We\u2019re still doing a lotta work on it \u2026 but the pandemic is over.<\/p>\n<p>\u201cIf you notice, no one\u2019s wearing masks. Everybody seems to be in pretty good shape. And so I think it\u2019s changing. And I think this is a perfect example of it.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Two weeks ago, 850 more teachers were fired in New York because they weren\u2019t \ud83d\udc89, yet Biden goes on <a href=\"https:\/\/twitter.com\/60Minutes?ref_src=twsrc%5Etfw\">@60Minutes<\/a> yesterday and announces the pandemic is over and nobody is masking anymore.<\/p>\n<p>More evidence that covid policies have largely been political theatre. Midterms are coming. <a href=\"https:\/\/t.co\/S1MEmJElCM\">pic.twitter.com\/S1MEmJElCM<\/a><\/p>\n<p>\u2014 Castaway_RN (@Tinfoil_Travis) <a href=\"https:\/\/twitter.com\/Tinfoil_Travis\/status\/1571891176390918145?ref_src=twsrc%5Etfw\">September 19, 2022<\/a><\/p>\n<\/blockquote>\n<p>In the same interview, Biden also said the \u201cimpact on the psyche of the American people as a consequence of the pandemic is profound.\u201d<\/p>\n<p>Following Biden\u2019s \u201cthe pandemic is over\u201d declaration on Sunday, COVID-19 vaccine manufacturers on Monday lost more than a combined $9 billion market value in a stock\u00a0<a href=\"https:\/\/www.ft.com\/content\/c6fcbde9-9575-4c9c-a6eb-2c8796c2c5cb\">sell-off<\/a>. The companies\u2019 shares\u00a0<a href=\"https:\/\/www.msn.com\/en-us\/money\/markets\/moderna-biontech-and-novavax-plunge-after-president-biden-says-the-covid-19-pandemic-is-over\/ar-AA120zWP\">dropped<\/a>\u00a0as much as 9%.<\/p>\n<h2><strong>No End in Sight to COVID \u2018Public Health Emergency\u2019<\/strong><\/h2>\n<p>Following Biden\u2019s declaration, Sarah Lovenheim, a spokesperson for the U.S. Department of Health and Human Services (HHS),\u00a0<a href=\"https:\/\/www.washingtonpost.com\/health\/2022\/09\/18\/biden-covid-pandemic-over\/\">said<\/a>\u00a0the federal\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/biden-covid-vaccine-distribution-private-sector\/\">public health emergency<\/a>\u00a0\u201cremains in effect\u201d and that a 60-day notice would be provided by the agency before it is rescinded.<\/p>\n<p>A 60-day period means that the earliest possible date when the emergency declaration would be lifted is in late November \u2014 well past the current Oct. 15 expiration date.<\/p>\n<p>HHS first declared the public health emergency on Jan. 31, 2020, and renewed it 10 times since, most recently on\u00a0<a href=\"https:\/\/aspr.hhs.gov\/legal\/PHE\/Pages\/covid19-15jul2022.aspx\">July 15<\/a>.<\/p>\n<p>Remarking on the \u201cpublic health emergency\u201d remaining in effect even after Biden declared the pandemic \u201cover,\u201d Mary Holland, president and general counsel of<a href=\"https:\/\/childrenshealthdefense.org\/\">\u00a0Children\u2019s Health Defense<\/a>, told\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a>:<\/p>\n<p>\u201cIt is an outrage that Biden has declared the pandemic over and yet federal and state emergencies and COVID-19 vaccine mandates remain.<\/p>\n<p>\u201cIf it\u2019s over, it\u2019s over! No emergencies, no lockdowns, no mandates, no testing, no masks. Anything else is not only incoherent, it\u2019s the essence of tyranny \u2014 pointless, cruel restrictions that destroy lives.\u201d<\/p>\n<p>Holland said if HHS follows Biden\u2019s \u201cpandemic is over\u201d guidance and ends the federal public health emergency at the next opportunity on Oct. 15, the move will raise a host of liability and legal questions around COVID-19 vaccines and other Emergency Use Authorization (EUA) products, including tests and masks.