Bush appointee, was chosen by Trump attorneys and Department of Justice (DOJ) lawyers and put into place by U.S. District Judge Aileen Cannon, a Trump appointee. Trump and the DOJ can object to components of the plan; Cannon would adjudicate any objections.<\/p>\n<h2>Declaration<\/h2>\n<p>Dearie\u2019s <a href=\"https:\/\/www.documentcloud.org\/documents\/22672328-dearie-case-management-plan\">case management plan<\/a> starts with having a government official \u201cwith sufficient knowledge of the matter\u201d submitting a declaration or affidavit regarding <a href=\"https:\/\/www.theepochtimes.com\/us-government-seized-over-11000-non-classified-documents-from-trumps-home_4706797.html\">an inventory list<\/a> DOJ officials have released.<\/p>\n<p>The official would attest that the list \u201crepresents the full and accurate extent of the property seized from\u201d from Mar-a-Lago, Trump\u2019s Florida residence.<\/p>\n<p>If the plan is put into place, Trump would then respond with a list of any items listed by the government that were not seized from Mar-a-Lago.<\/p>\n<p>Trump would also detail items that were seized but not included in the inventory.<\/p>\n<p>\u201cThis submission shall be Plaintiff\u2019s final opportunity to raise any factual dispute as to the completeness and accuracy of the Detailed Property Inventory,\u201d Dearie said.<\/p>\n<p>The government would then be allowed to respond to Trump.<\/p>\n<h2>Seized Materials<\/h2>\n<p>Based on <a href=\"https:\/\/www.theepochtimes.com\/appeals-court-allows-doj-to-regain-access-to-classified-documents-seized-from-mar-a-lago_4746924.html\">an appeals court order<\/a>, Cannon earlier Tuesday <a href=\"https:\/\/www.theepochtimes.com\/judge-in-trump-records-case-blocks-special-master-from-viewing-materials-with-classified-markings_4748013.html\">blocked Dearie<\/a>\u00a0and Trump lawyers from viewing the roughly 100 materials that were marked classified and seized from Mar-a-Lago.<\/p>\n<p>Dearie and the Trump attorneys are still poised to review each page of non-classified materials taken from the resort.<\/p>\n<p>Dearie wants the government to list each document and say whether the government filter team identified the document as potentially covered by a form of privilege, such as attorney-client privilege. Trump\u2019s team has already received an initial set of potentially privileged documents, according to Dearie. After Trump\u2019s team reviews the materials, they would specify any privilege claims, including any claims for documents that were not deemed potentially privileged by the government. Dearie will resolve any disputes on privilege.<\/p>\n<p>The final log of privilege designations is due to Dearie on or before Oct. 21.<\/p>\n<h2>Delay on Ruling<\/h2>\n<p>The special master will not decide whether Trump shall receive any of the seized materials back until after Cannon rules on any objections to his plan.<\/p>\n<p>Trump has already motioned for the return of property.<\/p>\n<p>Trump must submit a brief in support of the motion no less than seven days after Cannon finishes ruling on the case management plan and any objections. The government will then respond, and Trump can respond to the government\u2019s response.<\/p>\n<p>Either party can request an oral argument.<\/p>\n<p>Dearie said that he will \u201cpromptly issue a report and recommendation after briefing and oral argument has been completed.\u201d Cannon has the final say on the motion.<\/p>\n<h2>Request for Help<\/h2>\n<p>Dearie wants permission to bring on a retired judge for assistance.<\/p>\n<p>Former U.S. Magistrate Judge James Orenstein \u201chas experience with complex case management, privilege review, warrant procedures, and other matters that may arise in the course of the Special Master\u2019s duties,\u201d Dearie wrote.<\/p>\n<p>Magistrate judges are appointed by other judges.<\/p>\n<p>Orenstein has worked with the\u00a0Foreign Intelligence Surveillance Court\u2014Dearie served on that court for years\u2014and holds top secret clearance.<\/p>\n<p>Orenstein should be compensated at $500 an hour, Dearie said.<\/p>\n<p>Trump is paying for all of the costs associated with the special master\u2019s work.<\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-zachary-stieber\"><\/a><\/p>\n<p>Follow<\/p>\n<\/div>\n<p>Zachary Stieber covers U.S. and world news.
