Brady dropped and <a href=\"https:\/\/www.msn.com\/en-us\/news\/crime\/meridian-mom-arrested-at-park-during-covid-seeks-case-dismissal\/ar-AA123Vzd\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> \u201csome arguments about the constitutionality of the charges, and whether or not they involve free speech.\u201d<\/p>\n<p>\u201cIt\u2019s exhausting to go two and a half years, that\u2019s a really long time to fight the state of Idaho, who has unlimited resources, and can continue to prosecute this indefinitely,\u201d Brady said. \u201cOur family has been through so much. We\u2019ve been doxxed, we\u2019ve been harassed, we\u2019ve had [Child Protective Services] called on us simply for me taking my kids to a playground. And knowing what we know now about Covid and all the falsehoods that have been perpetrated on the American people, the fact that they\u2019re still prosecuting me just adds insult to injury.\u201d<\/p>\n<p>According to Brady, her case is being prosecuted by Ken Jorgensen, who, in addition to representing the state in the trial, is one of Wasden\u2019s deputy attorneys general.<\/p>\n<p>\u201cI just knew if they [were] making it such a big deal for me to take my children to a playground, I had to hold strong and I ha[d] to keep going to the end, because at the end of the day, I didn\u2019t do anything wrong,\u201d Brady said.<\/p>\n<p>Wasden did not return The Federalist\u2019s request for comment about why his office has\u00a0continued to prosecute Brady, especially given the widely known, scientific data showing the <a href=\"https:\/\/www.foxnews.com\/opinion\/greg-gutfeld-despite-statistics-showing-low-outdoor-covid-spread-media-peddles-fear\" target=\"_blank\" rel=\"noreferrer noopener\">low transmissibility of Covid outdoors<\/a>, the <a href=\"https:\/\/thefederalist.com\/2022\/03\/24\/while-everyone-else-panicked-two-years-ago-the-federalist-was-right-about-lockdowns-doing-more-harm-than-good\/\" target=\"_blank\" rel=\"noreferrer noopener\">failure of lockdown-style policies<\/a>, and the <a href=\"https:\/\/thefederalist.com\/2020\/05\/21\/stop-fear-mongering-kids-are-safer-from-covid-19-than-everyone-else\/\" target=\"_blank\" rel=\"noreferrer noopener\">extremely low risk Covid poses to children<\/a>.<\/p>\n<p>Led by Republican Gov. Brad Little, Idaho instituted some of the most illogical Covid policies among Republican-led states. On March 25, 2020, Little <a href=\"https:\/\/gov.idaho.gov\/pressrelease\/governor-little-issues-statewide-stay-home-order-signs-extreme-emergency-declaration\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a statewide <a href=\"https:\/\/adacounty.id.gov\/wp-content\/uploads\/2020\/03\/statewide-stay-home-order_032520.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">stay-at-home order<\/a>, which forced government-deemed \u201cnon-essential\u201d businesses to close their doors, including \u201cbars, nightclubs, gyms, recreational facilities,\u201d and \u201centertainment venues,\u201d among others.<\/p>\n<p>But Little\u2019s horrid Covid mismanagement didn\u2019t stop there. In January 2021, the GOP governor released a <a href=\"https:\/\/gov.idaho.gov\/pressrelease\/idaho-legislatures-actions-threaten-vaccine-rollout-and-idahos-prosperity\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> decrying efforts by the Idaho legislature to end his Covid emergency declaration, saying it was \u201ccritical in order for Idaho to receive federal assistance\u201d and that the idea that the order \u201csomehow shuts down Idaho or takes away your rights\u201d is a \u201cmyth\u201d and \u201cpatently false.\u201d<\/p>\n<p>Moreover, Little previously attempted to guilt-trip Idahoans into getting the Covid shot by claiming the jab is the \u201cbest shot at keeping kids in school.\u201d<\/p>\n<p>\u201cOur students need to be able to learn in their classrooms with their teachers and peers. We can give our kids the best chance at a normal school year if more Idahoans choose to receive the vaccine,\u201d he said in an August 2021 <a href=\"https:\/\/gov.idaho.gov\/pressrelease\/opinion-vaccine-is-our-best-shot-at-keeping-kids-in-school\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. \u201cTo those friends and neighbors of ours waiting to receive the vaccine, the time to get the vaccine is now \u2014 when our students are going back to school. We can minimize or eliminate disruptions in the delivery of education, as well as sports and extracurricular activities during this school year, if more Idahoans choose to get vaccinated.\u201d<\/p>\n<p>Other nonsensical Covid-related actions taken by the Idaho governor include the <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/government-overreach-idaho-gov-brad-little-vetoes-ban-on-covid-vaccine-mandates\/ar-AAVBmR9\" target=\"_blank\" rel=\"noreferrer noopener\">vetoing<\/a> of legislation earlier this year that would have barred most private businesses from mandating the coronavirus jab for their employees.<\/p>\n<p>\u201cIdaho should be one of the most conservative states [in the country] if not the most conservative \u2026 but I think Covid really brought out the true colors of our supposed-Republican leaders,\u201d Brady said. \u201cI truly believe if I was in Florida, [Gov. Ron] DeSantis wouldn\u2019t be putting up with this. I don\u2019t think I\u2019d be being prosecuted.\u201d<\/p>\n<p>According to Brady, neither Little nor anyone else from his office has ever contacted her regarding her arrest or ongoing prosecution. <\/p>\n<p>Little did not respond to The Federalist\u2019s request for comment about whether he supports the prosecution against Brady or whether he has ever taken any action or encouraged Wasden to have his office drop the case against Brady.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
