PERC\u2019s work with Case Western University on an upcoming Supreme Court case that addresses the <a href=\"https:\/\/www.theepochtimes.com\/t-clean-water-act\">Clean Water Act<\/a>, Sackett v. EPA, is the subject of a <a href=\"https:\/\/www.perc.org\/2022\/09\/19\/perc-launches-new-conservation-law-policy-center\/\">statement<\/a>\u00a0from the nonprofit research institute, which says on its website that it\u2019s \u201cdedicated to advancing conservation through markets, incentives, property rights, and partnerships.\u201d<\/p>\n<p>The organization\u2019s <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-454\/221303\/20220418150428150_Brief%20amici%20curiae%20of%20Property%20and%20Environment%20Research%20Center.pdf\">legal brief<\/a>\u00a0in the case sided with Mike and Chantell Sackett, a couple who wanted to construct a home on their own property. More specifically, PERC supported the Sacketts\u2019 effort to get a hearing before the Supreme Court.<\/p>\n<p> <a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/21\/Supreme-Court-GettyImages-1404231177-1200x800.jpg\"><\/a> The Supreme Court building in Washington on June 21, 2022. (Anna Moneymaker\/Getty Images) <\/p>\n<p>The EPA claimed that the Sacketts\u2019 property is a federally protected wetland, meaning they need a federal permit to build on it.<\/p>\n<p>PERC\u2019s brief argues for a \u201cclear standard that landowners and others can reasonably apply on the ground,\u201d asserting that Sackett v. EPA could help the court articulate such a standard.<\/p>\n<p>By contrast, environmental groups such as the Idaho Conservation League, the Izaak Walton League, and many others backed the EPA.<\/p>\n<p>The Idaho Conservation League\u2019s <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-454\/228334\/20220617143504924_21-454%20Amicus%20Idaho%20Conservation%20League.pdf\">brief<\/a> contends that the Sackett wetlands are closely connected with Priest Lake, which they argue falls under navigable waters of the United States.<\/p>\n<p>That connection, they argue, means the Sackett wetlands are themselves waters of the United States.