<\/p>\n<p>\u201cThe government seems to imagine it can call the pandemic over, reverse CDC guidance, yet continue to cling to emergency powers and mandate extraordinarily dangerous shots that don\u2019t stop infection or transmission of disease,\u201d Holland said.<\/p>\n<p>\u201cI do not believe the people or the courts will allow this absurd and dangerous situation to continue much longer.\u201d<\/p>\n<p>Some Republican lawmakers also questioned why the public health emergency will be renewed if the pandemic is \u201cover,\u201d\u00a0<a href=\"https:\/\/www.washingtonpost.com\/health\/2022\/09\/18\/biden-covid-pandemic-over\/\">The Washington Post reported<\/a>.<\/p>\n<p>In turn, some White House staffers \u2014 in particular, senior health officials \u2014 reportedly were caught \u201coff guard\u201d and \u201c<a href=\"https:\/\/www.politico.com\/news\/2022\/09\/19\/biden-pandemic-over-covid-team-response-00057649\">surprised<\/a>\u201d by Biden\u2019s remarks.<\/p>\n<p>Biden\u2019s declaration \u201chas thrown a wrench into the White House\u2019s efforts to secure additional funding to fight the virus and persuade Americans to get a new\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/covid-boosters-no-human-trials\/\">booster shot<\/a>,\u201d according to the Post.<\/p>\n<p>In an appearance on MSNBC on Tuesday, U.S. Surgeon General Dr. Vivek Murthy contradicted Biden,\u00a0<a href=\"https:\/\/www.thegatewaypundit.com\/2022\/09\/us-surgeon-general-vivek-murthy-contradicts-joe-biden-says-covid-pandemic-not-video\/\">stating<\/a>\u00a0that the pandemic is not over because \u201cwe\u2019re losing about 400 people a day on average to this virus,\u201d adding his view that \u201cwe need to get that number lower. We have people who are struggling with long COVID.\u201d<\/p>\n<p>As for the timing of Biden\u2019s statement,\u00a0<a href=\"https:\/\/www.statnews.com\/2022\/09\/19\/is-the-covid-19-pandemic-over-the-answer-is-more-art-than-science\/\">an article<\/a>\u00a0in STAT noted, \u201cThere are no accepted metrics or defined international rules\u201d for when a pandemic has \u201cended.\u201d<\/p>\n<p>\u201cIt\u2019s over when people decide that it\u2019s over,\u201d John Barry, author of \u201c<a href=\"https:\/\/www.goodreads.com\/book\/show\/29036.The_Great_Influenza\">The Great Influenza: The Story of the Deadliest Pandemic in History<\/a>,\u201d a book chronicling the history of the 1918 Spanish flu, told STAT. \u201cAnd most people seem to have decided it\u2019s over.\u201d<\/p>\n<h2><strong>Administration Dials Back Covid-Related Restrictions as Midterm Elections Loom<\/strong><\/h2>\n<p>The Biden administration has turned the focus of its messaging to the \u201cimportance of getting vaccinated and receiving booster shots,\u201d and to the \u201cwide availability of\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/stephen-colbert-covid-pfizer-paxlovid\/\">antiviral pills<\/a>\u00a0and other forms of treatment for those who contract the virus,\u201d\u00a0<a href=\"https:\/\/thehill.com\/policy\/healthcare\/3649751-biden-the-pandemic-is-over\/\">The Hill reported<\/a>.<\/p>\n<p>As\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/biden-covid-vaccine-distribution-private-sector\/\">The Defender reported<\/a>\u00a0earlier this month, Biden purchased 170 million doses of updated COVID-19 booster shots, which will be made available to the public as part of an autumn vaccination campaign.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The Biden administration plans to shift distribution of COVID-19 therapeutics to the private sector by January 2023 \u2014 despite preparing to extend its COVID-19 public health emergency.<a href=\"https:\/\/t.co\/oSDiazOPo1\">https:\/\/t.co\/oSDiazOPo1<\/a><\/p>\n<p>\u2014 Robert F. Kennedy Jr (@RobertKennedyJr) <a href=\"https:\/\/twitter.com\/RobertKennedyJr\/status\/1567153741631037440?ref_src=twsrc%5Etfw\">September 6, 2022<\/a><\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/edition.cnn.com\/2022\/09\/19\/health\/biden-pandemic-comments-public-health\/index.html\">According to CNN<\/a>, Biden\u2019s remarks are aligned with the results of a recent\u00a0<a href=\"https:\/\/www.ipsos.com\/en-us\/news-polls\/axios-ipsos-coronavirus-index\">Axios\/Ipsos poll<\/a>\u00a0indicating 46% of Americans \u2014 the highest level since the start of the pandemic \u2014 say they have resumed their normal activities.<\/p>\n<p>In February,\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/internal-memo-biden-cdc-following-poll-numbers-not-science\/\">The Defender reported<\/a>\u00a0that an internal memo from an influential polling firm advised the Biden administration \u2014 in the face of flagging poll numbers and feelings of fatigue on the part of the public towards COVID-19 countermeasures and mandates \u2014 to present itself as having \u201cdefeated\u201d COVID-19.<\/p>\n<p>Biden\u2019s most recent remarks \u2014 delivered as midterm elections are looming \u2014 are the latest, and most explicit, in a recent pattern of statements and announcements from his administration that have begun to walk back the prevailing narrative of the past two-plus years.<\/p>\n<p>The Centers for Disease Control and Prevention (CDC) announced Aug. 11 the\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/cdc-backtracks-covid-guidance-damning-studies-cola\/\">reversal<\/a>\u00a0of its COVID-19 guidance, rescinding its previous distinctions between the vaccinated and unvaccinated.<\/p>\n<p>This was followed by the CDC\u2019s Aug. 17 announcement that the\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/cdc-covid-response-pharma-public-health\/\">agency will undergo an \u201coverhaul\u201d<\/a>\u00a0as a result of its \u201cbotched\u201d response to COVID-19.<\/p>\n<p>On Aug. 30, the Biden administration\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/biden-covid-vaccine-distribution-private-sector\/\">announced<\/a>\u00a0plans to shift distribution of COVID-19 therapeutics to the private sector by January 2023.<\/p>\n<p>On Aug. 31, the administration\u00a0<a href=\"https:\/\/www.shrm.org\/resourcesandtools\/legal-and-compliance\/employment-law\/pages\/no-vaccine-mandate-federal-contractors.aspx\">updated<\/a>\u00a0its\u00a0<a href=\"https:\/\/www.saferfederalworkforce.gov\/contractors\/\">guidance<\/a>\u00a0for federal contractors in relation to the COVID-19 vaccine mandate. Under the new guidance, the federal government will not take any action to implement or enforce\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/09\/09\/executive-order-on-ensuring-adequate-covid-safety-protocols-for-federal-contractors\/\">Executive Order 14042<\/a>, which mandated the COVID-19 vaccines for federal contractors.<\/p>\n<p>This shift comes in the aftermath of a recent\u00a0<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202114269.pdf\">federal court decision<\/a>\u00a0that\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/bb-court-narrows-hold-covid-vaccine-mandate-contractors\/\">narrowed<\/a>\u00a0the scope of the Biden administration\u2019s mandate for federal contractors.<\/p>\n<p>In a\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/22419165-sen-richard-burrs-letter-to-president-biden-on-whether-pandemic-is-over\">letter<\/a>\u00a0sent to Biden following his declaration that the pandemic was over, Sen. Richard Burr (R-N.C.), the leading Republican on the Senate\u2019s health panel,\u00a0<a href=\"https:\/\/www.washingtonpost.com\/health\/2022\/09\/18\/biden-covid-pandemic-over\/\">asked<\/a>\u00a0the president when vaccination requirements for federal workers and contractors would be fully lifted and more federal employees allowed to return to in-office employment.<\/p>\n<p>But\u00a0<a href=\"https:\/\/www.amazon.com\/Real-Anthony-Fauci-Democracy-Childrens\/dp\/1510766804\">Dr. Anthony Fauci<\/a>, who in April\u00a0<a href=\"https:\/\/www.washingtonpost.com\/health\/2022\/04\/27\/pandemic-phase-over-fauci-covid\/\">said<\/a>\u00a0the U.S. was moving \u201cout of the pandemic phase,\u201d balked at Biden\u2019s statement. In\u00a0<a href=\"https:\/\/www.csis.org\/events\/future-outlook-dr-anthony-fauci\">remarks<\/a>\u00a0made Monday, Fauci\u00a0<a href=\"https:\/\/thehill.com\/policy\/healthcare\/3651195-fauci-says-we-are-not-where-we-need-to-be-after-biden-declares-pandemic-is-over\/\">said<\/a>, \u201cWe are not where we need to be if we\u2019re going to be able to \u2026 \u2018live with the virus.\u2019\u201d<\/p>\n<p>Gregg Golsalves, an epidemiologist at the Yale School of Public Health,\u00a0<a href=\"https:\/\/edition.cnn.com\/2022\/09\/19\/health\/biden-pandemic-comments-public-health\/index.html\">said<\/a>\u00a0he was \u201cdismayed\u201d by Biden\u2019s declaration, arguing, \u201cWe are terribly under-boosted and under-vaccinated in this country.\u201d<\/p>\n<p>Notably, the World Health Organization (WHO) still\u00a0<a href=\"https:\/\/thehill.com\/policy\/healthcare\/3649751-biden-the-pandemic-is-over\/\">classifies<\/a>\u00a0COVID-19 as a pandemic. However, the WHO\u2019s Director-General, Tedros Adhanom Ghebreyesus, last week\u00a0<a href=\"https:\/\/www.reuters.com\/business\/healthcare-pharmaceuticals\/who-chief-says-end-sight-covid-19-pandemic-2022-09-14\/\">said<\/a>\u00a0the \u201cend is in sight\u201d for the pandemic.<\/p>\n<h2><strong>Growing Number of Lawsuits Challenge Vaccine Mandates<\/strong><\/h2>\n<p>Biden\u2019s statement comes in light of the elimination, or significant loosening, of COVID-19-related mandates in the armed forces and throughout the U.S.<\/p>\n<p>\u201cThe paradoxical juxtaposition that has the president declaring the pandemic is over while New York City\u2019s Department of Education\u00a0<a href=\"https:\/\/nypost.com\/2022\/09\/17\/850-more-unvaxxed-nyc-teachers-school-aides-fired\/\">fires 850 unvaccinated teachers and aids<\/a>\u00a0shows once again that the governmental purpose is coercion and not public health,\u201d Robert F. Kennedy, Jr., chairman of Children\u2019s Health Defense, told The Defender.<\/p>\n<p>Earlier this month, the U.S. Navy canceled \u201c<a href=\"https:\/\/www.thegatewaypundit.com\/2022\/09\/trident-order-12-disqualified-seals-duty-seeking-vaccine-mandate-religious-exemption-quietly-canceled-us-navy\/\">Trident Order #12<\/a>,\u201d which\u00a0<a href=\"https:\/\/www.thegatewaypundit.com\/2022\/09\/following-us-navys-change-vaccine-mandate-policy-us-marine-corps-follows\/\">disqualified<\/a>\u00a0SEALS who sought religious exemptions from the COVID-19 vaccine.<\/p>\n<p>The news was followed by an\u00a0<a href=\"https:\/\/www.marines.mil\/News\/Messages\/Messages-Display\/Article\/3157581\/interim-guidance-regarding-marines-requesting-religious-accommodation-from-covi\/\">administrative order<\/a>\u00a0by the U.S. Marine Corps stating that \u201ca Marine\u2019s vaccination status cannot be used against them in fitness reports or other performance evaluations,\u201d\u00a0<a href=\"https:\/\/nypost.com\/2022\/09\/17\/marine-corps-removes-harsh-covid-vax-penalties-for-religious-accommodations\/\">according to the New York Post<\/a>.<\/p>\n<p>The latest Marine Corps followed an order last month by a federal court in Florida temporarily\u00a0<a href=\"https:\/\/www.thecentersquare.com\/national\/judge-chastises-dod-marine-corps-in-order-granting-class-action-status-in-vaccine-mandate-case\/article_c3465070-1fd6-11ed-b3a8-ff177f81ada9.html\">blocking<\/a>\u00a0the Marines from taking disciplinary action against service members seeking a religious exemption.<\/p>\n<p>Separately, a\u00a0<a href=\"https:\/\/mikejohnson.house.gov\/news\/documentsingle.aspx?DocumentID=1184\">group of 47 Republican lawmakers<\/a>, led by Rep. Mike Johnson (R-La.), last week submitted a letter to U.S. Secretary of Defense Lloyd Austin\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/congress-pentagon-revoke-military-covid-vaccine-mandate\/\">calling on<\/a>\u00a0the U.S. Department of Defense to fully withdraw its COVID-19 vaccine mandate for military members.<\/p>\n<p>Among other things, the letter states that 8% of the U.S. Army\u2019s 1 million soldiers face expulsion and the Army is, accordingly, facing difficulties achieving its recruitment targets<\/p>\n<p>In June,\u00a0<a href=\"https:\/\/childrenshealthdefense.org\/defender\/whistleblower-military-covid-19-vaccine-mandate\/\">The Defender reported<\/a>\u00a0that internal U.S. Army documents indicated the Army was not meeting its recruitment goals and that a larger number of service members were unvaccinated or not \u201cfully\u201d vaccinated, compared to the official data presented to the public.<\/p>\n<p>Beyond the military, various state and local government jurisdictions have also quietly been removing or loosening COVID-19-related restrictions.<\/p>\n<p>In California, a\u00a0<a href=\"https:\/\/edsource.org\/2022\/state-lifts-vaccine-mandate-for-school-staff\/678020\">new policy<\/a>\u00a0that came into effect Sept. 17 no longer requires school employees to show proof of vaccination or to be tested for COVID-19 on a weekly basis.<\/p>\n<p>In New York, Gov. Kathy Hochul on Sept. 7\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/09\/07\/new-york-mask-mandate-public-transit-correctional-facilities-00055199\">announced<\/a>\u00a0that masks are no longer mandated to be worn on public transportation and in correctional facilities, detention centers and homeless shelters.<\/p>\n<p>On Sept. 14, a New York court\u00a0<a href=\"https:\/\/nypost.com\/2022\/09\/14\/nypd-cop-cant-be-fired-for-refusing-covid-vaccine-judge\/\">ruled<\/a>\u00a0the New York Police Department could not fire an unvaccinated police officer who sued New York City over its COVID-19 vaccine mandate.<\/p>\n<p>However, the New York City Department of Education\u00a0<a href=\"https:\/\/www.newsnationnow.com\/us-news\/education\/nyc-teacher-shortage-vaccine-mandate\/\">continues<\/a>\u00a0to enforce its Sept. 5 vaccination deadline for teachers, with 850 teachers\u00a0<a href=\"https:\/\/nypost.com\/2022\/09\/17\/850-more-unvaxxed-nyc-teachers-school-aides-fired\/\">fired<\/a>\u00a0following this deadline.
